>> and that breaking news is bart. lets than an ahour away from a strike and negotiations completely broken down. certain the trains will not be running for tomorrow morning commute. good evening. i'm in for dan. >> i'm carolyn. we have team coverage for you on the bart striking beginning with john live at cal-trans if oakland where the talk break off late today. john? >>reporter: federal mediator gave open invitation to both sides to return to the building to begin negotiations restarted but tonight that seems very unlakely. members of seiu local spent the night packing up tent and bottle of water getting ready for what could be a long hall. nearly 30 straight hours of talk did not produce an agreement but a lot

of sniping. union members say they were basically on board with wages and pension but that bart pulled a fast one at the last minute. >> we were this close and yet at the last minute they threw in a management strike clause to take away our rights as workers. everything else was done. >>reporter: bart general manager grace says there were no surprises. >> these are work rules that were essential to maintaining the future efficiency and effectiveness of the agency. what happened is the union decided to, they wanted to take the money that was on the table but not the work rules that were than ought table. >>reporter: bart says it offered work ears 12 percent raise over 4 years with employee paying more for health pension benefits. they couldn't degree on work rules. >> what they thought was total and complete flexibility to time shift on monday i'm going>u to go to concord on tuesday i go to daly city. >> work rules mean do we have

bart ride they are evening and we are live at the blake bart station in oakland. >>reporter: larry, devastating is the way one man described tomorrow commute there is a strike. bart riders are getting ready to launch their plan b for tomorrow as others are preparing for mass congestion. >> bart, can't do anything about it. >>reporter: a strike would put bay area commuters in a jam. something casual car poolers not looking forward to. make it hard for them to go to work and to come home. the traffic is going to be very heavy. >> i'll get in early. try to leave early. >> those who travel by water. >> bike and at that time ferry every day now everyone is going to be taking my way. taking our way so it's going to be really crowded for the regular tl people on the ferry. >>reporter: people like jim don't have a choice. he take bart from fairfield every day. what are you going to do.

>> car pool. i'll be out there open the road with everybody else. >>reporter: it has been months since the july bart strike but what happened is still fresh on people's mind. >> ferry tried to keep up with the strike but it was just capacity. every single boat. it's going to take probably 2 or 3 thundershowers get to work tomorrow. it will be a real pain. >>reporter: stress of a strike has even caused some people to lose sleep. >> it's actually keeping me up at night as well because you don't get updates until late. i don't know how i'll get to work the next morning. so last night i want to say i woke up three times e-tonight as midnight tick closer commuters still witnessing hoping for good news down to the last minute. this is 7 news. >> bart has chartered 200 bus to help passengers get around. lack like this strike is going to hachlt the buses run from 9 stations seen on the map, concord, lafayette, walnut creek, west oak land, dublin, san leandro, hayward and free mont. you need purchase a

for breaking news updates. be sure to join us on the morning news and earlier start time of 4 a.m. for the latest on how the strike affects the commute before you head out the door tomorrow morning. >> 6-year-old boy suffered life threatening injuries today when a driver accidentally accelerated on to the sidewalk and pinned him against a wall. happened in downtown menlo par park. santa cruz avenue. lisa was there right after the boy and his twin brother were struck. >>reporter: one witness said the suv slammed into 2 boys passerby ran to help. they quickly realized one boy was hit but okay. while his twin brother was not. >> tried to help. get the car off him as fast as we can. luckily a guy was able to get in between the car and the boy. >>reporter: that guy was ali soft. >> he try to push the car back. >>reporter: the owner of this store squeezed his body as far as he could in between the car

and the boy. >> could see the arm just crushed and the kid was just a lot of pain. it was sad. seat look on his face. >>reporter: but the suv didn't budge. all the while the car driver, a 90-year-old man from woodside sat in the driver seat in shock. the crowd moved the man out of the car and then pushed the car off the little boy. police tested the driver. they found he wasn't upped the influence. they call what happened a horrific accident. >> training to pull out. had confused reverse and drive and the brake pedal and gas pedal reversing backward went forward instead. >> those who saved the boy call this outrage since little boy had just gone to the store to buy some candy. they found the wrappers on the ground underneath the car. >> if he shouldn't be driving. dmv has to did something. >>reporter: the driver has not been charged with a crime. this is abc 7 news in menlo

park. >> so sad. >> new details if the crash of asian a flight 214. we have learned san mateo county district attorney office has come to a decision about whether to file charges in the death of passenger who was run over by a fire truck. 16-year-old girl died after she was hit by a rig being driven by san francisco firefighters who was responding to the disaster. official nounlts is expected tomorrow. parole sex offender now under arrest for the murder of oakland federal investigators. 56-year-old randy arrested today on multiple charges including murder, vehicle theft and grand theft. he's accusing the woman on the left side of the screen hereth his former girlfriend, 50-year-old sandra coax. she disappeared in early august. her body was found week later in a park near vacaville. police believe she was with coax on the night she disappeared. >> dozens of protestors gather in front of immigration custom enforcement office in san francisco tonight. this started at 5 this evening. organizers say the protest
