out of work and now out of time. unemployment benefits expire today for more than a million americans. good evening, ama daetz. the expended unemployment checks have now stopped. benefits rap out today for 1.3 million americans. that number includes 213,000 california residents. the payments stop at a time enwho's' u.s. long term unemployment reached its highest since world war ii. here's a look what the end of

the benefits means for those who receive them. >> i'm in a panic. i don't know what i'm going to. >> kathy is one of about 1.3 million americans facing the end of jobless benefits. congress did not extend the emergency program so for most people around the country, after hey received 26 weeks of payments, the money runs out, she size this will hurt. >> i have bills to pay and no way to pay them. >> an economist says this will mean important choices for people out of work. >> likely to force many of them to take jobs they otherwise wouldn't take. either parttime jobs or lower paying jobs. >> some republicans prefer limiting benefits to just 26 weeks, saying a continue situation is a disservice to workers. the white house is pushing congress extend the long-term benefits. most democrats want a year, but for this newly employed mom getting back some benefits would

help. >> give me a chance to have some type of income coming in. >> meanwhile, sarah of the pennsylvania department of labor and industry says employers tend to increase hiring after the first of the year. >> overall we see positive signs of the economy, and not only employers hiring but job seekers finding jobs. >> the first final for congress to up extending the unemployment benefits is january 7th. >> for the unemployed here in california, they will receive 26 weeks of benefits, but will no longer get the additional 37 weeks of unemployment under the federal program. >> we're learning new details about a contract ratified by ac transit unor workers that includes a 9.5% wage increase phased in over three years. employees will pay a monthly flat fee of $120 for healthcare. this is the third tentative agreement voted on.

the contract must now be prude by the board of directors. now to developing news. an oakland family says it now has two options for long-term care of a 13-year-old girl declared brain dead after complications from a tonsillectomy. the court order keeping jahi mcmath on a ventilator at children's hospital oakland will expire monday at 5:00. her family says a facility in southern california and new york hayes offered to take jahi but only have she has a feeding tube inserted. the hospital says the family has to provide their own doctor for that in a statement the family says, quote, we hope that by this time tomorrow we'll have the past towards jahi's removal in the last hour we heard from the hospital. >> first they said they had insurance. now they don't have insurance, started a crowd source funding effort. first they had a facility in the bay area, then that fell through. enough they have another

facility in southern california. >> the fundraising effort has raised $3,000. they hope to bring in 20,000. sergioin -- sergio quintana has been following the story. >> oakland police are investigating a man who was killed hosting a friend's birthday party. frederick parker was kill when he left the party to have a cigarette. the shooting happened at 11:00 in east oakland outside parker's apartment. neighbors report hearing about 20 shots fired and police say other people may have been with parker when the shooting happened. would burning is banned tonight as the bay area is under its sixth straight "spare the air" day. officials declared another "spare the air" day tomorrow. this is a live look outside from our emeryville camera. all the particles in the air make for this unbelievably pretty sunsets, but poor air quality, the 21st alerts this

winter. bay area air quality officials say unless the weather changes this could become the new normal. our meteorologist has the details. >> certainly is pretty, and we need a little wind, new air mass, and we have to have a -- we do have a wind advisory, red-flag warning for tonight, into tomorrow. but yet another "spare the air" day tomorrow, with poor air quality tomorrow, and it is the 22nd alert since november 1st. the most we have had for any winter season is 30. that was in 2006-2007. the winds are kicking up above 1,000 feet. we'll talk about the dry fuel, the gusty wind and when and if we'll see rain. a san francisco police officer says she was just doing the right thing when she bought a pair of shoes for a homeless woman on the street who didn't have any.

jackie sellinger's son mosted this photo on our facebook page along with a reminder about how giving should not end after the holidays. cornell bernard caught up with the police officer and is live with a story you'll see only on abc7 news. reporter: jackie sellinger was on duty in union square when she made a purchase for a person in need. homeless people are sometimes overlooked during the holidays but not by san francisco police officer jackie sellinger who recently spotted a homeless woman sitting in front of this shoe store. >> she was holding a sign that she needed shoes. i looked down at her feet and could see she had some really flimsy looking slippers on. >> the woman told the officer homeless shelters, which donate shoes, never have anything that fits her, a size 12. >> i just thought about my family, and the fact that we have so much.

>> so this cop offered to buy the woman something she needed. >> she says to me, i'll take anything. she goes, we can walk down to the -- she felt like it was a little expensive at sketcher's. she said we can walk down to payless. she was a really humble lady. >> we learned about the story when the officers son took pictures of the impromptu shopping trip and posted them on our facebook page. >> she had already done and it was completely her decision. there was no one watching her, and i admire my mom. >> store manager says the woman chose this all-weather would for $69. the kind gesture prompted him to help out, too. >> i offered my employee discount for the officer to purchase the shoes. >> why did you do that? >> holiday season. i did feel bad for the lady that was in front of the store. >> i didn't really get her name. i didn't want to embarrass her.

we have the spare the air, and we have that this evening. temperatures are beginning to tumble out of the 60s and to the upper 50s. san jose, 59. san francisco. average highs this time of year in oakland should be 55. so you hit 65 today. so certainly a warm, warm day out there for standards here in december. and for mt. tam, we are looking at temperatures in the low to mid-60s to really a nice and mild afternoon with 52 right now in novato, and 58 in livermore. a look at east bay right now, it is certainly nice out there. still with a lot of nice weather to enjoy. red-flag warning in effect for the hills above a thousand feet, and with that we'll look for those gusty northeast winds, in fact wind gusts over 30-miles-an-hour and dry, mild weather to start 2014, so

mt. diablo and mt. tam, winds that will continue to be a problem. low relative humidity. in fact the relative humidity around livermore, 19%. so, certainly dry out there. you add in that wind, we are looking at some of the gusts at the higher elevations up to 21-miles-an-hour, atlas peak, 21-miles-an-hour, and calaveras road, gusty winds. so lasting through tonight, and overnight lows with a little wind allowing for temperatures maybe two to three degrees warmer. near freezing tonight around the delta. 39 in san rafael. half moon bay, 46. so high pressure building in behind the weak lee that passed to the north yesterday, brought the cloud cover, and now with that, they high close to the low. the pressure gradients tighten and we're getting the wind. so that means high fire danger and relative humidity not recovering much, and with the above normal temperatures tomorrow, as much as ten degrees
