now on abc 7 news, breaking news out of the east bay, a bart train hits and kills two employees. we'll tell you how it happened in a live report. and developments in the bart strike. a bart union rep says it will vote on bart's contract offer but riders should not expect an end to the strike any time soon. abc 7 news starts now. sky 7 hd is live over the scene of a deadly accident involving a bart train in the east bay.

two bart employees have been killed. hello. i'm anna dates with the early edition of abc 7 news at 500. nick smith has an update for us, nick? >> reporter: we understand that those two employees were hit near north main and jones. we have also heard from a bart employee the two killed were non-union employees suggesting they may have been management. greg just arrived to the scene. she's getting information and will confirm that information and update us. i want you to look my shoulder and see the train involved. the two bart workers may have been performing maintenance between walnut street and pleasant hill after 1:00 p.m. officials have not identified names, ages or gender but confirmed both were hit by an eastbound train. when we arrived on the location, we could see bart police securing the scene and getting

information from witnesses. we asked if the train was in operation as part of regularly scheduled maintenance or some type of training. they were not ready to confirm who was operating the train and why. >> a situation like this where we're on strike because the rails need to be kept clear of any type of rust, that's how the trains communicate is through the rails. so there are maintenance runs done with the trains. >> reporter: this is a view from sky 7 hd. it gives you an overhead view of the action. officials confirm wherever there is an accident involving a train, there are a set of procedures they go through. it's initially treated as a criminal investigation. pictures are taken and the train operator is tested for drugs and alcohol. we heard the president of at us on her way to the scene to the location. we do know that the bart spokesperson has arrived and again, the general manager is

here. she told me nick, i'm just trying to get some information. i'm not avoiding you. i will come back and give you information as we learn it. two employ yeses struck and killed on the tracks. we did see the officers on the scene covering those bodies respectfully with the tarp. we also learned just now to our newsroom, we've been told by members of local 1555 they will not strike tomorrow out of respect for the two employees who were killed on the track. the strike continues but there will not be picketing at the station. live in walnut creek, nick smith, abc 7 news. thank you. tonight bart and two largest unions are in communication, though not actively negotiating. today a union, atu 1555 said it will vote on bart's last offer. the union's president said she doesn't expect members to approve it and wants to continue talks. bart and the unions agree on the financial side of the contract. the pay pension and health insurance cost. however, the union says they do

not agree on work rules including the hours of the workday and when they receive over time. abc 7 news reporter has the latest on this. >> reporter: on word that one of bart's unions will vote on the latest contract came during a news conference today. leaders took the opportunity to read an open letter to computers about their concern to go on strike. they insist in a charge on work rules that is unacceptable. grace and her staff have said that they want a change in rules that would allow them to update certain practices, like writing reports using tools like ipads instead of writing reports by hand. during today's news conference antoinette bryant said their work rules have little to do with technology and are in place to protect workers from the whims of management. among the examples is protecting against subcontracting. >> we're going to vote until the

final offer. we're getting that printed up fur members now. we have a meeting tentatively set. we'll vote that contract, we absolutely are. we know our members are going to vote it down. >> bryant also said the main reason the contract will be voted down is because it doesn't address safety issues. bart management. >> these issues, by law, have been part of a package that we presented since april 1st. so it's been there how many times we talked about it, i don't know. >> to be clear, these comments came earlier today before the accident involving a bart train and the deaths of two people on the tracks. both sides have not made comments since and we're waiting for those comments, as nick mentioned. reporting live in the newsroom, abc 7 news. let's check traffic on this saturday without bart train service. sue hall has the latest. >> thank you. we're going to look at a map, if you will.

