13-year-old girl who appears brain dead. and the kindness of strangers. what one police officer did to make a difference.

she is not dead. >> new hope for the oakland girl declared brain dead by doctors. they now say they have new options of where to move her. good evening and thank you for joining us. i'm ama dates. she was declared brain dead after complications from a tonsilectomy and now the clock is ticking. according to a court order children's hospital oakland can remove her from the ventilator on monday. we go now live to oakland with the story. sergio? >> ama, the family is desperately trying to avoid the monday 5:00 p.m. deadline. they say they will even go to court to try to extend it. they say also this evening they have been working phones

all day long and trying to lineup a facility so they can take her out of the hospital and they are trying to find a way to pay for it all. >> her family is trying to lineup a facility that will keep her on life support. her mother is telling abc news that she still has faith her daughter will recover. >> she's alive to me. she's not dead. >> her family is trying to move her out of children's hospital oakland before a court order expires on monday at 5:00 p.m. they released an extended written statement that reads in part, our attorney is in discussions with two facilities that expressed approval for accepting her on a ventilator. one is in california and one is in new york. sam singer says they will cooperate with moving her under three conditions. >> first is a physician to perform the medical procedures necessary, second the transportation and third a legitimate facility that will take her. >> singer raised serious questions about the family's

ability to meet those conditions. >> first they said they had insurance and now they don't have insurance and started a crowd source funding effort. first they had a facility in the bay area and then they said it fell through. >> children's hospital has not received information from the family or their attorney about any facility willing to receive her. in oakland, abc7 news. >> the family has a fundraiser set for tomorrow and have launched a crowd sourcing page to raise money as was mentioned in sergio's story. they plan to use the money to move her to a new facility. so far they raised more than $4,000. new at 11:00, san francisco police are investigating a shooting in the bay view district. officers found a 21-year-old man suffering from a gunshot wound at 7:30. he was taken to san francisco general for treatment. a big crackdown is underway in search of drunk drivers. police say one of those

arrested for driving drunk was this man, 63-year-old sam mckee. he was arrested for his fifth dui in the last 10 years. a sonoma county judge issued a warrant after he failed to show up for court 0 christmas eve. authorities rescued him. checkpoint are set up all across the bay area as part of a maximum enforcement effort. police agencies around the state are taking part to get the number of drunk drivers off the roads before they cause trouble. >> if you believe you have been drinking don't drink and drive. call a friend. there is a lot of services out there that can be contacted and will pick you up. call a taxi service. just call somebody. don't drive drunk. it is not worth it of the -- worth it. >> 338dui arrests have been made this month in santa clara county. for the seventh day in a row there is another spare the air day in the bay area. that means the burning of wood or other solid fuels are banned for the next 24 hours.

the prolonged dry weather is causing levels of pollution in the bay area. however, it does make for beautiful sunsets. let's head to abc7 news meteorologist lisa argen who is in for leigh glaser. >> hi, ama. we are looking at the stagnant air mass over the bay area as the high pressure continues to be parked over the region. in fact, we will see a couple degrees of warming tomorrow. so we are looking at the seventh consecutive day and the 22nd alert since november 1st. the record is 30 days for the winter season in 2006 and 2007. and tomorrow the santa clara valley will have the hazest conditions. we are looking at another advisory, offshore winds. it is keeping some of the temperatures up today, and we will look for increasing temperatures and low relative humidity with the dry fuels and the gusts up to theater 5 miles an hour. we will detail this and look at our seven-day outlook coming up. ama? >> thank you so much, lisa.

the lack of rain this year is just as bad in southern california. this will be the driest year for los angeles since 1877 when official measurements began. rainfall for the entire year in l.a. is just over 3.5 inches. it is a different story in other parts of the country where people are bracing for bitter cold temperatures. six states from montana to minnesota are under windchill advisories. the temperatures there could plummet below freezing. we will have more on the extreme weather later this hour. tonight more than 200,000 long-term out of work californians are finding themselves in a deeper financial hole. the emergency program that provides federal unemployment benefits after state health is exhausted has ended. altogether 1.5 million jobless americans are finding themselves starting the new year without financial assistance. and that means the need is going to be higher especially for non profits already struggling this time of year. abc7 news reporter lisa amin gulezian joins us to explain.

lisa? >> one nonprofit expects a 75% drop in dough mageses in a few weeks. at the same time the pool of people they help could double. now that unemployment benefits for so many have ended. >> the total budget is 10 million. >> lisa cheryl works hard for the contra costa and solano county food bank. the e-mail blast will go out tomorrow. it is a last-minute end of year push to get donations. >> immediately after december ends, the donations do start to decrease. >> at this food bank $2 million was added just this month. but outside of the holiday season, $600,000 comes in. that's more than a 70% difference. they are bracing for an additional search in clients. >> now more people are looking for help as well once their unemployment benefits end.

there will be more people looking for assistance. >> more than a million american benefits will cutoff tonight. lawmakers left washington without voting on an extension. >> i am in a panic. i don't know what i will do. >> she has been unemployed for 26 weeks. that's the new limit for unemployment benefits starting tomorrow. democrats are pushing for a three-month extension. >> we don't abandon each other when times are tough. >> others argue the program is tooence expensive. it is costing $25 billion a year and the people are simply becoming too dependent on the system. >> when you extend benefits to 73 weeks or nip 9 weeks it encourages some people to stay unemployed too long. >> congress won't consider extending unemployment benefits at least until january 7th. lisa amin gulezian, abc7 news. >> a number of new state laws

will hit the books in the coming days. teenage drivers will be banned even if using a hands frida vice. in the new year california is the first state to stop wildlife from injecting metals and new laws will take place including restrictions on the ability of mentally ill people to have guns and safety tests for shotgun and rifle owners. also starting january 1st, openly gay youths will be accepted as members of the boy scouts. it follows a contentious vote that reversed a long-standing ban. after months of disagreement, ac transit workers ratified a labor deal. the new contract includes a wage increase of 9.5% over the next three years. workers will have to make a $1 twenty monthly contribution for health care. the ac transit board of directors is expected to vote on the contract in early january. a joyful homecoming for a salinas mother who gave birth to a premature baby boy.

