good morning. thanks for joining us, i'm matt keller in for eric thomas. >> and i'm kristen sze. we begin with the deadly accident on b.a.r.t. tracks. two employees killed on the tracks on the second day of a strike. we're live in oakland with the latest. knick? >> reporter: good morning. we're here because workers continue to hold the line at the lake merritt station. they're quiet, somber, but they've not given up their fight on this, two days after two b.a.r.t. employees were hit and killed. investigators with national transportation and safety board took over the accident scene on sunday and spent most of the day

inspecting the train and conferring with the state and local counterparts. this week, the inspection -- the officer in charge and his team will interviewer everyone on board, and the operator of the train will be tested for drugs and alcohol, standard operating procedure. safety records will be used and digital data will help determine who was in the cabin of the train and the speed at the time of impact. >> when you have a high-speed train going down where people are on the tracks, on automatic pilot, when the protocol says you should be going 25 miles per hour on manual, something's wrong out there. >> reporter: the victims were identified as contract worker larry daniel and christopher sheppard. christopher was a member of afscme. both men were both said to have a great deal of experience. here at the lake merritt b.a.r.t. stations, where union workers have held the picket

line, candles have been placed in memory of the lost lives. we'll continue to follow the situation and let you know the latest in the investigation. live, knick smith, abc 7 news. the labor strike is entering its fourth day. the b.a.r.t. board of directors will hold a closed-door meeting to discuss the strike and negotiations. as of right now, no negotiations are scheduled. b.a.r.t.'s two biggest unions delivered a counterproposal yesterday. they say it includes changes to workplace rules. officials say they're still waiting to receive the offer. you may see even more traffic today than on friday. this will be the first monday of the strike. the highway patrol hopes to have as many officers on the roads to clear accidents as soon as possible. let's see how thinkings are going with the commute with leyla gulen. >> b.a.r.t. will be putting

things into a contingency program, but only 6,000 riders compared to 400,000 we typically see on any given day. other transit agencies will pick up the slack and offer extended service. so i'll have more on that for you in just a little bit. if you are taking to the roads, we do have some construction around the bay area. north and southbound 880, we will have lanes blocked off in both directions, and connectors as well. so that will be a little bit of a slow commute for you. that will last until 5:00 this morning. a look at the drive-time traffic, everything is moving along at top speeds, and outside we go, a look at the bay bridge toll plaza, where we had an earlier fog advisory. that's been lifted. you can see the traffic is clear and moving smoothly out of emery. let's say hello to my brother in pin stripes, mike nicco. >> this is what she's talking about. let's focus our attention on

visibility. five in napa. a little bit of fog. everybody is cloudy except for the east bay valleys right now. the onshore breeze is here, and it will keep the cooling trend we saw over the weekend in our forecast. you're stepping out right now, most of us in the upper 40s, low 50s. we have a cool spot in nevada with about 45 degrees. this is the look from emeryville, and we're looking at barely the bridge. you can see the top of it cut off by the clouds. 73 to 84 for the north bay valleys. afternoon sunshine, 68 to 75 around the bay. and clouds stubborn in san francisco, low to mid-60s. the charter buses are back in nine east bay b.a.r.t. stations. amy hollyfield is live and are people lining up early again this morning? >> reporter: people just started showing up, matt. look behind me. we have about a dozen people here in line. they are very early. the bus does not get here until

5:00 this morning. and there are fewer people than this people on friday. people maybe decided there's no reason to get here this early. everyone in line did get a seat. here's what it looked like on friday. b.a.r.t. shuttling the people from the east bay to san francisco. on friday, they handled 4,400 people. that's how many people climbed aboard these buses, and b.a.r.t. spent $175,000 on friday on these buses. the people on the first bus, though, definitely get to the city quicker. i kept in touch with people as they headed to the city, and those on the 5:00 bus got there in 40 minutes, compared to those who went at 6:00, it took them an hour and a half to get to the city. so the earlier, the better. these buses will be running from 5:00 in the morning until 8:00. reporting live in walnut creek, amy hollyfield, abc 7 news. >> amy, thank you. the san francisco bay ferry expects to see more ferries than