offer limited round trip bus service to san francisco from nine bart stations. today's service hours were from 6:00 to 9:00 a.m. with service between 3:00 to 6:00 p.m. the buses will run again tomorrow morning at 8:00. there is increased ferry service oakland to san francisco and 13 departures. there are lines in san fan today for those ferries. san francisco says yesterday its ridership numbers more than doubled. and we do want to hear from you about the bart strike and starts with the words dear bart. we got a tweet today, dear bart, why can't we all get along and get this done? you're causing so much hassing around the bay area? and dear bart, get over this strike stage. understand it's literally paralyzing the majority of the bay area. if you would like to say something to bart or its union, send us your video on instagram,

celebrated by releasing balloons at the sierra lamar search centerment she's been missing since march of 2012. although searches are continuing, authorities are presuming sierra is dead and torrez has been charged with murder and kidnapping in the case. a worker at san francisco general hospital reported seeing an unconscious woman in a stairwell one week before the body of a missing patient was found in the same spot. 57-year-old lynne spalding disappeared from her 5th floor room on september 21st. she was found in a rarely used stairwell on october 8th, 17 days after she vanished. the san francisco chronical said the orderly told a nurse he saw a woman reportedly passed out in a stairwell. the nurse contacted the sheriff's department which provides security for the hospital, however, it's unclear how the sheriff's department responded and if they sent anyone to check that stairwell. well, the warm temperatures

back to the breaking news, sky 7 hd is live over the scene of an accident involving a bart train in the east bay. two bart workers have been killed. we're told they were non-union workers. investigators are on the scene. we'll continue to monitor the situation and bring you updates on abc 7 news at 11:00 and on twitter at abc 7 news bay area. well, turning to our weekend weather, it's been a fantastic week and saturday but will it feel like fall soon? >> hi there, everyone. i tell you, this is why we call -- this is the best time of year here in the bay area

because we have little less in the way of fog and clear, clear overnight skies and a lot of mild temperatures. we are starting to pick up on a little bit of fog developing right off the coast from live doppler seven hd. you can kind of see it yourself. we'll go ahead and animate it a bit. this is more or less the high clouds but some is sneaking in here along the coast. i don't think it will cause many delays or slow downs tomorrow, and it should burn back off the coast by around lunchtime or so. beautiful shot from the east bay hill cam with lots of sunshine still out there. temperatures mild. san carlos, 77, 57 right now in san francisco. 82 and half moon bay 62 degrees and from our cam you can see the waters on the bay very, very calm. not a lot of wind out there and i mean, this poor guy we might have to push him a little bit to get him back to shore. santa rosa 84, fairfield 81 and

liver more 85. the view from mount pam, you can see the clear sky there and of course, tibberon and scott recovering today. we hope you'll feel better. the forecast highlights clear overnight, mild to warm this weekend and then we will look for some cooler days, as we head into the middle or to the latter part of next week and you can definitely see the satellite radar. most of the low clouds sitting with clear conditions inland and here is another look at it as high pressure continues to keep that storm track right here well to the north of us. so this mild pattern will continue for at least the next couple of days. now the cav yacht is the mid to the late part of the workweek, we'll keep a close eye to the pressure and could bring in more clouds and cooling as we head

into thursday and friday. we start off this evening with clear skies. by tomorrow morning this is 6:00 a.m., not a lot of fog, maybe a touch here and there, otherwise get ready for another pleasant day with low 80s inland and keep mid 60s at the coast and of course, speaking of the coast, pumpkin festival -- oh my gosh, they have square pumpkins there this year. you have to go and check it out. by 2:00 temperatures upper 60s to near 70. overnight lows will keep it coolest in the north bay, 40s there and 50s with a touch of fog near the coast and the highs for sunday, once again mild to warm with 82 in morgan hill and 77 on the peninsula mid to upper 70s. 6 for the bay tomorrow and san francisco 68 and it will be mild in the city and then in the north bay, 77 valoho and

interior east bay communities, mild to warm 81 for brent wood. the seven-day forecast as you see for yourself, not too bad. 80 inland and thursday, friday and saturday when the clouds start to thicken up a bit, fog returns ask by next sunday, we might put a few drops in our forecast. we'll just have to wait and see. >> thank you. >> sure. a student man in china conquered the great wall by tight rope walking blind folded above part of it. he's known as the prince of tight rope walking. he and an apprentice went across the wire more than 350 feet above the ground. no safety nets or harnesses. he did a little dance and his partner upside down.