baby jaden was not supposed to arrive until christmas day, but instead arrived on august 27th. doctors were not sure he would survive, but after being transferred to the hospital at stanford, baby jaden thrived gaining several pounds. still to come on abc7 news at 11:00, a random act of kindness. what a san francisco police officer did to help a woman in need. plus a good deed done and now someone is a million dollars richer. we'll tell you why. and later, is facebook over? th

officer says she was just doing the right thing when she bought a pair of shoes for a homeless woman who didn't have any. her son posted this photo on our facebook page along with a reminder that giving shouldn't end after the holidays. cornell bernard has the story you will see only on abc7. >> sometimes homeless are over looked during the holidays, but not by jackie sellinger who spotted a homeless woman in front of this sketchers shoe store. >> she is holding a sign.

i looked at her feet and she has some really slim feet and putting slippers on. >> the woman told the officer homeless shelters that donate shoes never have anything that fits her, a size 12. >> we just have so much. >> she offered to by something she needed. >> she said i will take anything. >> we can walk down to the -- she felt like it was a little expensive at sketchers so she said we can walk down to the pay less store. i could see she was a really humble lady. >> we learned of the story when officer se llger's son secretly took these pictures of the i'm prom tee trip -- i'm impromptu trip and posted them on the page. >> she had done it and it was her decision and there was no one watching her. i admire my mom for that. >> the store manager said the woman chose this all weather boot for $69.

the kind gesture prompted him to help out too. >> i offered my employee discount for the officer to purchase the shoes. >> you didn't have to do that. why did you do it? >> i did feel bad for the lady in front of the store. >> i didn't get her name. i didn't want to embarrass her. >> the woman's reaction to the gift was all this officer needed. >> it was in her man riches -- man riches that she was grateful. that was better than a thank you in my eyes. >> we attempted to find the woman with the new boots somewhere in union square, but no luck. in san francisco, cornell bernard, abc7 news. >> the san francisco police department is stepping up to help out the needy. through the end of january they are collecting new socks that will be donated to charities ho help the homeless. donate by stoping by the police station and dropping off a new pair of socks. new at 11:00, alameda police are looking for a missing woman who is suffering from early stages of

alzheimer's disease. she was last seen at noon in front of her home. she is 68 years old and 5 foot 5 and 110 pounds. she disappeared while walking her dog, a brown chocolate lab. a year after superstorm sandy, one new yorker has a reason to celebrate. the landscaper found a winning scratchoff lottery ticket while cleaning up debris. by new york lottery rules he had to wait a year to claim his prize. today was the day to claim the cash payout. he walked away with $779,000. it is time for a check on our weather. leigh glaser is off and lisa argen is in. hi, lisa. >> we talked about the red flag warning and the spare the air day for tomorrow. a look at live doppler 7hd which is nice and clear and the temperatures are staying up by the delta. 60 degrees right there.

you can see the lights. san francisco and oakland in the low 40s and redwood city and half moon bay at 43. another look outside and our exploratorium camera, you can see how calm the bay water is, but look how chilly it is in the north bay. 37 for novato and 41 in concord. you are looking at the 60 in fairfield and antioch as well. low 70s there and today the numbers were in the 70s in the north bay at the santa rosa airport. we are looking at another warm day tomorrow. a red flag warning with extremely dry conditions above a thousand feet with the spare the air day and dry weather for new year's eve and new year's day and it looks like into next weekend. the first weekend of 2014. here is a look at high temperatures today. anywhere from the low 60s in the city. we should see the mid50s this time of year for oakland. it was 67 and maybe could see a record or two tomorrow.

71 in santa rosa and we are 15 to 20% of normal. we really do need the rain. here is a look at the hilltop winds. 26 mile an hour wind gusts in knoxville creek. up to 20 miles an hour and by the delta looking at the mild numbers. we will stay in the upper 30s to near 40. elsewhere, numbers are dropping to the low 30s. a chilly morning for you. 41 in richmond and san jose at about 39 tomorrow morning. the high pressure continues to be our dominant weather maker and as it builds in, we are looking at the high fire danger for december and those extremely low relative humidities today. we are down to about 19% in the livermore valley. and tomorrow again 10 to 15 degrees above average. oakland or anywhere along the central coast we could see some record falls. 65 in money monterey with the santa ana winds with southern california.

74 in palm springs and tahoe is nearly 50 degrees. right now though it is 18 at truckee. still making the snow with those chilly overnight readings. tomorrow look for highs in the upper 60s from palo alto to san jose. 70 in santa cruz. look for another 70 in santa rosa with oakland at 65. the accu-weather seven-day forecast, spare the air tomorrow and a little cooler by monday. a few more clouds on tuesday, new year's eve and new year's day looking very sunny and we will increase the clouds by next weekend. it does not look wet. >> thank you so much, lisa. snow was in the forecast for a group of river otters at san francisco aquarium of the bay. employees have added 600 pounds of man-made snow. the snow will changing the environment a bit for these louisiana natives while keeping the exhibits all natural. mike shumann is off with the 49ers. >> big game for the 9ers and a lot of playoff implications.
