winds have picked up and temperatures are in the mid to low 60s. but still decent and cool toward the evening. we have rain in the extended outlook. developing news in unincorporated san jose. sheriff investigators are on scene of a fatal shooting by deputies this morning. three deputies were called to oo tri-plex shortly after midnight to investigate glass breaking reports. the sheriff's office is not saying what kind of weapon the man had, but we know deputies shot and killed him. the district attorney's office is investigating this as well. here's a live look. it opened shortly after 4:00 this morning. we should note that right now

the second and third are closed while cal-tran crews restrike the approach ls. >> and we captured the moment the sign changed from closed to open and if first cars drove through with an escort. last night workers recon figured the number two board to be permanently to eastbound traffic. commuters will see the biggest benefit during peak hours with an average of five minutes taken off their commute. >> it's going to help people who commute into the city during the weekend. i think it will relieve the congestion we see on the weekend. traffic is backed up. we continue to follow developing news.

last night b.a.r.t.'s board voted to renegotiate part of the contract with the union. bart board of directors. they decided to go back to the bargaining table with the union. >> it's important to find a middle ground. >> at issue is what the b.a.r.t. board calls a clerical error. they say employees can receive six weeks of paid leave under the federal medical leave act. the b.a.r.t. board says that provision was a mistake and negotiators like loi sily signe form without reading it. >> they didn't expect it to be in the package because they never discussed it. they say it was caused $44.2 million over four years. which is more than half the cost of the entire $67 million tentative agreement. the union says a deal is a deal.

>> i don't see how. it's an honest mistake. you find it. we signed it. >> i just don't want another strike. >> the board says former chief gosht tor is out. abc 7 news. police found an 8-year-old boy with stab wounds. the boy was rushed to a trauma center in critical condition. the man is out of the hospital. police arrested a fairfield resident. this morning she's under arrest for two counts of assault. they found her after getting # 11 calls about a disturbance. the investigation is ongoing. police want to hear from anyone who witnessed what led up to the attack. new this morning, san jose police are investigating a fatal shooting. police were called to west san

carlos around 7:30 last night. that's where they found a man who was shot at least once. he was taken to the hospital where he was later pronounced dead. police have no suspects in custody right now, but, of course, the investigation is just getting started. it is san jose's first homicide of 2014. last year the city had 46, which was the highest number in 40 years. an update we brought you early this morning. police have arrested a bank robbery suspect. this video shows the man robbing the branch around 11:00. investigators say he was located and arrested by police. now to everyone's favorite story, bat kid has saved the city. yesterday the city of san francisco was transformed into gotham city to help make

5-year-old miles scott's dream of becoming a super hero come true. >> reporter: as bat kid emerged from batman's smoky base of operations in a lamborghini bat mobile. it was the beginning of a day long adventure. [ cheering ] >> reporter: when much of the city cheered own and is still cheering. >> in san francisco we don't really have a lot of kids. i think there's a lot of us like, yes, we get to do something fun for a kid. >> reporter: bat kid, also known as 5-year-old miles scott helped batman disarm a serious device and free a damsell in distress tied to the cable line and then to a bank to foil the riddler's plan for a major heist. the suited villain was led off and the bat kid was met with growing applause from the crowd.

and the bat duo had to set him free and help the police take away yet another villain. but there's more. >> i want to thank the bat kid for saving our city. the cheering crowd got their final word from the boy hero. miles is a cancer survivor. when his leukemia went into remission he asked for this wish. the bay area chapter of the make-a-wish foundation quickly got to work. he helped entertain the bat kid put and put the whole day together enthusiastically. >> he's our hero. it's great. >> reporter: san francisco loves bat kid indeed. >> the department of justice even got in on the act sending out this news release about the

indictment of the riddler and penguin. if not for the heroics of the bat kid. the president got involved congratulating miles in a video posted online. he then tweeted this photo of miles running down the street yesterday morning. the president also encouraged people to follow miles with #sfbatkid. at one point we measured more than 20 tweets a second. similar hash tags like bat kid and gotham were trending all over the doesn't. and police chief's son designed these special bat kid t-shirts. they originally expected to sell 300 but ended up selling 3,000. so you can buy one online. they're $20. all of the proceeds will go to the make-a-wish foundation. and since yesterday's edition

