seven-day forecast coming up. i'm looking for rain. katie. >> all right. aren't we all. thank you, francis. we start with developing news in oakland. a shooting victim has died. the victim was shot in east oakland on 96th avenue near bancroft avenue last night. he was shot at least once, possibly in the head. he died this morning. neighbors reported hearing about 20 shots fired. police have not released any information on a possible suspect or suspects, but we know a reward is being offered for information. >> it is one development after another for the family of a 13-year-old girl on life support. this morning a new facility is offering to take jahi mcmath but the question remains who will perform the medical procedures needed to move her. abc7 news anchor ama daetz has the latest from children's hospital. >> he's a professional. >> reporter: the fight to keep jahi

mcmath on a ventilator led to a with war of words. that was between the hospital spokesman and the mcmath family attorney, mr. dolan. the family wants to move jahi to another facility for long-term care. >> if they want to move the body of this individual, we will do everything in our power as long as it's legally and medically correct to help them. >> but the hospital said certain requirements need to be met before jahi can be moved. >> one is that they have a physician who will perform the surgery necessary to transfer the body. secondarily, that the body be transferred, and thirdly, that there is a licensed legitimate place that will take a deceased person on a ventilator. >> dolan said a facility in southern california may be willing to take jahi and has spoken to children's hospital. but the facility requires a tracheotomy and a feeding tube inserted first to make the transfer possible. time is running out. the order expires monday at 5:00 p.m.

jahi's uncle isn't giving up. >> we have to go to court and buy time. we have to do it by any means necessary. >> dolan plans to be back in court monday to file an extension and file a complaint in federal court. >> what this hospital is doing is telling this family, we are going to decide what is going to happen to jahi, not you, even if it kills her. >> dolan said that's a violation of the family's constitutional rights. ama daetz, abc7 news. a.c. transit union workers have ratified a third labor contract. this is the third tentative agreement bus mechanics, drivers and others have voted on in the last few months. you might recall governor brown called for a 60-day cooling off period that prevented a possible strike. that cooling-off period ends tomorrow. the tentative agreement includes a 9.5% wage increase over the next three years. employees will also have to make a flat monthly contribution of $125 to their healthcare costs. california desperately in need of more rain.

the state is now on track for one of the driest years on record. reservoirs are alarmingly low and farmers are starting to worry. the question is, should you? here's abc7 news reporter alan wang. [horn honking] >> that's the dinner bell for tim's cattle herd. he's been feeding them hay every other day because the drought has left his pastures barren. >> we are looking at nothing. normally he has five to six inches of green grass provided free by mother nature. >> we are feeding $500 to $600 every other day for the feed. that's the hay. >> at that cost cattle ranchers are selling off large portion of their heard. we could see a glut in the market and lower prices early on. but when they are regrowing their herds, prices could skyrocket.

people in some areas are being ordered to cutback on water usage and many other reservoirs below 40%. >> people in particular in agriculture, they are the ones with the biggest concern because they rely on basic rain up front. >> right now hetch hetchy reservoir, which supplies water to san francisco and other parts of the bay, is at 70% capacity. >> right now we aren't too worried, but we will see what january, february and march bring. mandatory restrictions won't be considered, but for now we have to worry about food prices going up. in the east bay, alan wang, abc7 news. >> for the sixth day in a row, today is a spare-the-air day in the area. it's the 21st spare the air alert this winter. air officials say unless weather changes, this could become the new normal. woodburning would be banned throughout the region. violators face a $100 fine. $500 if you are caught a second

time. more than 1 million americans will lose their unemployment benefits today when the federal government's emergency compensation expires. few senators, one democrat, one republican have proposed extending the benefits another three months. president obama plans to push congress to do so when it returns next month. the president said the abrupt cutoff of cash assistance will hurt economic growth and jobs. >> this morning bizarre new details about a killing that happened in san francisco earlier this month. police arrested a 16-year-old in connection with the murder and attempted robbery that happened on november 14th. a group of men tried to hold up a person with a cell phone. the victim complied burks one of the robbers shot him anyway. the bullet only grazed the victim's face and hit an accomplice, killing him. police identified 16-year-old clifton chapman as the dead robbery suspect. the robbery victim was wounded, but is okay.

