and good wednesday morning. we begin with the federal drug investigation that netted a freshman congressman. >> republican trey radel, will answer to charges today in a washington, d.c. courtroom. he already has a message for the voters back home. >> i'm a conservative. >> reporter: overnight, comments flooding the facebook page of first-term florida congressman trey radel. after he posted an apology saying, i am disappointed in myself. and i stand ready to face the consequences of my actions. radel is charged with misdemeanor cocaine possession. he was arrested last month in an fbi sting. and is set to be arraigned today. the 37-year-old blames his struggle with alcoholism for leading him to, quote, a irresponsible choice. his story drawing comparisons to embattled toronto mayor, rob ford. >> i'm not an addict of any sort. >> reporter: radel was elected last year. telling cnn -- >> i just want to do something to be able to help.

>> reporter: in a recent interview, he said his favorite vacation spot outside of florida is cartagena, colombia. and he's known for his love of hip-hop music. >> public enemy "bring the noise," is one of my favorite tracks. >> reporter: voters are already bringing the noise, asking for his resignation. >> his constituents that voted him into office. and this is what he did for them? it's embarrassing. >> reporter: gop leaders aren't going that far yet. in a statement, radel's saying, as the father of a young son and a husband to a loving wife, i need to get help so i can be a better man for both of them. the congressman says he will now seek treatment. as for the charges, he faces six months in jail. now, a developing story from the coast of south florida. a massive search under way right now for two people missing after an air ambulance went down in the atlantic off of ft. lauderdale. the coast guard has recovered some wreckage of the lear jet. and the bodies of two other people on the plane have been recovered. that flight was returning to cozumel, mexico, after bringing a patient to florida yesterday. it is still too early to know what caused the plane to go down.

and this morning, a popular virginia lawmaker is recovering from a vicious stabbing. state senator creigh deeds is in fair condition. the apparent assailant was deeds' own son, 24-year-old, gus, who then took his own life. the attack happening in the senator's rural home. jim avila explains how deeds was able to get help. >> reporter: still bleeding in his chest and in his head, and his son dying in the house over on the hill there, senator deeds walked down that long driveway, and then continued down to highway 42, about 75 yards in all, where, by happenstance, he was discovered by a cousin, on the road, who took him to his house, where 911 was finally called. >> deeds has spoken to investigators. reports say that his son went -- underwent a mental health evaluation monday but was not admitted to a psychiatric hospital because there were no beds available. the closely-watched vote. city of albuquerque has rejected a ban on late-term abortions. residents voted 55-45 against

the measure that would ban abortions after 20 weeks, except to save the mother's life. reproductive rights advocates called it a victory for women and their families. abortion opponents had hoped the victory would create national momentum. and the supreme court saying the tough texas abortion law can stand while it's being appealed. the justices voted 5-4 yesterday. that leaves the provision requiring doctors to perform abortions in clinics to have admitting privileges at a nearby hospital. the case remains on appeal in a federal court in new orleans. now, to the midwest, where teams from fema will soon start fanning across the tornado zone to assess the damage from sunday's deadly tornado outbreak. they'll be inspecting hundreds of ruined homes in illinois to clear the way for families to receive federal assistance. eight people were killed when dozens of tornadoes violently tore through the area on sunday. and new details are emerging about the security agreement being worked out between the u.s. and afghanistan. afghan leaders are expecting to receive a contrite letter from president obama, apologizing for u.s. mistakes, with a promise not to repeat them. the agreement is aimed at

allowing american troops to stay in afghanistan past next year's deadline. an alarm has been raised on capitol hill, about the security of the obama care website. cyber security experts have warned a house panel that healthcare.gov should be shut down. unless serious security issues are ve resolved. one of the security experts said once he breached the site, he had ability to use users' web cams. and had access to everything on their computers. the affordable care act came up in information on "the tonight show," as former president george w. bush stepped back into the spotlight. in a rare public appearance, mr. bush and former first lady, laura bush, talked to jay leno, about how he felt when doctors recently discovered he had a blocked artery. >> when the president had a heart scare, how scary was that? >> it was scary. very scary. >> i wasn't that scared.>> was it -- you had obama care? >> yes. >> talking about president obama

now, pilots are being singled out, as well, because of their

welcome back. johnson & johnson being slammed with a multibillion-dollar settlement. the company will pay at least $2.5 billion to those people it is accused of help selling faulty hip implants to. the deal provides about $250,000 per patient. and it covers those who had the implants removed or replaced before the end of august. the biggest corporate payout in history is this one. the $13 billion settlement by jpmorgan chase for knowingly selling bad mortgages.

