the upper deck into san francisco. 80, emeryville toward the macarthur maze westbound is moving at the limit as you can see, the bay bridge toll plaza is light as well. matt? >> >> breaking news, hose place are investigating the first homicide the new year a man was shot and killed a few hours ago and our reporter, katie marzullo is in east san jose with the details. katie? >> police have a murder mystery on their hands. the street here east san antonio crawling with police and investigators as you can see. the command unit is on the scene and everyone is trying to figure out what, exactly, happened. san jose police got the call before 1:30 this morning, a passerby saw a man down on a driveway off the sidewalk and was identified only as being in his late 20's. police say he was shot once and did not survivor. no one called in having heard shots fired so that is part of the mystery here, and so far, no

one has admitted witnessing anything. >> we have talked to a few people and knocked on a lot of information but there is not much information. we are asking the we public to they know anything to call our investigators or tip lines. the lieutenant says the neighborhood is surrounded by gang hotspots but it is way too early to know the motive. they do not have any suspects. they will be here for a few hours. as long as they are, east san antonio street around the area of 33rd street, will be closed to traffic. residents in san jose are hoping the year's first homicide is not a sign of things to come. in 2013, 40 murders occurred in san jose, something that has not happened in 20 years. there were 44 homicides last

year all from january to november, two fewer than in 2012. good news on property crime, though, which include burglary and car thefts, they dropped 9 percent, and the numbers come during a time when fewer officers are on the force, sworn staff now is over 1,000, which is 300 fewer than in 2011. >> federal agents are collecting evidence after a suspicious fire last night at the chinese consulate in san francisco. it happened after 9:30 the at corner of geary and laguna. flames charred the front of the building but firefighterred has it out. the chinese consulate called it a "fire bomb" attack asked demanding authorities provide better security and apprehend those responsible. federal investigators are at the scene investigating it as an arson attack. we will have the latest from the scene coming up in 30 minutes.

street. the woman's brother said before this the sister was looking to move because there are gang hotspots in the area. >> >> she has complained about the area she doesn't like it and so much stuff has happened over here sheen whats it get out. police say the man was shot at least once and he is in his late 20's. police very much looking for ones in the case, with no one calling in having heard shots fired. so far of the people they have talked to no one has admitted seeing or hearing anything. if you have any information on kay, call the san jose police department and investigators are expected to be out here for hours. east san antonio street and couples blocks of 33rd street are closed to traffic. developing news from san francisco, federal agents are now joining the investigation

into a suspicious late night fire at the chinese consulate. we are joined with what we are lending about the fire and how they are going to respond today. amy? >> they have had to board up the consulate, the door is out here on the curb, a terrible site of the attack that happened. today the council general will meet with united states officials to talk about tighter security. here is what the response looked like last night: local and federal officials now investigating the crime that happened at 9:25 last night, police say someone poured two buck coats of gasoline on the front door of the chinese consulate and set it on fire. it is located here in san francisco. no one was hurt. a spokesman for the we embassy called it a sabotage of vile nature and said it is a violent kill targeted at chinese counselor institution in the united states and they have expressed strong condemnation. the consulate will be open today

despite the damage. no one was hurt in the attack. in arrests have been made. a sheriff deputy is in the hospital after crashing his patrol car at the end of a high speed chase. new video shows the seen, at 7:30 last night when a deputy was pursuing a stolen car on eastbound highway 12. the driver failed to make a sharp turn at pennsylvania avenue and the car wound up going into a field. patrol car crashed interest a pole seriously injuring the deputy. the statement says the deputy's injuries are serious but not life threatening. >> this was the scene of an accident as the driver led police around and around the neighborhood after officers tried to stop a car that matched
