>> los angeles police surrounded terminal 3 at lax. the suspect has been stopped but police are taking precautions in case there are other shooters. >> we are going to the newsroom. >> details are coming in. we saw the f.b.i. arriving. this started at 9:30 at a checkpoint inside terminal 3 that houses air tran, alaska and jetblue. a man fired shots with a rifle at a security check point. it ended up with several people wounded. at least three. one wore a t.s.a. officer uniform and we believe the t.s.a. officer was shot. police and security immediately moved in ordering people to get out, evacuate the terminal. some went on to the tarmac where they were loaded on the buses. the suspected shooter has been shot and taken into custody but we talked with a local man by known who flew in and said all hell broke loose. >> all hell broke loose because

people were pouring out of the terminal on to the tarmac. police arrived, the cars came driving up. we were watching this all happen, thinking, this is really weird. i heard two shots fired outside like it was fired from inside the terminal. >> armed police arrived and triage times were set up. reports confirm the shooter used an ar-15 assault rifle which is called the m-16 for the military lax is shut down with no notes coming or going out of that airport. we will be updating the situation with more information as it becomes available at abc7 news. >> we want to get you a closer look where this is happening. perhaps you have flown into or out of los angeles airport.

terminal 3 is virgin american's terminal on the northeast side. virgin goes to 16 destinations including san francisco and san jose. a spokesman at san jose is telling us that virgin america and southwest airlines from los angeles originally from the west coast could be diverted to san jose. there is one southwest airlines flight to los angeles that is waiting at the gate at san jose airport unable to depart. southwest and virgin are two of the six airlines that head to los angeles from san jose. presumably, there are other airlines still heading there. >> abc7 news is reporting that the lax shooting prompted airports in new york to increase security efforts there including the high visibility heavy weapon patrol. they want the display of heavy weapons to deter copycat shooters. we will have continuing coverage of shooting at lax with updates

later in the newscast. you can follow us on twitter, as well, for breaking news alerts. >> we have news that is breaking over oakland right now where you can see traffic is backed up in the eastbound lanes of the tunnel closed after a car fire filled the tunnel with smoke. moments ago, the c.h.p. re-opened one area of the tunnel. we understand eight people are being transported to the hospital after this tunnel fire and the traffic is backed up eastbound. we will have more as we follow the story. >> bart union workers are voting on the tennive deal that -- the tentative contract deal that caused a strike for bart. amy? >> kristen, more than 1,400 union members are due here to vote. the polls are open now. you can see they are casting

their ballots. they need a simple majority, 50 percent plus one to pass the contract. >> as bart employees head to the polls to vote on the contract, some riders have a few last thoughts to consider before they vote. >> pass the contract. just take it. it is not going to get any better. >> they need to resolve the issue. whatever it takes, right? too many are affected. >> the union leaders have a good feeling the contract will pass. >> we got a good reception. the team, when they talked to the members, got a good reception. it was good. >> they capped the votes a city council still member in orinda is focusing on other voters. >> it is not a coincidence, a lot is going on, on bart, today. we want to make sure the riders are being held. >> steve has 20,000 signatures in support of a ban on transit worker strikes. he has 1,300 e-mails written

directly to senator who is the chairman of the transportation committee and will print the signatures today. >> rideers and commuters have to take a stand and say, no more, this is not reasonable. we need to get our political leaders to respond. >> bart union leaders say they deserve the right to strike. >> he needs to walk a day in our shoes and find out what it is like to be a bart employee. >> back to the issue of the contract vote, the polls are going to be open until 10:00 tonight and they will make an announcement with the results, they hope, by 11:00 tonight. >> we want to take you back to our other breaking story with traffic backed up after a car fire filled a tunnel with smoke. laura, what is going on?

