another cool evening ahead and i have the accuweather seven-day forecast coming up. katie. >> francis, thank you. we have developing news in oakland a shooting victim is in the hospital with life-threatening injuries. the victim was shot in east oakland on 96th avenue near bancroft avenue last night. he was shot at least once, possibly in the head. they described the person's condition as grave. neighbors reported hearing about 20 shots fired and police are asking any within koss tom forward. so far no news on any possible suspects. >> one thing after another for the family of a 13-year-old girl on life support. this morning a new facility is offering to take jahi mcmath but the question remains who will perform the medical procedures needed to move her 678 we have the latest from children's hospital. >> the fight to keep jahi mcmath on a ventilator led to

a with war of words. the family wants to move jahi to another facility for long-term care. >> if they want to move the body of this individual, we will do everything in our power as long as it's legally and medically correct to help them. >> but the hospital said certain requirements need to be met before jahi can be moved. >> one is that they have a physician who will perform the surgery necessary to transfer the body. secondarily, that the body be transferred, and thirdly, that there is a licensed legitimate place that will take a a a -- a deceased person on a ventilator. >> it requires a tracheotomy and a feeding tube to be inserted before the move. time is running out. the order expires monday at 5:00 p.m.

jahi's uncle isn't giving up. >> we have to go to court and buy time. we have to do it by any means necessary. >> dolan plans to be back in court monday to file an extension and fill a claim in federal court. >> the hospital is saying we are going to decide what is happening to jahi, not you, even if it kills her. >> dolan said that's a violation of the family's constitutional rights. ama daetz, abc7 news. a. c. transit ion workers have ratified a third labor contract. this is the third tentative agreement they have voted on in the past few months. you might recall governor brown called for a 60-day cooling often period that prevented a possible strike. that time ends tomorrow. it includes a 9.5% wage increase over the next three years. employees will also have to make a flat monthly contribution of $125 to their healthcare costs. california desperately in need of more rain. and the state is now on track

for one of the driest years on record. reservoirs are alarmingly low and farmers are starting to worry. should you? here's abc7 news reporter alan wang. [horn honking] >> that's the dinner belfour tim's cattle herd. he's been feeding them hay every other day because the drought has left his pastures barren. >> we are looking at nothing. normally he has 305 inches of grass provided free my mother nature. >> we feeding $500 to $600 every day for the feed. >> at that cost cattle ranchers are selling off large portion of their heard. we could see prices drop early on but then as they reagree their herds pockets could skyrocket. people in some areas are being ordered to cutback on water

usage and many other reservoirs below 40%. >> people in particular in agriculture, they are the ones with the biggest concern because they rely on basic rain up front. >> right now hetch hetchy reservoir that supplies water to san francisco and other parts of the bay is at 70% capacity. >> right now we aren't too worried but we will see what january and february bring. >> for now we have to worry about food prices going up. in the east bay, alan wang, abc7 news. >> the drought could cost palo alto near $5.5 million because the city would have to buy energy to make up for the lost hydroit electric power. palo alto gets half of their electricity from dams but since lake waters is so low, less water is flowing through the generators. that could force the city to look elsewhere for their power needs. >> today is a spare-the-air day in the bay area. it's the 21st alert of the

winter. bay area officials say unless the weather changes this could become the new normal, woodburning would be beened throughout the region. violators face a $100 fine and it's $500 if you are cut a second time. panic has turned to peace for a detroit mother and son who is a heart transplant recipient visiting the bay area for the holidays. >> these people came to the area to perform a concert. the thief got away with their laptops, luggage, musical instruments and medication he's required to take every is it 11 hours to keep him alive. >> i'm thinking, oh, man, this is bad because it's medicine that i don't know if it's easy to get because i get it from a mail-in pharmacy. it's critical stuff, so i'm terrified. >> shawn had an enlarged heart

and got a transplant three years ago at the age of 20. the medication keeps his body from rejecting the new organ. a local hospital give him an emergency dose and a prescription to last him while he and his mother record third new song. more than 1 million americans will lose their unemployment benefits today when the government -- federal government's emergency compensation expires. they have proposed extending the benefits another three months and president obama plans to push congress to do so when it returns next month. they said the abrupt cutoff of cash assistance will hurt economic growth and jobs. >> this morning bizarre new details about a san francisco killing that happened earlier this month. police have arrest add 16-year-old in connection with the murder and attempted robbery that happened on december 14th. investigators say a group of men tried to hold up a person with a cell phone. victim complied. but police say one of the

robbers shot at him anyway. well, the bullet grazed the victim's face but hit an accomplice, killing him. police identified 16-year-old clifton chapman as the dead robbery suspect. the other victim is okay. police believe this man is one of two people responsible for robbing a woman back in august. they took her cell phone is a necklace. police say the victim used the cell phone to take this sellfy after exit committing the crime, not realizing the photo would be uploaded to the internet through the cloud. a group of patients in southern california is fighting parkinson's disease in part by fating each other. it's an innovative program that incorporates boxes as part of their physical therapy. a before c7 news health and science reporter carolyn johnson has the story.

