near at pump. our reporter, amy hollyfield, is near the scene. we dust got a briefing from the alameda sheriff deputy. listen to this, the deputy who tried to pull over the driver of the s.u.v. that crashed, that deputy ended up having to save that driver, rescue him, from the burning car. the deputy thought the driver appeared drunk so he tried to pull him over on 98th in oakland. the driver took off. as he raced down 98th he lost criminal and crashed into the 24 hour gas station knocking over two pumps. that caused a fire. this happened next to an apartment complex, the brookfield place apartments. residents say they hear the crash, they saw the gas pup was >> it was overwhelming. one thing to be on fire but a

gas station? it could have blown up. i was in panic mode telling everyone "let's go, let's go." you don't know what will happen. >> the apartment complex was evacuated. the fire is out. firefighters are erring on the side of caution and waiting for an expert for come out and explain it before they get the "all clear." they think they will open up the street in the next half hour. it does look like they are starting to let this area return to normal soon. they are feeling confident about the situation and the safety. the dave was taken to the hospital and he could have a broken leg and he has been charged with d.u.i. >> thank you, now a check on the weather forecast. mike?

is moved to the shoulder at grope -- greenville road. at highway 4 we have a closure overnight to lone try way in the eastbound direction all lanes are blocked that could affect the saturday commute. >> thank you. developing news this morning, target now says data hackers stole credit card information on 40 million accounts before thanksgiving day and it wasn't discovered until four days ago. if you used a credit or debit card at target since thanksgiving day, check your statements. the minnesota-based company is working with the secret service and private firms to investigate the broach. an expert says that it would be difficult to spot that kind of data theft in such a large system. >> what is most likely the case is some piece of software along the chain of processing credit card transactions was

compromised by something similar to a computer virus. >> the data affected including names, credit or debit card numbers, and security codes. according to a notice posted for customers on the target site, they say they found the unauthorized access december 15th but it remains unclear who conducted the data broach. and how. the company has set up a phone number at 866-852-8680. it is also posted on our website at abc7news.com. matt keller will have more in 30 minutes. >> developing news in oakland: the family of a 13-year-old who is on life support after tonsil surgery went wrong is bracing for a long legal battle with children's hospital. they hoping the power of prayer will help her recover. katie marzullo is in the newsroom with the story.

updated. the family attorney says they are at a stand off. >> today, the state public utilities commission meets in san francisco this morning to vote on sanctions and likely fine against pg&e which faces a fine up to $17 million for keeping faulty gas pipeline records and failed to disclose the faulty reports for gas distribution line in san carlos running under britain avenue. the pipeline was not seamless but made of reconditioned pipe that was welded together similar to what we saw in the san bruno explosion. and seniors group will present a petition with 6,000 signatures urging the p.u.c. to deny the request for massive rate increase. pg&e is asking to $4.9 billion rate hike to updetroit the pipeline -- update the pipeline

india is demanding the united states drop the case again the diplomat arrested and strip searched claiming she was the victim of a blackmail attempt by her housekeeper. the case involves 39-year-old woman the -- difficult counsel general in new york. the prosecution says she falsify add visa application for her nanny saying she paid her $4,500 a month when, really, she paid her $3 an hour. the case has sparked widespread outrage in india and is claiming diplomatic immunity and will challenge the arrest. >> delta is apologizing for issuing a confirmation code that reads out as antigay slur. the code read "h8gays." a passenger was flying from atlanta to florida and he noticed it. delta apologized saying the confirmation codes are computer generated and random. we will make every effort to

live from the kgo-tv broadcast center this is abc7 news. >> good morning on thursday at 6:29. a look outside, a look at this picture from our mount tamalpais cam of the bay it is pretty breezy. that is how we wake up. thanks for joining us, i am kristen sze. more breaking news from most of morning. a fiery explosion at an oakland gas station after a driver slammed interest a gas pump while trying to run from police. our news reporter is at 98th with how the officer ended up saving that map's life. amy? >> kristen, there is an ironic

story but, first, what is happening now, they decided it is safe to open up 98th avenue in oakland and they have decided although there is a small leak they have detected here, they are still trying to get to the bottom of what that is and why is it happening they have decided it is safe to let track through but they are keeping the apartment complex empty and not letting the people come back home. they had a near at the gas station overnight when an s.u.v. crashed into two gas pumps. a sheriff deputy tried to pull the driver over as part of their avoid the 21 campaign and therapy looking for possible drunk drivers and they thought he might be impaired. they tried to pull him over but the driver took off and crashed. at that point the drink could not get out. our deputy had to extract the driver from this car. which is the irony of situation, here is the guy they are trying to find out what is going on and they end up having to save him

so that is a little inbound. after the drive was rescued he was taken to the hospital with a possible broken leg and charged with d.u.i. this happened next to the brookfield place apartment complex and the residents say when they saw the gas station was on fire they were terrified can got out as quickly as they could. they are being allowed to shelter in an elementary school nearby to stay warm. i asked, why is it safe enough to open up the street but not the apartment complex and the sergeant slains -- explained they can close a street if a couple of minutes and it takes longer to evacuate the apartment building. they will keep the people out for now and waiting if experts to get to the scene and check owe the leak and explain this system before they feel safe opening up the community.

matt? >> you are right. hackers hit the bull's eye at target stealing the credit and debit card information from millions of customers. the company says the breach started the day before thanksgiving day and went through the black friday weekend through december 15th on sunday. it happened at stores not online and experts believe the hackers broke into the target network when customers swiped the strip only their debit and credit cards. >> it let them take that information and encode it on a new card and duplicate that card and use it as if it was their credit card at any store. >> the secret service says it is investigating the theft but would not give details. target says it is partnering with a third party forensic firm to investigate the incident. the company has set up a again number to help customers who may be a victim. we put that number on our

website at abc7news.com. it could take months to learn if you are a victim. financial experts say check your credit and debit car statements for a couple of months and make sure someone is not stealing from you. >> michael finney recommended closely watching your credit cart account, you can use a monitoring service to check each day, and place a fraud alert to have merchants contact you before opening any new accounts in your name and check with the reporting burrows do make sure there is no fraudulent activity. if you report the fraud you are not held liable. >> the anti-job unified -- antioch unified school district is paying $8 million to special needs children abused by their teacher. the 55-year-old teacher resigned from the elementary school last february after parents reported her to police.
