reporter is first breaking news on twitter about half an hour ago. heather? >> reporter: this is not about getting the disputed clause put back into the contract this, is about process about the board voting to okay the deal, but only after signed clause was removed unions would like to work with the district on the clause but again, this is separate and about process the way it went down, unions feel, hasn't happened in the collective bargaining world. after two strikes this year, a cooling off, months of negotiations, and two worker deaths on the tracks it appears bart and unions had a deal in october, then, stunning aannouncement from bart that management had signed a family medical leave clause in error. section 4.8 giving workers up to six weeks paid family leave. bart says it never meant to agree to that, voting in november to approve the $67

shooting in oakland this afternoon. investigators responded to the incident on fruit veil avenue. police say the victim may have known the attacker. the gunman fled in a car and the victim was conscious and taken to highland hospital. >> a vallejo shooting suspect under arrest apprehended after making a get away on a boat. sky seven over the coast guard station when authorities took him into custody. investigators say the suspect shot another person around 12:30 and then escaped on water in this small boat. the coast guard caught up with the man, pull that had boat over and arrested him. the victim was taken to the hospital. >> crime is at a five year high in san francisco. police say

46,000 crimes reported throughout the enld of october, most since department began tracking numbers in 2009. and nearly 40,000 are car break ins, thefts and robberies. police say smart phones and other electronic devices continue to be the easiest and most lucrative for thieves and some are using bart to get to the city, just for the purpose of stealing. it's not just happening san francisco. in the south bay, property crimes jumped nearly 33% and seeing a 23% jump in oakland in appropriate and violent crime. >> new images of a police helicopter that crashed into a pub in glasgow, scotland about three hours ago. witnesses say there are injuries, numerous people have been trying to clamor out of the building. a rescue operation is underway now to bring out people still believed to be trapped inside. right now it's just after 1:00