for a cargo load, while costs have increased sharply. they fear the effect of new emission standards will literally drive them off the road. the drivers believe the port should pay them a monthly stipend to meet the greener standards. the port of oakland has not replied to our request for comment. oakland police are searching for a gunman who opened fire on two men. it happened near bancroft avenue after the 8:00 last night. both victims are expected to survive. it came just hours after a man and woman were shot in a car. their vehicle plowed into a parked car on international boulevard at 73rd avenue. the woman was wounded in the neck and is in critical condition. police think it helped at well street a few blocks from the crash scene. a convicted felon charged in the murder of an oakland woman is expected to be assigned a public defender today. he is charged in the murder of sandra koch, a federal

investigator last seen august 4th. her body was found in vacaville five days later. he says he is innocent, but he was at the motel. a small earthquake felt in contra costa county. the quake struck two miles south of black hawk, four miles east-northeast of san ramon. no reports of damage or injuries. if you feel some shaking, it could be the stopping from people running to shuttle buses with the b.a.r.t. still on strike. >> exactly. or your nerves, because you're hoping to get to work on time. we totally understand. right now, the roads are clear. since you will be carpooling or driving yourself, you can see we've got lots of green on this map. it looks like a decent ride if you get out now. i will say the traffic is expected to be much heavier today. we also do have a few limited

construction projects. westbound along 80, 580 out of hercules and the hoffman split, we will find construction crews. that will last until 5:00 this morning. over towards sfo, the westbound side of 380, the south airport bypass, the connector there, it will be closed until 7:00 this morning. so far, it looks like 101, traveling both north and southbound, at 380, everything is running at top speeds. going to the san mateo bridge now, the traffic is quite light if you are heading in both the east and westbound direction. westbound, the taillights pushing toward the high-rise. an earlier accident has cleared. mike? >> all right, thank you, leyla. strong waves are following strong rip currents, sneaker waves, watch out for the outcrop pi s and jetties. the day planner, the next seven -- or 12 hours, it is cloudy except everywhere in the

east-rise valleys. a homogenized air mass thanks to the cloud cover. only 62 around the bay. inland, especially the east bay, where we get the sunshine first, 72 degrees. by 4:00, we're pushing 80 inland, 72 around the bay, but only 64 at the coast with holes developing in the cloud cover and the clouds come back during the evening hours. 54 at the coast. grab a coat there. maybe not as heavy a coat around the bay, 72 inland. moving forward, the sea breeze will get stronger and temperatures will drop. so today and tomorrow, the warmest days in the forecast. wednesday and thursday, you could see we drop about one to two degrees both days. matt, kristin? >> all right, thank you, mike. an east bay store is hit by robbers again. next, why the owner hopes this surveillance video will help make criminals think twice. and the capture -- recapture of two escaped convicts.

good morning. it's 4:13. we're keeping an eye on the continuing impact of the b.a.r.t. strike, what that's doing to traffic this morning. >> yeah, let's check in with engineer dick hampton, and, dick, how is it going out there? >> good morning, matt and kristen. it's going very nicely. i checked out your ride into san francisco, 288 northbound and southbound, and 101, as well, northbound and southbound, as leyla just mentioned. the traffic is moving at the

limits. there are virtually no traffic. it's looking like a normal monday morning commute at this early hour coming in from the peninsula. i'm eastbound on the bay bridge, the lower deck, approaching the island. as you can see, the traffic is light here, as well this morning. but as mike nicco mentioned, no pun on words, but there is frost on the pumpkin this morning. matt, kristen? >> all right, thank you, dick. we appreciate it. on the peninsula, a search is under way for a shooter that left a palo alto man in critical condition. police say the shot-spotter technology led them to east palo alto around 2:00 yesterday afternoon. the victim was found a mile and a half away at university and crescent in palo alto. police believe they were driving when someone fired at their car. police hope surveillance video will help them nab someone who robbed a convenience store.