oakland police are trying to track down a robbery suspect who they say took a picture of himself with a stolen phone. police believe this man is one of two people responsible for robbing a woman back in august when they took her cell phone and necklace. police say the suspect used the cell phone to take this selfie after committing the crime, not realizing the photo would be uploaded to the internet through the cloud. a group of patients in southern california is fighting parkinson's disease in part by fighting each other. it's an innovative program that incorporates boxing as part of their physical therapy. abc7 news health and science reporter carolyn johnson has the story. >> reporter: since dolores took up boxing four months ago, the 79-year-old has noticed big changes. >> i'm not so stooped over, my back is straight again and i'm walking with a better swing and my balance is a lot better. >> she was diagnosed with parkinson's disease a year ago. she credits the program, lock -- rock steady boxing, for the

slowing of the progression of the disease. the symptoms often include shaking and slowness of movement. twice a week she and others who share the same challenge work out for 90 minutes at a gym in southern california. >> their agility, their balance, all of this is just so much more improved. >> no one gets hit in this boxing program. ann adams brought it here from indianapolis after seeing how it helped her own father who has parkinson's and used to use a wheelchair. >> i watched him get better, dancing around in class. very agile. >> research shows it's not just boxing, but traditional forms of exercise such as exercising and aerobic training this can help with balance and mobility but ron said boxing is different from other exercises he's tried. >> the most beneficial type of thing that i found for overall wellness. >> carolyn johnson, abc7 news. those classes in coasta mesa

wheelchair was hit head-on by a car on monterey road near falon avenue. a 50-year-old woman killed while crossing the highway laft month. pedestrian and drivers, police say, both need to focus more on traffic and remove the smartphone earbuds that can prevent them from hearing approaching cars. a u.c. berkeley grad has become the first person to die in an avalanche this season. michael was an avid skier and recently moved to jackson hole wyoming from san francisco. as lilian kim explains, he was skiing in the back country when his trip turned fatal. >> it's a risky take to live life. it's the risky take to feel life and that's what it was. >> billy shared a ski house with mike in squaw valley a couple years ago. he said michael had a strong sense of adventure but always took the proper safety precautions when skiing. he is very experienced in the

back country, he was with a group of very experienced people. they did most of the right things, but you can never be too careful. >> he was said to have all the safety gear, a beacon, probe and shovel when his friends found him buried in the snow just outside the boundaries of the jackson hole resort. a doctor in the area attempted to revive him but he was pronounced dead. it appears he was the first in a group of five people to head down the slope and trigger the avalanche. the brother arrived in jackson. the two grew newspaper orange county but both moved to the bay area for college. >> it is my understanding they were able to find him with shovels and whatnot quickly, but unfortunately they weren't able to revive him. >> michael was only 29 years old who left san francisco to spend the winter in wyoming. the cal grad majored in economics and public policy and was president of the cal ski team. his family released a statement saying mike lived life with a full heart. he loved his families, cal

bears, his skiing buddies in san francisco. >> that's been the big take away from this. mike lived his life with a lot of love to people around him, and they did for him as well. >> the avalanche was set to have a 40-inch slide depth. it's also been described as a south slab avalanche, which according to experts, tend to break at your feet. abc7 news. >> a body found in mccovey cove has been identified. it's that of 22-year-old man of brazil. he called family and friends on october 28th and said he was in trouble and needed police. his sister came to san francisco 20 lack for him. it took until now to identify his badly decomposed body. >> shipping giants ups and fedex are still reeling from the holiday rush that delayed delivery of packages. both companies have apologized said bad weather and a surge in online shopping were behind the problem. neither company released numbers but it's estimated thousands of people were affected. ups admits some customers are

entitled to refunds. but at least one lawmaker wants all shipping fees refunded. amazon and wal-mart are offering gift cards to affected customers and kohl's is paying for undelivered items. two bay area high school marching bands will be ringing in the new year across the pond. oak grove and pitsburg marching bands will be participating. the pittsburgh band boarded their flight yesterday bound for england. >> it's a big deal not only for what our accomplishments are but for these kids. most have never been on an airplane and their first plane ride will be international to london. >> oak grove marching band members from san jose will be also leaving for the u. k. soon. london's parade draws hundreds of thousands of spectators and millions of tv viewers.

