abc7 news begins with breaking news. >> the news comes from san jose. an early morning fire raced through a home near east san antonio street. the family escaped after being awakened by a smoke detector. firefighters worked quickly to keep the flames from upping to other homes and will remain on the scene for several hours. the reporter is on the scene and join us with a live report at 5:30. we do have the breaking news but we will look at the weather

because this is, again, foggy for those who are driving. breaking news is showing the fog and drizzle but just a lot of mist and moisture. we hope to have drizzle but even that is lard to find to track it. sun will breakthrough between 10:00 and noon and with clouds this afternoon with temperatures from the mid-to-upper 50's along the coast and upper 50's to low 60's for the rest of us. leyla gulen? 33 prosecutor -- 33 bart trains are on time. for bart, no delays. muni has in delays. ace train one is on time. on the maps, in san jose, we have this issue, a car hood is blocking a lane northbound 101 coming up to this area.

have lost confidence in the company. >> with the infections and now this, why bother? >> it grosses me out. i eat chicken. foster farms say they maintain an ongoing pest control program, a single incident is not acceptable and we are committed to a zero tolerance policy. the company has treated the plant and expected to re-open as soon as it passed inspection. governor brown has the new budget today a day early. it should be welcome news no education, health care, and the environment. some propose l as are controversial. katie marzullo has been going through the budget. katie? >> the governor is proposing prudence but the budget provides additional money for nearly every area of the government. we get to hear the details this

morning rather than tomorrow because the budget was leaked to the media. 10 percent of the total budget goes to paying down debt to the tune of $11 billion. $6 billion pays back schools that have state aid cut the last few years. k-12 education gets $45 billion. $1 billion is slated for the csu systems and community colleges. the governor wants to put $1.6 billion away interest a rainy day fund. here are the totals, the budget proposes $154.9 billion in spending from all funds an increase of 5 percent over last year. on the revenue side, $4 billion windfall from the capital gains tax and prop 30 provides new sales and income tax revenue. another big ticket and controversial item, the high-speed rail project, governor brown wants the bullet train to get $250 million generated by the landmark cap

and trade law which is opposed by some environmentalists. recent court rulings prevent the state from using bond rows to -- proceeds to fund the project. prudence is the legislative analysts forecast california will have a more than $3 billion operating surplus by end of the fiscal year. the governor presents the budget at 9:00 a.m. in sacramento. the number of flu cases and deaths from the flu are rising in the bay area and one hospital set up a special area just for flu paints, a tent is outside the emergency room to treat new flu patients. the idea is to keep it from spreading into the hospital. a doctor says parents will likely go home after being treated in the tent. the hospital expects to keep the tent up to the next two weeks. >> we have the first ever reported death from bird flu in north america. a canadian has died after

traveling home from beijing. he was infected with the swine virus which rarely passes from person-to-person but when it does, 60 percent of the infected people die. the man suspected of abducting a little girl faces more charges stemming from kidnapping incident in antioch. david douglas may have tried to kidnap other children. the charges include allegations he tried to molest the seven-year-old victim and possessing child pornography. he snapped her from the first yard and a target employee gave investigators the needed we tip to rescue the girl. >> school officials are overhauling how berkeley pool is cared for. the pool oversite has been moved from the administration to district headquarters. the change comes after reports of students suffering eye ear

good morning, we start with breaking news from the south bay. >> a is couple is looking for a place to stay after a fire gutted their san jose home. matt keller is near the scene. matt? this fire started 3 1/2 hours ago. smoke is still pouring out from the roof of the home. firefighters say there are two at ticks in the home.

the tubes the family wanted. jahi mcmath is doing much better now she has been take ton a new facility. the attorney says doctors inserted the tubes into kid dead yesterday. she was declared brain dead last month after complications from tonsil surgery and says doctors are optimistic the condition has stabilized and her health is improving from when she was taken from children's hospital oakland. >> transgender teen faces criminal charges after she acted in defense she claims by attacking another student who bullied her. jewyles gutierrez is a boy biologically but identifies as girl and admitted to stating the fight after hercules high school. jewyles gutierrez says the other girl bullied her and pushed her to the breaking point. >> it was hurtful. the bullying was not nice words.