an attorney for the oakland teenager accused of setting a high school senior on trial says

it was not homophobic. sasha was born male and napping on the transit bus when a 16-year-old student from oakland high school set sasha on fire. the teen's lawyer called it an ill considered prank that went terribly wrong. a judge has granted the defense a november 26th hearing to challenge the man. a man wanted for a horrific attack has been 28-year-old timothy chase was seen here. he is seen walking up to a person on the walk and stomping on her head repeatedly. police make several arrests in san francisco after the crowd

turned hostile yesterday. a crowd ran from him to his home in the apartments after they tried to give him a bike citation. neighbors and families thought police were being too brutal. two officers and two of the suspects were injured. we have an abc 7 news exclusive for you this morning. customers were shocked at what they found on the counter at a local post office. personal information on a pad of scratch paper. the story you'll only see on abc 7 news. >> then i saw the partial social security card. >> jan, who does not want her last name used was shocked when she looked at the pad of scratch paper on the post office counter.

copies of social security cards, driver's licenses and other information that shouldn't be out here for anyone to see. >> what reaction did you have here? i mean, it's right there for anybody to pick up. earlier this week jan went to the post office in menlo park. we showed alicia the copy of her work badge. she provided that and other personal data when she applied for a passport. a couple was providing personal information for the child's passport.

they overheard our situation. >> none of the information would ever show up on somebody's scratch pad. >> we showed the supervisor what we found. >> this is a risk of identity theft. >> i agree with you. >> how did this happen? >> i don't know. i would have to investigate. >> we'll let you know what they find. workers are under way around the clock to get water and aide. they decimated cities and town where is the survivors are hungry, dehydrated and at risk for disease. the official count stands at 11079. but more than 3,600 people are estimated to have died. at least 600,000 people have been displaced. officials are focusing on getting hope to survivors.

the pace of the delays operation is picking up with more food and medical aid reaching the disaster zone. happening today in the bay area, there will be a typhoon haiyan relief fund-raiser from 1:00 to 4:00 in the afternoon. the church is just west of interstate 280. on monday abc 7 news is hosting a fund-raiser to help the victims. all you have to do is call in on monday right here on abc 7. the golden gate bridge's board of directors i proved a $2 fee.

get ready for fresh crab. take a look. this is the first dungeoness crab of the season. it wasn't all good, though. rough seas kept most crabbers from heading out in the boats. that means you'll pay between $5.50 and $6.50 per pound. this is the first conducted under a new state law that limits the numbers of traps catchers can carry on their fishing boat. it's unfortunate some had to be docked on the first day. but how are we looking moving ahead? >> well, we'll be breezy this afternoon. and the waves blown out in the afternoon due to gusty winds. but live doppler 7 hd picking up cloudiness. now there's a system that will provide showers along the north shores. right now some rain but cooler

bring this in by tuesday of the north bay. here's a system bringing in the stronger onshore flow and making it gusty along the coast. as we head into tuesday, look what happens. we have more green on the map here. perhaps thursday, a lingering shower. so it's a couple of systems that will be getting together and i lowing for the high pressure ridge to move to the east. that's allowing the ponlt of rain chances. 63 in san jose and sunnyvale. on the peninsula, a cool afternoon at half-moon bay with temperatures in the upper 50s. should be 63 this time of year. in the northbay. some low 60s. we have a ways to go.

i have a look at the seven-day outlook coming up. coming up, the caldecott tunnel is open for business. the new tunnel officially opened at 4:00 shortly this morning. that's when the sign changed from closed to open and the first cars were escorted by the chp through there. last night workers finished recon figuring the number two board to a permanent eastbound board of traffic. cal-tran says reverse commuters will see the biggest benefit during peak hours with an average of five minutes taken off their commute. cal-tran says another dramatic change is for people heading in to san francisco on the weekend. there used to be one tunnel open, but now there are two. and we should note the second is closed while the crews restrike the approach. it should reopen by noon.