>> as people make year-end donations to charity. the bay area humane society hopes they won't overlook donations for pets. they can make donations at the lobby and donations bins are also set up at five express food place throughout the county. the year end drive ends tuesday. some starbucks customers have been showing their holiday cheers. drive through customers at this connecticut starbucks has been paying it forward and then some. so far more than 1,000 people have paid for the person behind them. it's not just on the east coast in nevada 73 customers in a row paid it forward. and in north carolina one woman posted her starbucks gift card on facebook urging people to use it, but instead something else happened.

this week. no clouds at all. temperatures will be in the upper 40s later on today. back here in the bay area, live doppler 7hd, we are picking up quiet condition. just some extra clouds off the coast that will clear very quickly later on this morning. and we will show you a live shot from our sutro tower camera lacking down toward san francisco. you see blue skies and some of the haze already there lingering right around the bay. it's currently 47 in san francisco. 41 in oakland. 37 in san jose. so we are definitely seeing some chilly numbers this morning, especially in some of the interior locations. looking from the kgo roof camera, very light wind right now over san francisco. and much of the bay. we take a look at the chilly numbers. santa rosa, the coolest spot. there's been some fog that's developed overnight. it's come and gone. hazy conditions in livermore,

currently at 34 degrees. here's what you can expect for today. a lot of sunshine, as we look from the east bay hills toward san francisco. clear and chilly, though, for the morning and it's another spare the air day today. no woodburning. dry and mild all way into the new year. doesn't look like we will see rain soon. the satellite image over the last twelve hours shows the area of low pressure moving east yesterday, as it passed through the cold front, it brought us high clouds but no rain at all. an area of high pressure will continue to rebuild. this will be the dominant feet and you are it will stick around all week bringing us plenty of sunshine and temperatures above average all way into next weekend. the forecast model shows the clouds gone all the way into sunday. so sunshine returns and sticks around. here's a look at high temperatures today. namely in the 60s. a few degrees warmer compared to frye. 63 in san francisco. 64 in san rafael. 65 in san jose, and also in

the inland areas. the by near mid-60s with hazy sunshine due to the poor air quality. along the coast, that's where we will see sunshine, as well. temperatures in the low 60s. i'll have the complete accuweather seven take forecast, including the new year's eve forecast, come up. katie. >> sounds good. thank you, francis. new worries this morning for millions of target customers. just when people thought it was safe to use their debit and and credit cards again at a target, the retailer comes out with bad news, pin numbers were stolen, too. nine days ago target said the issue was identified and resolved, but yesterday the store revealed that strongly encrypted pin data was removed consumers are nervous. we talk about it before we came even. >> how did you pay for your transaction tonight? >> i used my debit card and cash. >> we have very good consumer protection laws that protect consumers from paying for unauthorized purse.

but if you don't notice them, you will end up paying for them. >> you are to report suspicious transaction after monitoring your credit report. >> there's word this morning of a potential security flaw with the popular photo sharing website snapchat. a coding error could allow a hacker to get phone numbers and names without your permission. doesn't sound like a big deal, but in a short amount of time they could collect millions of names and put them together and sell it to a bidder. the security that found the weakness, gibson security, said it reported it to snapshot in august, but the problem has apparently not been addressed. as many as 50 million people use the app. santa cruz residents can take advantage of curbside christmas tree recycling. areas served by greenway recovery can put undecorated christmas trees out with their recycling bin. trees should be cut into

three-foot sections for curbside pickup. they will send them through wood chippers or they will be used for biofuel to generate electricity. residents in other parts of the county can bring their trees to special ecycling bins located at many fire stations throughout the county. >> paying your credit card bill on time is the surest twice avoid fees, right? >> a san francisco woman paid on time and still got socked with bank fees. her bank admitted it was a mistake, but her account went to collections. no one could help her until 7 on your side's michael finney stepped in. >> all margaret bruno wanted to do was pay off her credit card bill to avoid any more fees. >> i was out of work at the time, looking for a job. it was very frustrating time for me. a very scary time. >> her bank sent automatic payments to her hsbc credit card account every month for two years. her debt was down to just $137 when, suddenly, margaret noticed a late fee on her credit card bill. she called hsbc right away. >> i was charged a late fee but

