jose with the latest on the investigation. katie marzullo? >> you can see the last few minutes the crime scene investigation van has arrived on the scene as police continue to investigate the case and they are going door to door to try to find witnesses or anyone who heard anything. no one actually called in shots fired to police when the crime occurred. it was at 1:26, before 1:30, someone saw the body and called police. that is how officers were alerted. when they got to the scene they found a man in his late 20 shot at least once and on a driveway area just off the sidewalk. they tried to resuscitate him but were not able to. he was pronounced dead at the hospital. we do not have an identification and we don't know what happened. police have not identified any suspects or motive.

police will investigate for hours, they say, and there are roads closed here, east san antonio between 34th and 101 overpass, closed, as long as police investigate. san jose's first homicide of 2014 comes on the heels of a tough year struggling for officers. in 2013, 40 homicides occurred in san jose if the third straight year, with 24 murdered last year in the first 11 months two fewer than 2012. rot crimes including burglary and car theft dropped 9 percent. the numbers come against a background of fewer officers, sworn staff now just offer 1,000, 300 fewer than in 2011. >> agents and arson investigators are collecting evidence after a suspicious fire at the chinese consulate in san

political power. this morning, doctors say his kidneys and other vital organs are suffering from critical malfunction. today in san francisco the state supreme court is set to decide whether to grant a law license to a man living in the united states illegally. the man came to the united states from mexico when he was 17 months old. he went to college, graduated from law school, and passed bar exam on the first try. he now is challenging a 1996 law that bars people living in the country illegally from receiving professional licenses from government agencies. opponents argue allowing him to practice law in the united states undermines the justice system. >> the swine flu is back in marin county but this time health officials are prepared. four years ago the swine flu killed 14,000 world wide and five in marin county. the problem was that strain of swine flu was new and not in the vaccine available at the time. officials say 20 percent of the

amy, good morning. >> the consulate is open today although it looks like this. look at the front door, or the doors on the curb side, the glass is broken. the topic is security, a san francisco police officer is here watching over the consulate overnight. the chinese officials want more security. police say that someone poured two buckets of gasoline on the front door of the consulate and set it on fire last night located at geary in san francisco. a spokesman for the consulate said the counsel general will meet with issue agencies to request they strengthen protection of the chinese consulate and in an official statement they called this sabotage targeted at the institution. no one was hurt in the attack, no arrests have been ahead, and officials say no one has come forward to chairman responsibility.

thank you, amy. a family is praying for a newborn baby whose mother was killed in a tragedy on eve. relatives say 19-year-old ashley capuchin was proud mother of three mold old salvador. they mourned the young mother last might and prayed for the recovery of her son and teen sister. after family argument tuesday ashley got from the car stopped at the intersection at paseo padre parkway in fremont. she and her sister tried to cross the parkway to walk home while carrying the baby in a car seat but were hit by a passing pickup truck. ashley died at the hospital and her 17-year-old sister is in stable condition and the baby is critically injureed. >> she is in better hands right now, pray if my great grandson that he will make it. he is in critical condition. >> police say the victims were not in the crosswalk and the driver of white truck that hit them will not be charged.

>> san francisco police are investigating a police chase that ended in an accident in portrero hill. this is video from a viewer of the scene as the driver led police around and around the neighborhood starting around 7:30 last night when officers tried to stop a car that matched the description of the vehicle involved in an armed robbery. the vehicle crashed into a pole at 22nd and connecticut and one person was arrested and taken to the hospital with minor injuries. the second suspect got away. >> a sheriff deputy is hospitalized after crashing the patrol car at the end of a high speed chase. last night, a -- difficult was pursuing a stole be car on eastbound highway 12 and the suspect tried and failed to make a sharp turn at pennsylvania avenue and the car wound up going into a field. the car crashed into a poll seriously injuring the deputy inside. the sheriff says that the deputy's injuries are serious but not life threatening. two suspects from the stolen car