president obama says improved efficiency are hoping the environment and the the economy. they will increase u.s. oil extraction. last month it exceeded oil imports for the first time in nearly two decades. that's a big deal. that's a tremendous step towards american energy independence. but this is important, too. we reached this milestone in part not only because we're producing more energy, but because we're wasting less energy. for the republican senator ron johnson of wisconsin criticized the affordable care act. he said the initial claims that americans could keep their insurance plans amounts to political fraud.

it would allow insurers to extend health plans. the insurance policies are being canceled. opponents say the bill will industry important consumer protection. >> that idea that it was helping consumers at the underbelly is poisonous with -- in terms of the health and well being of the american people. >> president obama has already vowed to veto the bill. democrats in the house say they voted for it because of pressure from voters. >> i'm accountable to the people who sent me here. the president offered his own fix on thursday. it will allow them to extend health plans for existing customers through 2014.

that'sen extra year for insurers and customers who adapt to the new rule. yesterday the president met with insurance executives to build support for his proposed fix. programmers in san francisco have created an online tool to help them deal with the website. they got the idea when they have trouble signing up for insurance plan on healthcare.gov. it took two days and a couple of hundred dollars to build. >> we thought that when we first heard it we could create a much more usable experience than what healthcare.gov was offering in terms of finding the plans themselves. now, to be clear, you cannot use it to sign up for a held plan. just search for one. on the site you will enter your zip code and income level. that's a good day for a little boy.

many smokers can no longer light up at home thanks to a new smoking ban in effect. the ordnance bans smoking inside apartments, condos, any residence that shares a common wall with another home. it took effect on thursday. landlords now face the task of enforcing it. it's part of a broader law that the city council passed last year. it also bans smoking in patios, parks and bus stops. local boy scouts will be collecting tons of food to feed hungry people in the bay area. here's a look at the food collected last year. 30,000 youngsters take part in today's food drive. the scouts hope to collect about half a million pounds of food. and you can help them reach the goal by going to our website. you'll find a link on our website. it's 8:41 on this saturday morning.

here's a question for you. do student athletes wanting to attend cal get an academic break? the median high school grade point average for incoming freshmen at cal is 4 out of 19 on a 4.0 scale. that's because so many take extra credit courses to try to get in. not every student including athletes arrived with the high marks. this whole school is a school of excellence. >> and that's coming from a freshman football player at cal even though he was accepted with a 3.6 gpa. the university says it looks at other factors other than academics when selecting students and never picks someone bound to fail.

>> we know they have so much to bring to the community. i don't focus on taking science classes. you work with your strong points. i guess for them it's sports. the cal football team hasn't really performed well this year. in the pac-12 conference they are 0 for 7. uc president janet napolitano had this to say about the team. >> the cal football team. the number one concern i have is not the record. it's the graduation rate. the national collegiate athletic association found between 2003 and 2006 only 44% of football players at cal graduated. the most recent numbers are not out yet. >> they're leaving early. we have work to do on that front and we already know it. the athletic director is assembling a task force. we want to look at it in the

water at berkeley. 46 in novato. 50 in concord and the livermore valley. but most of us may be getting tired of this. the weather maker has been our friend for weeks and months now. we need to dislodge it for the storms. we'll have a preseasonal afternoon. and a chance of rain coming into the north bay as soon as tuesday. we do have rain in crescent city. it's due to this weak system. it does allow for some clouds to develop around the south bay in the afternoon. and so with the cooler air mass, we will be a little bit cooler today and tomorrow with temperatures in the 50s at the

coast. breezy at the bay but still droi with plenty of sunshine. we are looking at an area of high pressure that's keeping us so dry to eventually slide east. and then the flow gets more zonal, allowing for perhaps incoming weather systems on tuesday and wednesday. it doesn't look very promising or very strong. we'll take what we can get and perhaps a little bit of rain. 66 in sacramento. 54 in yosemite and dry all the way through southern california. a few rain drops up to eureka. not perhaps the great surfing day in santa cruz with the gusting winds. 62 in oakland today with mid 660s returning for santa rosa and livermore. partly cloudy both weekend days. a little sunnier. out ahead of the next system that could bring us rain in the