i wasn't late, i paid, and i paid through my bank. >> hsbc said she would have to send proof. it took a week to obtain the check. they reversed the late fee and everything seemed fine except it happened again. >> they said they didn't receive my payment and they would charge me a late fee. >> again hsbc said she was delinquent. again, she sent proof of her payment. hsbc reversed the late fee and once again everything seemed fine until she got the next bill. it had a late fee, too. so did the next bill and the one after that. >> so every month i had to go through a big deal about proving that i paid. and then they would reverse the charges and send me an apology letter. >> still the bank kept recording delinquent payments and soon began calling her cell phone. >> hsbc would be calling me about 15 times a day and when i would straighten it out, they said sorry, this will take two days. >> finally she paid the last $15

of her debt and called hsbc to close the account. >> they apologized to me and said i had a zero balance at that point. >> however, and you probably guessed it, her next statement said no payment was received, and she owed a $30 late fee. >> but i gave up at that point. i just had to have a positive attitude about looking for a job. i couldn't go through this anymore. >> she admits she was so exasperated she didn't dispute the bill. late charges piled up and the final blow, hscb sold her account to a debt purchaser, which tried to collect $103 on her account. she tried to explain she didn't owe this money. >> but they weren't nice and they didn't believe me at all. >> the unpaid debt glares on her credit report. she said it blocked her from buying a car. >> so i'm like, i'm calling channel 7, michael finney. >> and we got to work point out to hsbc that margaret apparently didn't owe a debt.

the bank has now sold hsbc quickly unraveled her bank, and agreed to clear it. they said privacy rules prevent them from disclosing details, but a spokesperson said by phone we made sure this matter is not going to have a credit worthiness impact. we have also reached out to the debt collection company that purchased the debt and we are work to go resolve that debt and bring the whole matter to a close. >> i'm just very happy this, you know, i'm looking at this file and someone is helping me. >> hsbc told margaret the problem began because another customer had a similar name and account number so her payments were routed to the wrong account. one way to avoid this, put your full account number on your checks when you make a payment. i'm michael finney, 7 on your side. a young man in las vegas was all smiles when he discovered a new ipad box under the christmas tree, but when he

opened it he found the box was stuffed with paper. her mom bought the device for her son at walmart for $300. she took it back to the store and finally the store realized customers in other states were finding the same thing. they exchanged the box for a real ipad and told customers to be aware of the scam. they said open the box before you make the purchase. >> if you got a new tablet or ipad this christmas, you will probably spin time downloading apps. here's one idea to keep you connected all year long. >> if you have been really good this year, santa might leave you one of these under your tree, ipad, ipad mini, and even an i-phone would be a welcome site. >> if the traffic at this apple store in san francisco is any indication, a lot of people will get one of the three. what are you going do with your new device? i have an idea. >> download the latest abc7 news app and get the latest headlines

elevationing from the treetop on the bottom. hazy sunshine later on this afternoon. check out how cold it is in santa rosa at 25 degrees. fog has developed in the overnight hours. there has been patchy fog in some areas. napa also pretty cool at 27. fairfield 29. and livermore hazy at 34 degrees. as we look toward san francisco from the east bay, we see lots of blue out there. so we have a clear and chilly start for your saturday. it's another spare the air day today. dry and mild weather. that brings us all the way into 2014. a look from emeryville out toward the golden gate bridge. you see the haze. we have the spare the air day in effect. we've got poor air quality in parts of the north bay, and medium air quality for the rest of the bay area. this is actually the sixth consecutive day, and it's the 21st alert since november 1st. so definitely no wad burning. looks like tomorrow we will see another spare the air day, as well. here's why.

with the pacific satellite image we can show you the area of low pressure. yesterday we had some high clouds, but no rain. now as that moves east we have high pressure building over the pacific. this is going to set itself up to stick around all week. it's rebuilding. we will see a slight offshore flow. sunny conditions and slightly above average temperatures. the forecast model shows those clouds quickly clearing. then we've got clear conditions all the way into tommy. sunshine returns and it stays with us into new year's eve, as well. highs today in the 60s for the most part. 63 in san francisco. so warmer by a few degrees. san jose 65. 64 concord and 65 oakland. if you are head today the game tomorrow, the raiders game, as they take on the broncos, 1:25. temperatures near the 61, 62-degree mark. very mild and sunny. you will still need sun glasses and a light jacket.