good afternoon. big bounce back for stanford. the cardinal host ninth ranked ucla averaging 45 points per game coming in. homecoming week down on the farm, had a good time down there. about defense, 3-3 and kevin hogan all day to though and double coverage, cody wit field, one of the best catches you'll ever see one handed full extension, 30 yards and off hand. normally try to make that catch with your left hand. he did it with his right. the cardinal defense frustrating all day. throw picked off by jordan edwards who ran it all the way back in but a touchdown called back because the penalty. tyler takes it in and ran for 137 yards. 17-3 stanford and fourth quarter bruins down seven and rich charpds, the second interception of the game led to another td run as stanford hands ucla the first defeat of the season, the final was 24-10.

rick quan joins us live. a lot of doubts about the cardinals and they made a statement this afternoon especially on defense. >> reporter: yeah, you got it exactly right, larry. the sanford defense really was the key today. as you mentioned, they held the offense to ten points, 35 points below the average. as you mentioned, a lot of doubters after last week's loss to utah. i asked the line baker shane the statement the team is trying to make today. >> people giving us praise and doubting us, doesn't matter. 1 0 guys on the team in this family. like coach said, when we play good football, we're hard to beat. unfortunately we lost last week. it is what it is. we have to focus and come out and ready to play. >> reporter: one of the big keys was stopping brent. how did you control him? >> the quarterback with that mobility, try to be collectiontive rush. one guy gets off the rush, it has to be four guys on the rush,

breaking news from walnut creek, two workers dead after being hit by a train. sky eye hd over the scene. workers were performing normal maintenance when hit. nick smith is at the bart walnut creek station with the latest, nick?

>> reporter: information continues and you're right, it had nothing to do with the bart strike but we can confirm one employee killed was a union member. a member of 3993. look over my shoulder. you can see the train involved in the accident, the two that were hit were hit near north main and jones we again can confirm one employee was a union member. according to bart, they were hit by an out of service train, just a few minutes ago dpras the general manager grace appeared on the scene and told me she would be out to let us know what is happening. they did not reveal the names, ages and gender but said they were servicing a section of the track that needed repair. when we arrived we could see bart police securing the scene and getting information from

witnesses. we asked if the train was part of a regularly scheduled maintenance or training. they say it was not part of training but cannot confirm who was operating the train and why. >> i do know that we run them to keep the rails clear and we run them to transport personnel at locations for staff. >> reporter: this view from sky 7 hd gives you an overhead look of the action. officials confirm wherever there is an accident involving a train, there are procedures they go through. the scene is secured, pictures are taken and the train operator is tested for drugs and alcohol. both employees had extensive experience with bart as employees. the train was being run on automatic mode. so we know an engine near was not actually at the controls running and controlling the speed of the train. i have confirmed, it was in automatic mode. one of the two employees on the

track was supposed to be in the position of lookout, looking out to see if a train was coming. we don't know what happened. we're waiting to hear information on why that employee who was supposed to be on lookout maybe didn't move in time and we learned the unions out of respect will not picket tomorrow. the strike continues, but then ons will not be picketing at the different locations out of respect for the two employees that lost lives. in walnut creek, nick smith, abc 7 news. >> you can get the latest. follow us on twitter. negotiations have stalled in the bart labor dispute, however the two sides are communicating. they told bart union members will vote on the last offer made by bart management. today the atu also issued an opener let tore computers affected by the strike. the union claims bart orchestrated the commute

nightmare to destroy the unionized work force. also today, the sciu's president told bart management the union should sign off on the portion of the contract if the two sides sent the work rules to an arbitrator to help settle those. bart shut down that idea. abc 7 news traffic reporter sue hall joins us to tell us how the strike is affecting traffic right now, too. >> that's right. the blunt is at the bay bridge as you might inmag gin. you can see 80 westbound to the toll plaza japed and across the bay bridge and in the eastbound direction now is slowing, as you can see by the red sensors. down through marin, let's look at the golden gate bridge knew and show you what is happening here. looks good. you can see traffic moving in both directions, so that might be a great alternate if you're down south 101. let's look at the bridge, another alternate for you. those taillights headed in the

safely. we love you. we believe in you. we want you to surrenderer you self-to someone who you trust who will bring you back in safely. >> officials say the convicted murderers forged paperwork to free themselves. they were serving life sentences without the possibility of parole. the step-mom of a teen charged in a bullying case has been arrested. 30-year-old vivian vosburg was taken into custody accused of child abuse. they have video showing her beating a child with her fists in front of a group of kids. she is the stepmother of a girl accused of bullying 12-year-old rebecca who committed suicide in september. >> we've got witnesses that said she's had a proclivity for bullying girls back to elementary school. so there is a problem. there is a significant problem, and it started at home.

