into gun control and the second amendment. >> the parents of a 13-year-old santa rosa boy shot and killed by a sheriff's deputy filed a lawsuit against sonoma county and the officer that pulled the trigger. andy lopez was killed by a deputy. his parents asking for a fair, and thorough, investigation. we leanne is in the newsroom tonight. >> reporter: prior to filing the lawsuit, the fame had an autopsy performed on their 13-year-old son and asking the fbi bring in a pathologist to perform an independent one. that is why they have yet to bury their son. the lawyer representing the family of the 13-year-old andy lopez says it was a case of racial profiling. >> he assumed a mexican american kid is a gang member, dressed like a gang member. i'm going to shoot first, ask questions later. >> sonoma county responded saying statements in the claims

alleging the sheriff encourages deputies to prematurely shoot suspects are false lopez was shot and killed october 22nd. two deputies spotted the team walking. one of them told investigators he mistook the teen's pellet gun for a real one. the attorney says that video comparing the two has offended the family. >> if you listen to their conduct, displaying, it's a done deal, folks they have already concluded that the shooting was justified. okay? shame on them. >> reporter: the family had an independent autopsy done, showing seven bullets struck lopez but the first one, through his heart, which brought him down. >> gelhaus unloaded in a super reckless way, i mean, say it's reckless doesn't come close.

>> reporter: gelhaus told police he feared for his life and those around him. the boy's mother told reporters she is mad that gelhaus is home, on paid leave, her son is dead. she says i want them to arrest that asassin. the fbi is conducting an independent investigation. the family today showed these pictures of their son, who they say was a loving boy. >> we want justice z then, also sh we want an honest investigation. >> reporter: the mexican consulate near san francisco referring parents negotiated with the american government to allow the boy's grandmother and aunt to come from mexico for the funeral. >> thank you. pro tests against the shooting of andy lopez are ongoing with the community

executives at twitter boosted the asking price for their stock offering this week. the stock will begin trading thursday. between $23 to $25 per share. at the high end, twitter could raise more than $2 billion making it second biggest ipo, ever, behind facebook a new associated press poll
