people last night. police say a couple in their 50's were walking their dog near constitution avenue before 6:55 when a 54-year-old woman hit them from behind with the car. the man and woman died at the scene. the car chest going. here is what happened next. the driver then went over the center divide of the road and struck another car and cashed into a tree here on constitution. >> police determined she was drinking and arrested the woman for two counts of manslaughter while intoxicated and two counts of felony driving under the influence. she is at the medical center and will be booked into yale when she is released. the dog was taken by the humane society for treatment. no word open how the dog is doing.

the street is open in both directions. the victims have yet to be identifyied. >> highway patrol is investigating a frightening accident on 280 in san francisco. look at this video: a truck crashed after 5 p.m. on the approach from 280 to southbound 101 and the cab of the truck was dangle dangling from the overpass and the patrol had to close all lanes of northbound 101. it took three hours to move the truck. >> students angered over the shooting of a classmate by sheriff deputies will walk out of school and march to city hall this morning. adults are protesting although the boy was carrying a toy that looked like an ac47. >> hundreds showed up for the vigil. >> people are mad.

it is not detroit. >> the sheriff deputies shot and killed a 13-year-old andy lopez. he was shot seven times. two wounds were fatal. a 24-year-old veteran was training another deputy when they saw lopez with a rifle that looked like an ak-47. >> the rifles marked with an orange tip but andy's on >> other kids did future have tips. >> i told him, make sure you have something yellow, red or orange on your gun. i said, they look too real. >> one community leader is addressing what she calls a disagreement between latino and law enforcement.

demonstrators will gather at 9:00 a.m. to protest on this second anniversary of the eviction from the plaza. occupiers are planning a rally around 5:00 and they will march to city hall. oakland police have extra officers ready just if case they are needed. >> a supervisor at the 49ers new stadium will avenue to grand theft charges suspected of stealing material including copper wiring from his employer cupertino electric. he is facing five counts of grand theft and two counts of burglary. the material did not come from the stadium project. he is in jail on $400,000 bail. >> we are learning the financial toll the bart strike took on the restaurant industry in san francisco. it was a $3 million hit during the four day strike. the firm says the average

restaurant lost about $5,000. on monday alones restaurants saw an average of 16 percent drop in business. >> the opening ceremony for the maverick surf competition is this afternoon near half moon bay. the window if the big wave contest opens in a week on november 1st. last year, sky 7 was overhead when surfers from all over the world paddled to form a prayer circle. surfers are given 48 hours notice to ride the big waves when the conditions are right that could happen from next week until the end of march. >> this afternoon at half moon bay, you can check with mike on the fog. >> there will be more sunshine than fog. the clouds are not as thick as this time yesterday. most of the fog is in the north by. we have high clouds. that is indicative of the low pressure off the coast that will stream the high clouds to us.

the next 12 hours we are in the mid-40's to low 50's. that is not so hazy at noon. temperatures are warmer in the mid-to-upper 50's on the coast and the bay area and 64 inland. it will jump ten degrees by 4:00 and 74 inland and 66 at the bay and the coast. grab a coat but the evening it will not be wet or breezy, just tree pollen. 52 at the coast and 58 around the bay and 64 inland. on monday, the transition to cooler fall weather returns. saturday and sunday, warmer than today with high sunshine, near 80 inland and low-to-mid 70's around the bay. we drop two to 12 degrees on monday. usually that is good sign that a cold front is coming with moisture but it now looks dry. have a great weekend.

covering news from north carolina a stand off that lasted most of the night came to a peaceful end in north carolina. a gunman surrendered to police after holding three people hostage inside a c.v.s. pharmacy about 15 miles west of charlotte. the hostages were not hurt. we will monitor the story with updates. >> more fall out from a salmonella outbreak linked to three central valley powellty plants. the hat lat says mexico banning products coming from two plants in fresno and one in livingston^. investigators found the plants were the source for salmonella

outbreak that sickened 300 people since march. there was never a recall issued and the plants were allowed to remain open. foster is making changing to the processing procedures. experts say poultry is safe if cooked to 165 degrees. >> the city of san jose is cracking down on student car washes on the weekends. the issue came to a head of a cheerleaders planned a car wash to raise money for a national competition. the city of san jose says that the car washes violate water discharge laws and have to stop. a spokesman says anything that goes down a drain that is not storm water or rain is a pollutant. the city says students who want to hold the car cash can do it on gravel or grass and make sure the dirty water does not run into the street or the drain. the same rules that businesses and drivers already follow. >> safeway changed rules for a program that donates purchases

to the children's schools. parents at scotts valley are registered for safe way's program that takes part of what they spend and donates it to the p.ta. but safeway will only donate from transactions involving cash, check or debit card not a credit card. >> i am sure we will have less funding from this. knowing we have the p.t.a. to back us with up the funds is a load off. >> with help like student clubs are expected to be reduces safeway said it is difficult to make a donation from a sale when we incur a high credit card transaction fee. they hope to deduction the blow by eliminating the program donation cap. >> in the south bay they are trying to get families to give up sodas and replace them with healthy foods. starting this morning the second annual soda exchange is underway in cupertino. bring in unopened soda for cash
