bart station with the latest. >> we got here we were surprised to see the train is still on the track. firefighters are surprised they are still here, too. this turned out to be more complex than they thought. they have in estimation when they can move the train. here is video of how this started. there was smoke coming from under the tracks at 6:15. they were able to evacuate the people off the train. no one was hurt. when they got the fire out, firefighters realized a huge 1,200 pound sell any conductor box fell off the train on the tracks. the only way to move it is to break it apart into pieces and they are still working on that. >> what looked like it would be a two hour thing and we with put out the fire and they would move the train and everyone would go

home has turned into an all-night cooperation between bart and our fire district getting this machinery off the track. the only way was to cut it apart with torches. >> they think they have another hour of working on breaking the box apart. then they can move the train. then they have to bring in a train to move that box off the track. there is still a lot of work remaining from what they thought was a simple fire. no word open when it will be cleared. they will be single tracking through orinda so expect delays. we see commuters arriving and gathering on the platform. people are going to try to get through but it will be slower than usual.

>> sue will follow-up on that. new details in the accident that killed two bart workers. bart has suspended a controversial policy giving track workers responsibility for their own safety. the change comes days after two workers were killed by a bart train while inspecting tracks in walnut creek. investigators will analyze the data from the reenactment. two life-sized mannequins were placed on the track to sometime late where christopher shepard and larry daniels were working when they were hit. trains now have to slow to under 27 miles per hour when someone is working on the tracks. we will have more on the story from katie marzullo at the top of the hour. >> developing news in concord: there is an investigation over a storage yard fire. the flames damaged several cars and trucks. would -- propane tanks were a

concern. the fire was knocked down on 20 minutes. no word on a cause. >> people in santa rosa are supporting a family would 13-year-old boy was fatally shot by police on tuesday afternoon. neighbors chanted demanding justice in the field where the 13-year-old andy lopez died. three was carrying a bb gun designed to look like an assault rifle when the police saw him. officers repeatedly told the boy to put the gun down but a witness would warned the boy about carrying it around watched the tragedy unfold in his rear view mirror. >> opened the door and shot, three shots. >> did they warn the kid to put the gun down? >> i didn't hear anything like that. i was a few feet away. >> he moved the gun toward the direction of the deputy and the deputy was fearful he would be shot. >> the sheriff has released no information of the deputies but

to say they are on extended leave. it is the third fatal shooting by santa rosa police. >> there will be protesters on the second anniversary of the eviction of occupy protesters and where thousands gather for a three-day training exercise. they will train officers to respond to terror attacks and disasters. the military-style training leads to violence. demonstrators will gather outside the oakland marriott city center hotel as vendors market equipment and occupy rally is scheduled for tomorrow night on the plaza. >> the contra costa county fire department is canceling plans to close another fire station because of rebounding real estate values. they report that the county fowl -- officials say tax revenue has given more money than expected.

they could be able to re-open two of the seven stations closed in 2011. however, budget protections show that fire district is still spending up to $10 million more a year than expected to collect. >> golden gate bridge drivers could have to cough up another dollar to cross the span starting next spring. the district is facing a $142 million deficit over the next five years. officials will meet tomorrow to discuss whether a one dollar toll hike is needed to close the deficit. it costs $5 to cross and $6 if you do not is a fast track. the board will discuss options next month at the public hearing in february and a vote later that month. >> registered thursdays and elected leaders will gather today to denounce plans by kaiser permanente to close the pediatric hospital unit in hayward next month. they say there are not young

patients hospitalized at the facility and those that are hospitalized there will be moved to oakland. the medical offices that serve most child patients will remain open. the nurses union opposed the move saying it will be a hardship on parent whose have to travel further. kaiser permanente has not decided to do with 21 measures who work at the hospital. >> in washington, dc, the white house plans to push back the deadline for mandatory health insurance by about six weeks. the move comes as experts scramble to fix technical bugs with the health care website. the deadline to sign up and avoid a penalty is february 15. >> president obama says he wants congress now to focus on overhauling the nation's immigration system. he will speak in 9 east room of the white house to call on lawmakers to take action soon. house speaker boehner raised the possibility of a house of representatives vote but most republican house members question offering citizenship to people with broke united states

from january 1 so with that in mind this is the driest january through october we have ever had with records back to 1850 in san francisco. we have not had 4" of rain. we should have a lot more than that. the previous record for dry weather was 5.75" so we are shattering that record and hoping the pattern changes. look at lake effect snow off lake michigan, lake huron, lake ontario. it is colder in the east. back home we have cloud cover with no rain and no fog. we will talk about temperatures stepping out dress for the upper 40's in the north bay valley through concord and fairfield and everyone else in the low-to-mid fists including san ramon at 51 and livermore at 53 and san jose and oakland and 51 in san francisco. you can see the cloud cover is