we are trying to get laura by phone. >> the eastbound lanes of highway 24, a couple hundreds yards west of the tunnel we are standing in the middle of the emergency vehicles. there were five ambulances but now they are down to two ambulances. eight people have been transported because of possible smoke inhalation. the driver of the car that burned up inside the tunnel is not injured seriously. everyone was caught with the thick smoke and ran or walked to the west side. their cars, still, are in there. i am told by c.h.p. there are too many to count. it will take, they said, only 20 minutes to re-open the tunnel. they will cheer the cars as we speaking towing or push them to the each side of the bore, so that operation will be ending

shortly. everyone everyone has walked away or gone away in the ambulance if they left the cars there and others will come in and drive the car to the other side. the cars are not damage but it was thick smoke. c.h.p. says it will be open in the bore, eastbound. >> we will follow this for you on twitter. >> the highway patrol is investigating a fatal accident that killed a man doing overnight contract work for caltran. this happened on interstate 680 at 2:30 this morning. police say a driver went off the road and on to the shoulder killing the worker and injuring another man. the driver is under arrest at the hospital for felony driving under the influence. >> in san francisco a dump truck was partly hanging off a

guardrail on highway 101 near paul avenue. these are pictures from sky 7. a scary scene with the investigators saying the truck struck two other cars. there is no word on the cause of the accident. amazingly, no one was hurt. >> concord police are looking for thieves could cause people to go hungry at a local food bank that was targeted before they could expand their service. matt? >> yes, disheartened is how workers describe the impact of the purring later, possibly delaying the scheduled opening of the new center. police say it afternooned on tuesday night. someone broke interest the construction site for the new monument crisis center on market street and stole $18,000 in building supplies and tools. they began a couple of months ago and were to complete by the end of the year. now workers share tools, possibly delaying the scheduled

opening. >> it was heartbreaking to come to work and the doors are open and all of my personal stuff was again, literally every tool i owned, again. you do not think you will get it back or you do not know when you will get it back. it drags you down. >> the monument crisis center helps out thousands each month with food, after school tutoring and other charity work. it is housed in a small building on monument boulevard. the community group hopes the clients will step up to replace the tools and supplies and are considering hiring a security guard to watch the site. the police say they are investigating but have not located any suspects. >> more on the breaking news from the top of the newscast, the shootings at lax and how it is affecting flights. a new mack eye for the obama

stunning new information from republicans of the affordable health care act website, with suggestions that only six people successfully signed up for coverage on the first day of enrollment. that number did not hit 250 by the end of day two after millions tried to log on.

health and human services secretary testified that the website's flaws make any early data unreliable. her agency will not release official enrollment numbers for a few weeks. >> change will benefit people who have health flexible spending accounts. workers can carry over to the next year up to $500 they do not spend. until how it has been use it or lose it. they are voluntary plans that let employees put pretax dollars from the paycheck into an account to pay for medical, dental and vision bills. the government is trying to motivate more people to participate and is effective immediately. >> our meteorologist, mike nicco, has the forecast. >> a nice day to enjoy the sunshine, some calm conditions and warm air because it will not last. the winds of changing are bringing it pack in the forecast. there is a chance even of rain in the seven-day outlook. >> surf is up in the bay area and the maverick surf competition can happen any time

>> covering oakland, oakland, sunnyvale and all the bay area, this is abc7 news. >> we continue to follow breaking news from los angeles. you are looking at a picture of lax airport. abc has confirmed that one t.s.a. officer who was shot is dead now at the airport this morning. three or four, perhaps several more, officers are injured with various reports. a suspect is in custody. the suspect had an ar-15 type assault rifle.

all flights are grounded at lax right now. there will be a lot of flights on the west coast diverted. president obama has been notified. in a little bit at 11:30, lapd and lax will hold a joint news conference to update the public on the situation at lax. >> on to other news of the day: surf's up as the window for maverick surf contest opens today off half moon bay that allows the best surfers to test their skills. the waves at ocean beach in san francisco looked like that yesterday. some waves were up to 6'. you can see how many surfers took advantage. maverick surfers are given 24 hours to arrive when the contest is called. >> any waves in store? >> no big storms right now. we do have a storm that will pass us to the north this weekend. outside, can you see what is

going on with live doppler 7 hd and highway dry it is. there are no radar runs and no clouds until you are in the ocean. our off-shore breeze is chasing them away. the winds are below den miles per hour and we get a gust through napa valley up to 17 miles per hour. everyone is in the 60's but for san carlos at 59 along with half moon bay which is our warm spot. napa is 68 and san ramon is 69 and los gatos is 67. in san jose, it is 63 and total sunshine. we will have total sunshine in our warmest afternoon upon us. cooler embryos through the week end as we introduce autumn to november with rain possible next week, likely on friday. today is the first day of the winter "spare the air" although it is not a "spare the air" day. temperatures are four to six degrees above average. you will enable to enjoy them until 6:11.
