>> the battle over jahi mcmath, the girl that is still on life support in hospital oakland. the family says she needs an operation before she is and tonight, the hospital refuses. once again, the family is fighting with all they have. even against the best judgment of doctors. abc 7 news reporter allen wong is live with tonight's news developments. allen. >> reporter: this week children's hospital offered the family to help it move jahi to another facility. now there appears to be lines it's not willing to cross, this could all end up back in court again. an undisclosed medical care facility is offering to take in 13-year-old jahi mcmath, it requires her

surgeryically implanted feeding tube but the hospital will not do it. >> help us get her out of your hospital to take her somewhere else. >> reporter: and the family said that the insurance company is willing to pay for it. the hospital spokes person said last week's court ruling that legally ad that jahi alegally brain dead prevent them from performing the surgery. >> the judge did not authorize any surgeryical procedures for transfer for another procedure. they do not believe in performing a surgery on a dead person is good medical practice. >> reporter: the family said she is not dead. >> the court made a judgment of technical definition of briny death. >> reporter: the family will go back to court to get the procedure done but they will

have to act fast because the judge decided that the hospital only has to keep jahi on life support until monday. in oakland, allen wong, abc 7 news. >> this is not the first time, it turns out, children's hospital oakland has been in this type of controversy, the bay area news group found an incident two years ago when another girl went in for a tonsilectomy and left with brain damage. she can no longer walk or talk after undergoing surgery at the children's hospital. her parents sued and settled for more than $4.4 million. developing news out of fresno, a single engine plane has crashed killing the two people on board. fire department officials say the adult male pilot was attempting to land when the car hit a tree. a boy about 9 years old,

believed to be the pilot's nephew, sadly, died in the crash as well. in fremont, a fire chief responding to an in an accident. both parties should be okay. alameda fire would like to hear from anyone who witnessed the crash. reports on of a sufferer in trouble, the call came in just before 4:30 this afternoon, the coast guard as well as local fire crews searched the area around rockawaybeach. no one was found. a sneaker wave could have pulled the the surfer out.

deadline to sign up for coverage has been extended several times. you now have until monday to complete the process if you want coverage starting on january 1st. new details tonight at least one bank -- bay area bank has issued thousands of new credit cards because of the breech at target stores. the customers were among the 40 million people affected by the breech from november 27th to december 15th. target officials say that they have no evidence that customers' pins were compromised in this hack, despite a report from the security blogger that first exposed the breech last week. a firry crash caught on camera. must-see video of strangers jumping out of their cars and in to the fire to save the driver.

clear skies, high clouds are just beginning to touch the coast line as they push in during the overnight hours. a live view here from the rooftop. it's 53 degrees in san francisco, temperatures are in the 40s, oakland, redwood city, los gatos and half moon bay. another look over san francisco, some temperature readings have dropped in to the 30s. santa rosa and napa. and now we go to our live view from the emory forecast is fors this. spare the air tomorrow, the fifth consecutive spare the air day. that will continue on through the beginning of the new year. high pressure still dominating our weather picture, bringing us mild and dry conditions. we do have clouds to our southwest that is pushing through the bay area. we will start the forecast animation during the overnight hours. more will sweep through in the afternoon hours giving us a hazy

sort of filter sunshine kind of day. it will be mild once again tomorrow. now, overnight tonight, look for a chilly conditions in the inland valley, especially up in the north bay, where lows are up in the upper 20s and napa, low to mid 30s in the south bay, and right around the bay, we will see lows dropping to the upper 30s and low 40s and tomorrow, with our filtered sunshine, look for high temperatures in the south bay, and about 66 in san jose, and 67 in los gatos, and 66, and 65 in mountain view and low 60s on the coast at pacifica and half moon bay n and around san francisco, temperatures in the low 60s, and 62 in downtown san francisco. up in the north bay, we will see mid 60s from santa rosa to sonoma, to napa. mid 60s on the east bay, with a high of 66, and oakland, 65 in union city and the inland east bay, highs of 66 in fairfield, livermore and walnut creek.