>> reporter: since dolores took up boxes four months ago, the 9-year-old has noticed big changes. >> i'm not so stooped over, my back is straight again and i'm walking with a better swing and my balance is a lot better. >> she was diagnosed with parkinson's disease a year ago. she credits the program, lock steady boxes, for slowing the progression of the disease. the symptoms often include shaking and slowness of movement. twice a week she and others who share the same challenge work out for 90 minutes at a gym in southern california. >> their agility, their balance, all of this is just so much more improved. >> no one gets hit in this boxing program. ann adams brought it here from indianapolis after seeing how it helped her own father who has parkinson's and got better. >> i watched him get better, dancing around in class. >> research shows it's not just boxes but traditional forms of

smartphone earbuds that can prevent them from hearing approaching cars. a u. c. berkeley grad has become the first person to die in an avalanche this season. michael was an avid skier and recently moved to jackson hole from san francisco. he was skiing in the back country when his trip turned fatal. >> it's a risky take to live life. it's the risky take to feel life and that's what it was. >> billy shared a ski house with him in squaw valley a couple years ago. he said michael had a strong sense of adventure but always took the proper pro cautions when skiing. >> he was with a group of very experienced people and they did most of the right things, but you can never be too careful. >> he was said to have all the safety gear, a beacon, probe and shovel when his friends found him buried in the snow just

outside the boundaries of the jackson hole resource. a dock store in the area attempted to revive him but he was pronounced dead t appears he was the first in a group of five people to head down the slope and trigger the avalanche. the brother arrived in jackson. the two grew up in the bay -- in the area but grew went to college in bay area. >> they were able to find him quickly but they weren't able to revive him. >> michael was only 29 years old who left san francisco to spend the winter in wyoming. he was president of the example ski team. his family released a statement saying mike lived life with a full heart. he loved his buddies, his skiing buddies in san francisco and the cal bears. >> mike lived his life with a lot of love to people around him, and they did for him as well. >> the avalanche was set to have a 40-inch slide depth.

it's also been described as a slab slide avalanche, which according to experts, tend to break at your feet. abc7 news. >> a body found in mccovey cove last month has been identified. police kay the body is that of a 22-year-old man of brazil. he called family and friends on october 28th saying he was in trouble and needed the police. his sister came to san francisco to look for him. it took until now to identify his badly decomposed body. >> shipping giants ups and fedex are still reeling from the overhaul holiday rush that delayed the delivery of packages. both companies apologized and said bad weather and a surge in shipping were the problems. ups admits some customers are entitled to refunds, but at least one lawmaker wants all shipping fees refunded. amazon and wal-mart are offering gift cards to affected customers and kohl's is paying for

up a few high clouds off the coast. elsewhere pretty clear right now. here's a beautiful look from the exploratorium towards the embarcadero buildings and the holiday lights still on. it is currently 47 in san francisco. one of the milder spots. a lot of 30s out there as well. 37 in san jose, los gatos and in half moon bay. cool conditions prevail in some of the inland locations from mt. tam you see more of the clear skies. a great view of the bay bridge and san francisco there. so only 26 in santa rosa. fairfield 28 and in livermore it's 35 degrees. as we enjoy another live shot from sutro looking down toward san francisco, we also can expect very chilly conditions this morning. so a clear start. it is another spare the air day today. the sixth in a row, as katie mentioned. dry and mild weather all the way into the new year. so we have a pattern that holds

steady through the week. and here's what i can show you the pacific satellite image. the trough continues to move east and that brought us the high clouds yesterday in slightly cooler numbers but fortunately no rain. high pressure building over the pacific. this will be the dominant feature for the rest of the week and with a slight offshore flow we will see numbers climb up a few degrees and then stay above average throughout the week. the forecast onmation shows basically sunny conditions all through sunday. and also you can look for some breezy conditions tonight. and highs today will be mainly in the 60s for everyone. low 60s along the coast. 63 in half moon bay and in san francisco. some mid-60s around the bay with 65 in oakland and in san jose. look for a few upper 60s. you will find 66 in fairfield and in livermore. now i also wanted to show you how dry we are. so this is percent of normal season to date. we start measuring rainfall

