walked or recovering from injuries. matt keller is on the scene. >> a worker cut down the trees that were damaged by the alleged drunk driver's car last night. today, the family of the two victims are just trying to cope with the sudden loss that left three teenagers without their parents. family members gathered near the scene this morning where their loved ones died 12 hours earlier after being hit by a car while walking their dog. the two victims of menlo park residents married more than 20 years and have three kids. the oldest is just 18. >> i am here for you. i said, i will build your father. a a 54-year-old hit the two with a car and hopped over the median and hit another car before crashing into trees. she was taken to the medical center with minor injuries and arrested for two counts of

manslaughter and two counts of felony driving under the influence. >> if you do things at a legal age, fine, but you have to look at the consequences of what she does and how it affects other people. >> the couple's dog was also injured and taken to an emergency veteran clinic. they are optimistic he will survive. there is a hope for the family members left behind that this tragic crash never happened and their loved ones will be back. >> i hope they are not dead. somehow that god sends them back somehow. two funerals, i have never seen this. >> the victim's brother said a grandmother currently lives with the three teenagers and more families members are expected to stay with them as they grieve the loss of their parents. >> thank you, matt. developing news. a rally is growing by santa rosa

students to protest the shooting death of a teen. he was carrying a toy gun that looked like an assault rifle. andy lopez was killed on tuesday. katie marzullo joins us. the emotions are so high for the sad situation, katie. >> they are. hundreds of petroleum -- petroleum are gathered on the corner, young people. if you look at the faces they are kids, the same age as 13-year-old andy lopez asking for justice and some wearing pictures of him on their t-shirts. this rally initiated at the local schools. there was to be a walkout at 10:00. we did not see a mass walkout from the middle school at 10:00 we talked with a dad who pulled up this to pick up his son and bring him to this rally. >> the thought of it gets me choked up.

my son has an assault driver fell and they just shoot cans meaning no harm and they are not hurting nobody or stealing or harming no people. i am here to pick up my child so we can protest. >> there are some parents, adults, who are watching from the perimeter teaching an eye on the kids. this group is expected to get bigger this morning. they are waiting for more people to arrive. the plan is, at noon, they will many from city hall to the sheriff's department and we understand there is a second march on tuesday on tap. >> friends and family of the teen have set up a facebook page "justice for andy lopez," calling for another march on tuesday. there are messages to his family and loved ones.

>> happening today a judge will decide are a convicted serial rapist will live once released from a state hospital. he is known as the pillow case rapist and odd mitted to raping 40 women in southern california and the bay area between 1971 and 1992. he is now 52. application say three -- he used a pillow case to quiet his victims. he'll be required to use an ankle brace it. occupy rally is taking place to train law enforcement to better handle terrorist situations. laura? >> i am at 11th and broadway in downtown oakland. behind me, we have demonstrator whose have placed themselves in front of the convention center at the marriott. there is a two day conference

and was of oakland police clashes with occupy demonstrators. of course, that made national headlines and the occupy folks are saying this two-year anniversary is something that must be remembered and that they will use this conference as a platform to protest what they called police brutality. we will hear from them later on abc7 news at 4:00. in the meantime, there are a couple of other activities planned. though will protest here until 5:00. then they will march and there will be a rally at city hall on the plaza at 6:30 and a large police presence is here. as you heard, they are taking zero tolerance stand to vandal ism. in oakland for abc7 news. >> the national transportation safety board has announced they will hold a hearing in december

on the asiana flight 214. more than 180 people were hurt when asiana flight 214 crashed short of the runway in july. three people were killed, including one who was accidentally run over by a san francisco emergency response vehicle. the ntsb hearing is held in washington, dc, december 10 and 11. it will focus on pilot awareness in highly automated planes, emergency response and cabin safety. >> the obama administration says they are finally getting someone from outside the government to take the lead on clearing up problems with the health care website. officials say a subcontractor will have the responsibility for fixing www.healthcare.gov. flips have prevented if emfrom signing up under the act and in some cases the wrong information was sent to health insurance companies. the government promised the site will be working smoothly by the end of november. >> the toll that the bart strike