>> she admitted to investigators it was her in the video. she told them she was breaking up a fight. a little boy with a lot of courage helped get a thief and caught on surveillance camera. the mother stopped to get gas in houston and left her car and kid the until the car. a man nearby stopped the handbag in the car. take a look. the footage shows the 8-year-old fighting over his mother's purse with the suspect and then after the man snatched it away, jose jumped out of the car, right there you see him and chased after the man and managed to grab his mother's wallet. jose explained why it was so important for him to get back his mother's wallet. >> my sister's party was coming up and i wanted her to have her party and i wanted my mom to get her stuff back. >> i was proud of him but as a parent you think of all these things that could have happened or went wrong.

>> reporter: nfl running back arian foster is the first athlete to sign up with a san francisco based company that allows fans to buy and sale shares of favorite athletes. they will pay foster $10 billion up front and in exchange investors can get 20% of his future income, including money from playing contracts, endorsements and appearances. fans can buy a stake at $10 a share and have to invest a minimum of $50. robert tuck man is punting the foster stock. >> it's very difficult to monetize athletes' brands post playing days. it's very difficult to monetize athletes brands while they are planning. >> reporter: fan text is looking for significant athletes with significant growth potential. >> how you play or the performance of your play gives you a platform in which to have a voice in the marketplace which impacts your brand. >> reporter: what is in it for

the athlete? >> for players, this is a complete home run for arian foster. he's basically buying himself insurance in terms of his playing days. >> reporter: so why arian foster? he's one of the nfl's biggest stars and his brand surged with popularity of fant see poot ball and fan text wants to make him a must buy for investors. >> investors should thread carefully. they risk 84 factors including the risk of athletes getting injured and issues with the trading platform and if fan text doesn't raise enough money in the initial offering, it says it's scrapping the deal. still, the company is bullish about bringing sports investing to the average joe. >> we really embrace this concept of him being a trailblazer and it fits his brand and how we see him and we think that there is a desire for that out in the marketplace. coming up next on abc 7 news at 4:00.

when it comes to tvs you probably heard of lcd and plasma but new technologies threats to make them obsolete. should you switch? we will see if these new tvs are worth the price. michael finny has a look. >> reporter: when you shop for television, the choices can seem overwhelming. consumer reports say it will only get more confusing. they tested the latest tv technologies, oled and ultra hd say while these sets while prison si have a lot to offer. ultra hd means you can get huge screens like this 84-inch one. consumer reports testers checked out and you also get a beautiful picture with lots of detail. but ultra hd sets start at $4,000 for a decent one. and there is another draw back. >> the problem with ultra hd is

that it needs a whole echo system of high-definition content, sometimes called 4 k and that really doesn't exist now so you have a tv with a lot of high resolution and not a lot of content. >> reporter: oled, the block levels on this set are the best testers have ever seen. the brightness levels are also great. the prices are still high, ole derks sets start at about $9,000. >> we feel that over the course of four or five years, it will become a mainstream product. >> reporter: meanwhile consumer reports says plasma tvs continue to improve. for example, consumer reports says this 55-inch panasonic plasma, excellent picture quality for about $1500. if your tv is in a room that gets a lot of light, an lcd television might be the best choice. consumer reports recommends the

see a little fog start to move from north to south. overnight lows tonight, the coolest once again in our protected valley area, santa rosa 44 and 50 san francisco and liver more dip to 48. so here is pretty much the story, the past few days, higher pressure has been centered to the northwest of the bay area keeping the storm track where you can really see it right here well to the north of us. it will continue to hold it's position for at least the next couple of days, so we'll continue with a mild weather pattern for at least through about tuesday, wednesday, by thursday we're going to keep a close eye an that area. it could possibly bring us a few clouds and will definitely cool us down the latter part of the workweek. if you're heading to the pumpkin festival tomorrow, great and chilly in the morning and maybe a little fog there in the 50s and then as you head into the afternoon hours, upper 60s to right near 70 degrees.