>> consumer attorneys say it is incumbent upon shoppers to modify their billing statements and report suspicious transactions. >> there's word this morning of a potential security flaw with the popular photo sharing website snap chat. a coding error could allow a hacker to get phone numbers and names without your permission. doesn't sound like a big deal, but in a short amount of time they could collect millions of names and put them together and sell it to a bidder. it was reported to snapshot in august but the problem has apparently not been addressed. as much as 50 million people use the snap chat app. >> there is curbside christmas tree recycling. areas served by greenway recovery can put undecorated christmas trees out with their recycling bin. trees should be cut into three food sections for curbside

pickup. they will send them through wood chippers or they will be used for biofuel to generate electricity. there are special recycling bins located at many fire stations throughout the county. >> paying your credit card bill on time is the surest twice avoid fees, right? or is it? >> a san francisco woman paid on time and still got socked with bank fees. her bank admitted it was a mistake but her account went to collections. no one could help her until 7 on your side's michael finney stepped in. >> all margaret bruno within today do was pay off her credit card bill to avoid any more fees. >> i was out of work at the time, looking for a job. it was very frustrating time for me. a very scary time. >> her bank sent automatic payments to her credit card account every month for two years. her debt was down to just $137 when, suddenly, margaret noticed a late fine her credit card

bill. she called hsbc right away. >> i was charged a late fee but he wasn't paid, i paid and i paid through my bank. >> hsbc said she would have to send proof. took a week to obtain the check. they reversed the late fee and everything seem fine except it happened again. >> they said they didn't receive my payment and they would charge me a late fee. >> again they said she was delinquent. again, she sent proof of her payment. hsbc reversed the late fee and once again everything seemed fine until she got the next bill. it had a late fee, too. so did the next bill and the one after that. >> so every month i had to go through a big deal about proving that i paid. and then they would reverse the charges and send me an apology letter. >> still the bank kept recording delinquent payments and soon began calling her cell phone. >> hsbc would be calling me about 15 times a day and when i would straighten it out, they

said sorry, this will take two days. >> finally she paid the last $15 of her debt and called hsbc to close the account. >> they apologized to me and said i had a 0 balance at that point. >> however, and you probably guessed it, her next statement said no payment was received, and she owed a $30 late fee. >> but i gave up at that point. i just had to have a positive attitude about looking for a job. i couldn't go through this anymore. >> she at mitz she was see exasperated she didn't dispute the bill. late charges piled up and the final blow hscb sold her account to a debt purchaser, which tried to collect $103 on her account. she tried to explain she didn't owe this money. >> but they weren't nice and they didn't believe me at all. >> the unpaid debt glares on her credit report. she said it blocked her from buying a car. >> so i'm like i'm calling channel 7, michael finney. >> and we got to work point being out to hsbc that margaret

apparently didn't owe a debt. the bank quickly unraffled her bank and agreed to clear it. they prevent from disclosing details but a spokesperson said by phone we made sure this matter is not going to have a credit worthiness impact. we have also reached out to the debt collection company that purchase the debt and we are work to go resolve that debt and bring the whole matter to a close. >> i'm just very happy this, you know, i'm looking at this file and someone is helping me. >> hsbc told margaret the problem began because another customer had a similar name and account number so her payments were routed to the wrong account. one way to avoid this, put your full account number on your checks when you make a payment. i'm michael finney, 7 on your side. a young man in las vegas was all smiles when he discovered a new ipad box under the

it's 5:47 on your saturday morning. we are lucky to have francis with us. a holiday treat. >> we can certainly use rain. we will see a lot of sunshine and it's a treat for me to be here, too. let's go to live doppler 7hd. looking around the bay area and showing us quiet conditions. a few high clouds over the coast, but that will clear very quickly. so we will get some scattered, hazy sunshine this afternoon. the haziness due to the poor air quality. i'll get to that in a minute. here's a live view from our roof camera. we look at the beautiful bay lights on the bay bridge. traffic has been a mess there all week. keep that in mind if you are headed toward the embarcadero. it's 47 in san francisco, 41 oakland and 35 in redwood city. but check out some of these chilly numbers as we look live from sutro tower cam. the clear skies allow us to lose a lot of heat overnight.

so with the radiational cooling, we are seeing numbers in the 20s. currently 26 in isn't rosa. 28 in napa. and look for 30 degrees in novato. so here's the weather story as we look toward sfo. you see fairly clear conditions. some haziness out there. don't expect too many weather delays due to the weather. and we've got the clear and chilly start this morning. plenty of sunshine later on today. spare the air once again. dry and mild all the way into the new year. doesn't look like we will serin until possibly the second week of january. so we are hoping for that. look at this other view from emeryville out toward the bay bridge. nor clear conditions out there. with the spare the air alert, no woodburning. the north by will see the poorest air quality. it is the sixth consecutive day and we've had 21 alerts since november 1st. here's why we can expect

possibly some more spare the air days in the near future. we have this area of low pressure that continues to move east. this brought us the cooler conditionings and high clouds yesterday but we still didn't see any rain. high pressure over the pacific is rebuilding. that's going to stick around all weekend. and with high pressure we have sinking air, a slight offshore flow. this allows for the stagnate air to pool, possibly more spare the air days. as we look at the forecast animation, shows the clouds clearing quickly. we could see breezy conditions overnight but sunshine returns today and will stick around throughout the week. so you can expect a lot of dry weather. temperatures in the 60s, above average. look for average high 63 san francisco, 65 san jose and 64 in concord. and here's a look at temperatures around the state where it's dry, as well. you can kind. see a little offshore flow. 47 degrees in tahoe with a lost sunshine, not much so. but there is dancing out there, as katie mentioned in another story. mild in southern california.
