eastbound traffic on the righthand portion of the screen, still slow and into san pablo. very busy out there it's bumper to bumper traffic. dan? >> the strike took a tragic turn over the weekend haf a train killed two workers doing maintenance, one was a 58-year-old chris shepherd a member of the one of the unions not on strike. we are live where she just spoke with investigators looking into this tragic accident. laura? >> that is right. at the pleasant hill bart station they did offer new information about what they

found so far. bart said the train was doing maintenance that, may be true but ntsb confirmed the man operating the train was being trained at the time of the accident. the 58-year-old was killed. he's a union member who crossed the picket line to go to work that day. a 66-year-old larry daniels was also killed. the team said they have interviewed four employees so far, including operator, they have collected a fair amount evidence at the scene. and >> this was a nonrevenue trip for training as well as maintenance personnel to do checks and tracks and equipment itself. so he was in training.

>> now, part of what the national transportation safety board will do next is look at work rules protocols supposed to be followed. and whether those procedures were followed in full in this case. ntsb says a train was being run by a computer, and traveling between 60 and 70 miles per hour, the time of the accident. the ntsb said the operator did push an emergency stop button. how quickly the train could stop has yet to be determined. >> a different labor dispute closed today. truckers claim they're mistreated and subjected to unsafe working conditions, one top complaint, drivers want

tonight a sparks nevada middle school high schoolteacher was shot to death by a 7th grader while trying to protect other students. police in the reno area say the 45-year-old engaged the armed student. the shooter wounded two students and shot the teacher before turning the gun on himself he shoots my friend. and then, he wanted to a teacher and said back up. teacher started to back up, he pulled a trigger. >> lancebury leaves behind a bif and two step daughters. the shooter has been identified as a 7th grader but

name and age have not been released. reports say the boy had been bullied. >> there is more heartache tonight for the family of a woman who went missing at san francisco general hospital only to be found in a scarewell at the same hospital. vic lee tonight with the latest information. >> lynn spaulding's body found october 8th in a stairwell. at the time spaulding being treated for an infection, now, a source tells us that one week before spaulding's body was discovered a hospital worker saw a woman appeared to be unconscious, lying at the same stairwell. that he stepped over her twice. spaulding's family is outraged about the revelation. >> i think tells us what didn't happen what. should have happened is care for
