weeks ago. abc7 news has the latest for us from oakland. laura? >> this will be a difficult new year's eve for the family of jahi mcmath. today a court denied their request to have procedures done here at childrens hospital that would allow jahi to be moved they still have more legal options, but only, so much time. >> i hate it. they're referring to her as a body. the deeased. >> her mother says she can't stand to here a poke spokesman repeatedly refer to her daughter as the body. >> her name is jahi mcmath. they do not refer to her as her name. that is so disrespectful. >> the 13-year-old was declared brain dead nearly three weeks ago after a tonsil surgery led to complications and cardiac arrest. >> hurts for the family but the

reality is reality there is no pleasant way to say anything other than this young woman is dead. >> the family and childrens hospital filed legal briefs in court. the family says they identify aid facility willing to take her on a vent later and raised $30,000 on a crowd funding site to pay for air transport across the country. but first, the family says any facility requires both feeding tube procedures be pefsh yoermd on the girl. something the hospital refuses to do. >> in essence what we'd have to do and what we're looking into is removing her, taking her to another facility to have a trach tube, a g tube, then another facility. >> we want childrens hospital to help us or get out of our way. >> monday, a superior court judge ordered childrens to keep

jahi on a vent later through january 7th. now, they did contact that facility in new york they confirmed they're in discussion was b.taking jahi. they posted this comment on their facebook page, quote, this child has been defined as a deceased person, she has all functional attributes of a living person. despite her brain injury. now what is unclear is whether this facility is is equipped to take a patient like jahi because it appears that they are strictly an out patient facility the director told us he couldn't talk about that yet on advice of the attorney. in oakland abc7 news. >> breaking news in san francisco. a man died after being hit by a pickup truck in the crocker amazon neighborhood officers examined the truck the truck driver remained at the

scene and spoke with police. investigators have not revealed details or whether the driver sat fault. >> it's now been one year since san francisco witnessed one of the most horrific traffic accidents that happened on new year's day in the mission district two. people died including a pedestrian. one driver surviveed and spoke to abc7 news about that day. leanne is here, now. >> yes. well, you know it's one of the words that touched a lot of us peoples lives ended just as the new year began. now, many neighbors were shocked and pray forward the driver of the car that was hit. >> when looking at the pictures you wonder how the driver survived maybe air bags saved the 19-year-old. he spent 29 days in the hospital. nine surgeries later, garcia is walking again. he ininvited to us his apartment

to talk about the accident and what he remembers. >> on new year's day he was driving his aunt home after the family celebrated. just about 8:00 in the morning at that time, investigators say the driver of the black chevy was trying to get away from police. and ran through the intersection. his aunt died. the car sped out of control, also hitting a pedestrian. a 26-year-old who also died. grars says he remembers his daunt's laughter just moments before the crash.

>> his mother lost a sister. the family says they've forgiven the driver of the car. 20-year-old david morales. police say they were looking for him after he spot shot at three people earlier that morning just blocks from the accident he's in jail. and the trial gives in a few days. he is facing three counts of murder and firearm enhancement allegations oochl there are those lucky to be alive. this surveillance video taken from the inside of the corner store shows a white toyota slamming into the building and an employee barely missed being hit. >> 30 seconds later one of the doors slashed against that. >> he was very lucky that day. >> garcia camped himself