it happened on willow pass road. it's the second time in two weeks the shop has been hit. you can see one man raiding the cash register, and another just taking t-shirts off the rack there. the owner is hoping somebody can identify the suspects and turn them into police. the two convicted murderers are back in prison this morning after mistakenly being released and recaptured. investigators say the two men escaped with the help of fake documents, and more arrests are likely to come in connection with their getaway. tamon bradley has the details. >> reporter: this cell phone video shows police surrounding room 227 in panama city where the two escaped murderers were hold up. charles walker and joseph jenkins travelled to the motel 100 miles from the prison where they were serving life behind bars, hoping for a ride out of town. >> made announcements over p.a. system, and after a minute or two, they came out. >> reporter: the two convicts this morning are back behind

bars and authorities continue investigating the elaborate scheme which led to their release. a law enforcement official told abc news the two men may have paid someone thousands of dollars to create the forged release papers they used. florida officials indicate there will be more arrests. >> we'll be backtracking to those who helped carry out this fraud, and in the long way, we'll be looking closely at anyone who may have helped harbor these fugitives. >> reporter: the escape has proved a big embarrassment for the florida authorities. they somehow produced authentic-looking documents on proper letterhead, and even included the judge's signature. >> they cut and paste my signature and affixed it to the order. >> reporter: it was good enough to release the two men. >> it is embarrassing. everyone else here is making sure that we come up with a process and a procedure that prohibits this from happening in the future. >> reporter: the incident has already led to changes. the florida department of corrections will now contact a judge to verify an inmate's

direction, the dublin interchange, you can see how wide open it stays, and 84 is running smoothly. 680, as well, south of 580. let's look at north of 580 along 680, walnut creek, it looks good. but i urge you to get the head start. mike? >> all right. the clouds have a head start this morning. live doppler, we don't have any moisture other than possibly some mist as you drive up into them, which wouldn't be very hard. look how low they're lying this morning. you can't see the top of the western span of the bay bridge from the exploreatorium. sunshine through the afternoon hours, and a slow cooling trend this week. an area of low pressure will sit off the coast and enhance the sea breeze, but it will keep most of the wet weather over the ocean. may get drizzle at the coast, that's when it. a look at the cloud cover. it's increasing right now. thick fog moving into the north

bay. clouds all the way down to the bay shore, into the south bay. notice the east bay valleys see the limited amount of cloud cover this morning. by noon, everybody is cleared out, and that's when we'll see holes develop in the cloud cover along the coast.microclimates this morning. upper 60s, low 70s for the bay shore. upper 70s to low 80s in the east bay. the exception livermore, the warm spot today, at about 83 degrees. tonight, temperatures back in the 40s to low 50s with the clouds thickest along the coast and some of those spilling into the north bay valley, so look out for fog there. the accuweather seven-day forecast. today and tomorrow, probably the warmest days, and then the slow cooling trend as we head through at least friday. we'll try to rebound the temperatures saturday and sunday. but another seven days without rain. matt, kristen? >> thanks, mike. president obama is speaking to the nation this morning,

addressing the computer chaos that's plagued the rollout of the affordable health care act. the president is expected to fix online issues people have faced in trying to sign up under the new health insurance law. the health and human services department says it's working with the best minds inside and outside government to fix glitches. republicans are calling on health and human services secretary kathleen sebelius, you see here, to resign. nsa leaker edward snowden said u.s. officials hacked the e-mail of the former president of mexico. according to the german magazine, documents from snowden said the u.s. accessed the e-mail system of former mexican system of philippe calderon. they're condemning the e-mail spying calling it unacceptable, illegitimate, and contrary to mexican and international law. it's 4:20. coming up, a warning to moms who buy breast milk online and the unexpected danger you may be putting your newborn in. the newborn pandas are cute

[tires screeching] of course, we continue to keep an eye on the freeways as the b.a.r.t. strike enters day four. dick is joining us by way of cell 7 live. dick, how is it looking right now? >> kristen, it's looking real nice here on the bay bridge so far at this early hour. i'm westbound just rolling up to the toll plaza, as you can see. here's maybe two or three, four-car backup in the cash lanes, but the fast-track lanes are moving through at the speed limit. you know, as leyla mentioned earlier, it's still very early. and if the traffic pattern holds true to form, what we saw friday morning, you know, you get