>> breaking news, emergency crews are at the scene of an accident involving a city passenger bus and a car. investigators say both vehicles crashed head on, on montgomery drive this morning. the fire chief says that ten people are hurt. there is one major injury. there are two minor injuries. no word on how many people were in the bus or how many were in the car. >> update on the breaking news from the top of the newscast, the fukushima area of japan rocked in the past hour by 7.3 earthquake. that is the same area where in 2011 there was an earthquake and tsunami that badly damaged the nuclear power plant leading to the release of radioactive materials that still present a problem to this day. the advisory is issued for the area but not for the rest the pacific. it was held 300 miles away in

tokyo. >> bulgarian authorities say they have solved the mystery surrounding the birth mother of a girl in greece called maria. a 35-year-old roma mother is her mother and gave birth to her four years ago in greece and gave the child away because she was too poor to care for her. maria was taken into care after found living with a family. the couple faces child abduction charges but say they did nothing wrong. >> court documents are again putting the spotlight on jonbenet ramsey's par ends. she was found dead in her home in 2006 in december. documents show 1999 a grand jury voted to indict the ramseys on charges of child abuse resulting in the first-degree murder of their daughter but the district attorney declined to press charges saying they did not have

the average restaurant in the financial district lost about $5,000. on monday alone, restaurants saw an average 16 percent drop in business. >> new this morning, the city of san jose is cracking down on student car washes which is common in a lot of lots on the weekend after cheerleaders plan add car wash to raise money for a national competition. the city of san jose says the car washes violate water discharge laws and have to stop. a city spokesman said that anything that goes down a drain that is not storm water or rain is polluting. students would want to hold a car cash can do it on gravel or grass. those are the same rules that apply to businesses and drivers. >> the paddle out for the maverick surf competition takes place this afternoon at half moon bay. the window for the big wave contest opens a week from day, november 1. last year, we were overhead when

surfers paddled out to form a prayer circle. they are given 48-hour notice to ride the big waves when the conditions are perfect which could happen from next week until the end march. the ceremony starts at 2:00 this afternoon. >> next weekend is also the end of daylight savings time so it is almost winter. >> it looks like it outside with the shadows longer, the air is hazy like we normally expect. i will show you what is going on. the fog from this morning has lifted the moisture and that is making it hazy. our visibility is above six from san jose to unlimited or ten where you see elsewhere. in san jose, what a difference 24 hours makes just a few high clouds and a few trails from some passing airplanes well above the city skyline. more sunshine, warmer temperatures today and today is the going of a mini warming trend that will last through the weekend and we slam the door shut as canada sends a push of

cold, unfortunately, dry air on monday and tuesday. we need the rain. you can see the haze hanging in the air and you can see the shadows from the lower sun angle. temperatures are from one degree warmer in santa rosa to eight in slow and we have the biggest jump there. we are out of the 50's and 60's and back in the 60's to near 70. still a little bit below average but not like yesterday. high pressure on top of an area of low pressure and the low pressure is wrapping some dry air at the surface and it is mixing out the marine layer and the moisture is right there and those are the high clouds we will have today, tomorrow, and lesser extent on sunday. because the weak system stays offshore there is no rain but it opens us up to the warm sunshine. today, upper 50's along the coast to mid-to-upper 60's for most of the north bay and bay shore and the south bay and napa at 70 and a lot of low 70's in the east bay valley.

tonight the temperatures are the constant, low-to-mid 40's in the deepest valley and a few 30's up north and the fog will form tonight while most of us are cloudy and clear with temperatures pushing the upper 40's to low 50's. we will talk about danville with the small crafts festival there and it will be gorgeous both days. the temperatures are starting at 10:00 at 60 and warming to the low 70's by noon and upper 70's from 2:00 to 5:00. we will have a game at the coliseum, and we have the steelers in town to take on the raiders in the upper 50's and low-to-mid 50's from 1:00 o'clock to 5:00. that was supposed to be...like tahoe. we will ignore what is behind me and look at the temperatures: the average high is 59 degrees and we are in the upper 60's. guess what happens as we head toward monday? the storm that brings us the cold air, we drop around five to 12 degrees and it will bring snow showers to the sierra on

monday and tuesday. check out tuesday's temperatures: five- to ten-degrees cooler than the weekend and we will start a warming trend on wednesday. we round out october with absolutely no rain. that is unusual for halloween. we always have a thresh of moisture but not this time with temperatures mild. >> speaking of halloween threat, halloween costumes could be safer without the mask. an investigation by phoenix tv station discovered masks are crawling with germs and bacteria. a dozen rubber masks were tested and they found everything from mold to fungus. doctors recommend soaking masks in rubbing alcohol before you wear them. >> that gross. >> listen to this, a southern california dad had one of the most brillant halloween costumes that made him and the daughter the hottest on the web this week. that is 22-month-old zoe running
