the three men are 18. they lived with the 17-year-old black student from august 20 to october 13 this year. the prosecution says the three defendants called him racial names and put up a confederate flying if their dorm and put a bicycle lock on his neck and refused to give him a keep before finally letting him out. the d.a. says when they tried to do it again he resisted and fought back and ended up with a bruised lip which led to the battery charge. some students this morning told us they were surprised it happened here. >> it is again the norm to think that anyone would do that to a person to another human being ...just hurts to happen in our dorms. that crazy. >> the prosecution says they decided to file the hate crime charge because of the bullying and symbols of hatred and the fact he was the only person of color in the suite and the only one targeted. the three students could face a year in county jail.
