the breaking news is out o colorado where authorities announced the death of a 17-year-old shot last friday. claire davis was shot point blank in the head and has been in a coma since. she was sitting in a hallway when karl pierson walked in and fired. pierson had been seeking revenge on the school's debate coach who verbally disciplined him. we also have developing news right now. the threat of another b.a.r.t. strike is gone. the unions and transit agency

agreed on a final contract's sticking point. sergio kin na is live with -- quintana is live. reporter: one of the issues that came up during the negotiations was a lack of break room for workers at three different b.a.r.t. stations, including this station here in daly city. that issue is resolved in the agreement, and the big sticking point, extended pay family leave was also resolved. the union held a news conference earlier today. >> we have language in the contract to deal with the family leave, where it follows the law that indicates the members are able to take sick, vacation, or unpaid leave, as family leave. so it will not be paid by the district. members have to use

leave. >> if this agreement is ratified be the union it helpeds end -- ends more than half of a year of a battle. the negotiations included two system shutdowns as the unions win on strike. during one of those strikes two employees were killed ton a track in wall mutt creek, and after an agreement was reached in october, there was another issue. b.a.r.t. managers insisted that was a mistake. the union said it was part of the grand deal. this weekend's final agreement gives b.a.r.t. riders one less thing to worry about through the holidays. >> i'm really happy. i ride b.a.r.t. every day. >> i think at it about time. reporter: there's no word from the unions as to when the membership will vote on agreeing to the tentative agreement as part of the contract. they want to get that done as soon as possible. reporting live in daly city,

11:00 am. it sent thick smoke pouring out of the manhole and closed down the street. no one was hurt. >> a massage therapist faces sexual battery charms involving his clientses. police say this man of menlo park sexually assaulted four women while giving them massages. accused of assaulting a customer here at this spa in palo alto. three other women say they were also assaulted by the therapist during massages at the same spa at the stanford shopping center. a doctor approved by both sides in the case of an oakland teenager placed on life support after a tense -- tonsillectomy will be remain on the life support through the weekend. dan ashley spoke to the mother in an interview you'll only see on abc7.

let's go back towards the eastern half of the ute. man, let me tell you, wichita, kansas, six inches of snow on the ground, expecting an additional six inches by early tomorrow morning, and you can see ahead of the cold air mass, severe thunderstorms moving in through the tennessee valley area, memphis, tennessee, mississippi, and tupelo area. the possibility of tornadic activity in that region of the country, and behind the cold front where the colder air mass is, we're looking at an ice storm expected overnight for chicago, down towards quincy. we're talking a lot of snow. kansas city, up towards milwaukee, close to a foot of new snow expected overnight tonight. numerous delays, and that's also hampering a lot of the holiday deliveries as well. we here on our coast, a lot better. we'll look at the forecast coming up. >> lucky us. thank you. target is making its

customers some new offers today as it tries to recover from a massive credit card brief. this week it was revealed thieves stole credit card information from 40 million customers. the retail giant is offering a 10% discount this weekend and there were good crowds at this target in emeryville. target announced customers affected by the breach would bear absolutely no liability for any fraudulent charges. target is providing free credit monitoring to all affected customers. preparations are well underway for monday night's football game at candlestick park. the last game ever at the stick. ground crews have been painting the 49ers colors on the turf, and papers on the seat will be used on a card stunt. the 49ers moved in 1971, and there are logos for 22 of the 42

an emergency space walk went bert than expected today. astronauts from the international space station pulled out a bad ammonia pump ahead of schedule. the pump held cool the station. an astronaut who has done that same walk herself has described it as being a very lonely and kind of scary. nasa may cancel the third space walk if monday's goes as well as today. >> new video of a dramatic rescue at sea. this happened today off the coast of australia. not far from sydney. two fishermen were clinging to a cooler for 15 hours, floating in the water after their boat sank. the rescue crew was turning around and going home after not being able to find the men when they spotted something in the water. >> holding on to this object for 15 hours or so, so, yeah, they weren't too lovely but happen to

it will be clear overnight. a little chilly inland. in the 30s there. a mild winter day. the first full day of winter. actually will be tomorrow. and dry and mid for the week. we're now in winter. the season chenged with the winter solstice this morning at 9:11. daylight hours, nine hours, 33 minutes, the shortest day of the year. as the winter solstice happened this morning. double-barrel high pressure keeping the storm track well to the north. look how this track is really amplified to the north so this dry weather pattern is going to stay with us right on in through the holiday week ahead. possibly in through the latter part of 2013. in fact the driest years in san francisco, you can see there, is turning out to be at this point this year, 2013.

score of the game. it was 35-6 at intermission. kansas kessler was shot out the second half. didn't matter, alan with the easy score. usc wins. the trojans finish the season 10-4. >> at the new mexico bowl it appeared washington state was headed to victory against colorado state. wsu led by 15 in the fourth but the rams rallied. the lead down to eight. after washington state fumble, colorado state scores again, and then ties it up with a statue of liberty play. it was 45-45, then on the ensuing kickoff, the cougars fumble again in their own territory. that set up this 41-yard field goal as time runs out. the rams hand washington state a heartbreaker, 48-45. >> monday night's game between the 49ers and falcons will likely be the last nfl game ever played at candlestick.
