fork lift fell off the truck and on top of him at 6:30 in the morning on october 14. since then, the start time has been moved back half an hour so 7:00 a.m. so this is more light. >> we are making changes with the lighting and stuff. that is a factor. >> each morning we do a team briefing: what are you doing in how will you be safe? safety is cue. you have to be thinking of your fingers and toes and that you want to go home. >> osha is shining new light on what happened when don white was killed by a counterweight of an elevator on june 11. he was communicating with the operator and wasn't wear the elevator was working. it is a mystery why he didn't move, knowing the elevator was coming down toward him. osha originally gave his employer, the subcontractor, a notice that no violation occurred. a spokesman told me that it was in the final review stage before a staff person raised questions

and rescinded the notice. there is in word on what the questions were. osha can fine a company from $5,000 up to $70,000 per violation. as for the workers' killed at the site, nothing can bring back what was taken away in an instant. >> it is tragic for them, for the families, for the job. it is a reminder to take life for what it is and enjoy the moments. that quick, it can happen. you know? >> osha said they have six months from the date of the accident to finish their investigation. that means the report on don white must be completed by december 11. >> matt, thank you. happening now in the south bay, san jose police have issued a silver alert for a missing 82-year-old man. he was seen yesterday near his hour in san jose wearing a

the weather service will issue later today the north bay interior valleys in the san francisco bay shore are under a dense den tonight until the morning commute and it will be difficult commute. look at the low-to-mid 50's at the coast, the south bay, north bay, napa still only 48, and the sunshine is dominant in fairfield and antioch. the bay bridge is lost in fog. you cannot see treasure island. hazy sunshine. temperatures are close to average moving forward in the stepped period, though, another seven days without rain. it looks like december in walnut creek right now with low sun, hazy hanging around in the morning. the east bay valley saw more fog this morning than yesterday. temperatures are close to average in the south bay, mid-to-upper 70's this afternoon clouds. low-to-mid 70's and sun for the rest of the peninsula, and a brisk day at the coast.

cold and damp and mid-50's. mid-60's downtown and south san francisco and sausalito at 68. mid-to-upper 70's in the north bay valleys. bodega bay is only 53 due to the burn. we will have mid-60's to low 70's for the east bay shore line and the warmest weather inland is up to the 80's for the east bay valley. tonight, the thickest fog is in the same areas and east bay valleys, especially. which low pressure will dominate the weather? it is the weather that is cut off from the main low overturning the atmosphere on friday. it will bring in mid-to-upper clouds and that will hold our temperatures in the low-to-mid 80 range, say, low 80's we have a cooler air mass monday and tuesday but the transition, again, will be dry.
