they looked at how long it might have taken to stop the train and how difficult it was to see these two men as=)ñ they stood on tracks. by setting up two mannequines, national transportation safety board investigators performed a reenactment of the accident that killed the two men. for some neighbor who's came to watch it was an eerie sight. >> makes it very real. >> in the reenactment, each has his back to a track just as investigators believe they did when they were struck. >> the responsibility of safety is on themselves the inspectors and consultant required to remain together for the duration of the activities and one of the pair is to be designated as the lookout. >> national transportation safety board said they had gone out on the tracks saturday, after getting what the bart safety manuel called simple approval. that means one man works,

lafayette and pleasant hill stations. connection buses were used to get riders between those stations as well as walnut creek. this added about 20 minutes of travel time. >> an alameda county judge banned workers from going on strike. at least until christmas time. in a hearing that lasted just two minutes. the superior court judge said a strike could be disruptive and grant td a 60 day cooling off period in negotiations. bart workers went on strike after a cooling off union negotiators hopeful in this case an agreement can be reached. with ac transit management. >> they need to remain flexible to achieve that contrast here. >> drivers and mechanics have rejected two tentative agreements and giving them one

a raise. the 60 day cooling off expires before christmas, december 23. >> the city gardener accused of running over a woman in a san francisco park charged with felony vehicular man slaughter and felony hit and run. she was sun bathing on a grassy knoll when run over by a city truck. for the first time we're hearing the gardener's version of what happened. >> through his attorney the city gardener said there was a good reason to drive on the area on the lawn and not stay on the intended path. about 25 friends and family members entered the courtroom to show their support for the driver. the 58-year-old city gardener pleaded not guilty to running over, killing a woman in san francisco vernal heights neighborhood. >> he's a man of integrity. and we just, i feel in my

heart it was an accident and i spoke to him sunday at church and told him we're going to be here. >> inside, his lawyers said he was driving on the asphalt when it unleashed dog darted in front of him. he tried to avoid hitting the dog, by swerving to the right and driving down the grassy hill. >> the dog scampered out and thought it was okay. then startedw2:ímr to ÷:;k hem hit something else because he k the right. >> the attorney says at the time his client didn't know he had run over the 35-year-old. she later died. >> the right thing to do would have been to come to a stop not go over the lawn and not to continue to drive over the lawn after you feel you bumped run over something stop, see what is going on. >> his attorney did not say why his client did not stop.

unloading fell on top of him. >> a gut wrenching investigation is underway in sonoma county a sheriff deputy shot and killed a 13-year-old boy that he thought was carrying an assault rifle. it turned out to be a boy. it happened in santa rosa and moreland and west robls avenues. abc 7 news talked today with a witness to this shooting and he is live in santa rosa with the story. wayne? >> we heard deputies in the santa rosa police department explain what deputies told them. there are other orgsz. there is an eye witness says the young boy didn't have much of a chance. the memorial in a suburban field. controversy about how he died after being shot three times in broad daylight by a sonoma county sheriff's deputy is growing too. >> this boy was not a