$4 billion will go to helping affected homeowners. an estimated $1.5 billion will be sent on loan forgiveness. $2 billion to interest rate reductions and other financial support. and jpmorgan is still the subject of an ongoing criminal investigation. >> five years after the housing crisis, not a single high-ranking banking official has gone to jail. why is that? >> no institution is too big to be held accountable. we're going to be extremely aggressive. >> attorney general eric holder also says jpmorgan helped set the stage for the 2008 financial meltdown. the record deal could serve as a template for similar settlements with other banks. and new york city is now the first large city in the country to prohibit tobacco sales to young adults. mayor michael bloomberg, a former smoker himself, signed the bill into law yesterday. it bans the sale of tobacco products to anyone under 21. the law also sets the minimum price for a pack of smokes at $10.50. h&m has customers upset with

law for presiding over his son's same-sex wedding. frank schaffer was unrepentant before a jury of fellow clergy refusing to promise not to perform more gay unions. he complained that gays are being treated like second-class christian. and he says he has been called by god to be an advocate for gay rights. the faa is waging a crackdown on obesity. it's targeting overweight pilots. abc's david kerley explains. >> reporter: overweight passengers have been kicked off planes. remember actor/director kevin smith, who says he's way fat, being asked to deplane. it's obese pilots who could be in jeopardy of losing their license to fly. not necessarily because of their weight. rather, their lack of sleep. >> the science is pretty clear. when a pilot does not get enough sleep, it really has the same physiological effects as drinking. >> reporter: and it's not just pilots. but air traffic controllers, too. altogether, that's nearly 160,000 people.

it's estimated that 3% to 7%, may be obese and suffer apnea. that could be 5,000 pilots and controllers. this plan comes five years after a go! airlines flight from honolulu to hilo, hawaii. a short flight. but both pilots fell asleep and overshot the airport before waking up and landing safely. why? the captain's undiagnosed obstructive sleep apnea, according to the ntsb. a captain who was experiencing daytime sleepiness and was obese. >> people who have sleep apnea, won't be feeling refreshing sleep. in the morning when they wake up, it's like they haven't got enough sleep. >> reporter: so, the faa flight surgeon says any pilot with a body mass index of 40, will have to see a sleep expert. and if diagnosed with apnea, will have to be treated before they can be medically certificated to work. this is a major change. and it's coming soon. what does a 40 body mass index mean for a pilot that's my height, six feet? he would have to weigh nearly

300 pounds. but the flight surgeon says he's going to lower that standard down the road. david kerley, abc news, reagan national airport. now, to a small study that finds that women who go to sleep and wake up at a consistent time every day have a lower body fat. researchers also found sleeping less than 6 1/2 or more than 8 1/2 hours a night was tied to higher body fat. earlier studies had found that lack of sleep caused dieters to lose muscle instead of fat. if your memory is failing you, you'd be surprised to learn that google may be to blame. harvard researchers say people are relying so much on the search engine to check facts, it is making them forgetful. the study found many of us view google as an extension of our own intelligence. scientists say the internet can undermind the impulse that makes sure important facts are stored in our memory banks. billionaire media mogul rupert murdoch is ending his third marriage. but will it be the biggest divorce ever? murdoch and his almost-ex-wife wendi deng, appear before a judge here in manhattan today to make it final.

we have more wet weather behind this the form of scattered showers. the best chance of steady rain is through the morning commute. we will have scattered showers this afternoon and temperatures are mild in the upper 50 to mill 60's. now the commute, leyla gulen? >> speaking of ponding that is what we have, reports of flooding at the intersection of 101 and 80. headed interest san francisco approaching the bay bridge you need to slow down. this is volume slowing things down. you can see the green which is an indication of where the commute could be affected. 580 is quiet to dublin/pleasanton and accident free. antioch to concord is 24 minutes. southbound from san rafael to san francisco is under 20 minute s. eric? >> we can use the rain.
