abc7 news begins with breaking news. the breaking news is in oakland where a student is shot and wounded according to the school district. we are over the scene near the bay area technology school. we understand that the boy was shot in the behind at charterer school. a of staffer drove him to the hospital. the unified school district says a student has been shot at a bus stop were we are checking to see whether the school has been locked down. we will follow the story on

abc7news.com and on twitter. thanks for winding us. our other top story right now, a ferocious warehouse fire in san jose this morning is creating a health warping, clothing schools and triggering a power outage. at height of the fire, 100 firefighters were on the scene, the inferno was at 101 and julian street. amy hollyfield was there along with matt. matt? >> no injuries have been reported. firefighters are getting the upper hand on the fire. they are are putting water on the hotspots. the flames did a lot of damage early this morning. there was no buildup to this warehouse fire in san jose. the flames got big quickly after the call came in before 5:45 this morning. firefighters immediately knew it was too dangerous to go inside and started sending water from

afar. >> the danger is we don't know what is inside the building. a lot of companies do not tell us they moving out and could leave debris in the building. >> the 80,000 square foot warehouse was separated by a firewall and mostly vacant. only a few businesses inside including a roof and tile company. the flames gobbled up the building, the explosions speeded up the process causing the roof to collapse. a firefighter told me it appears the flames were laughing at the water. >> they had it under control for a minute and it started blowing out up and now it is ten times worse. it went up quick. >> the fire escalated to five alarms with 100 firefighters on the scene including from nearby students the people and pets were evacuated immediately after the fire started. some people were sleeping when they heard a banging on the door. >> they took everyone out of the houses. they pushedden down the street. they told us not to wait until

it was over. >> neighbors watched the fire licking at the back of several homes and firefighters and a concrete wall did the best to keep the flames away. >> never seen a fire like this before. insane. >> five outbuildings were damaged and 15 homes are remaining evacuated. a vintage roof and tile company was this the warehouse. firefighters will be on the scene for five or six more hours >> the fires had a major impact on local schools, traffic, and people trying to get to work. amy hollyfield is the a closed school because of the fire. >> >> a rough day in the neighbor. look at the sign that greeted families at the school "prep school here is canceled," they were worried about the air

quality and the smoke coming from the fire. the public school district had the same reaction. >> at first, parents thought it would be normal at empire gardens in san jose. the fire was burning near, parents dropped kids off for school. then a change of plans. >> five minutes later i get to my job, no, come back, pick up your daughter. it is for the best. >> the administration called off school because of concerns of air quality. school workers wore masks as they cleaned up the campus. residents close to the fire were not too worried. some stood it on the estate to watch the smoke. everyone we spoke with says they felt okay. >> we have no pg&e but we are okay. >> fire officials were keeping an eye on the air quality. >> we have no reason to believe there is any haz-mat associated with the buildings. >> fire caused inconveniences, residents at the apartments

could not drive their cars from the parking lot this morning because street was closed. employees at the kellogg plant had a tough time navigating through blocked off streets and heavy traffic just to try to get to work. >> here is the view from the kellogg laboratory and the apartment building looking down the avenue: it is blocked by emergency vehicles. now you can make the right-hand turn so cars are able to get in and out of here. it made for an interesting morning for the night shift employees who could not get out and the day shift employees who could not get in. now it is business as usual and we are told there are air quality monitors on the scene keeping an eye on the situation. so far, the air is okay, they feel. >> at height of the fire, pg&e intentionally cut fire to 4,000 customers in the area so crews

could safely put out the fire. according to pg&e that number down to a little more than 1,800 customers who are still without power. a biotech company is under scrutiny after another dangerous fire that injured workers in south san francisco. the flash fire blew out a laboratory window on veteran's boulevard last night which injured two employees, one suffering severe burns. firefighters say the employees were working with hazardous chemicals. there was a similar fire in may. >> now the developing news: foster farms is would being do re-open their chicken plant after a live cockroach infestation was discovered. the department of agriculture issued a notice of suspension at the foster families plant in livingston the same location linked to the salmonella outbreak this march. according to the usda the

discovery of the live cockroaches created egregious insanitary conditions and failing to maintain effective pest control program. people near the plant worry about jobs but they have concerns as consumers. >> i am sure people will lose their jobs because they cannot afford it. >> the infection and now this, why bother? they were very popular. this will destroy everything. >> they say over the past four months inspectors identified a total of five cockroaches inside the plant. in a statement the company says and i quote, "food safety is foster farms highest priority," and the company took action immediately. this is an isolated incident. >> happening now, governor brown is on the road promoting a budget proposal for 2014. he made it official: the down was leaked to the media last night. abc7 news reporter has details

on "a modest" surplus. >> the governor announced the budget this morning including record spending from the general fund. the big picture: the government calls for $155 billion in spending a 5 percent increase from last year. the legislative analyst says at the end of the fiscal year the state should look at a $3.2 billion surplus. the governor banking on $4 billion in revenue from capital gains taxes and prop 30 tax increase. he is promising a somber approach. >> all in all, this is a wise allocation of the public funds and it does represent prudence in how we proceed which is never easy. when the money is in people want to go for it. we have tried to keep it very measured. >> breaking it down: the governor has set aside $11 billion to pay down the debt, $45 billion for k-12 education

an increase of $4 billion, and $1 billion goes to state university, and community colleges. the governor wants to use $250 million in proceeds from the cap and trade program to help fund the high-speed rail project. >> california is still the generator of dreams and great initiatives. >> for that rainy day the governor has set aside $1.6 billion. new this morning, new jersey governor chris christie fired two key aides in the wake of a growing political scandal involving a busy bridge and a down mayor. the governor apologized in a two hour news conference. our reporter has the latest. today, new jersey governor chris christie took on allegations his office engaged in a political vendetta. >> i had no knowledge or involvement in this issue, in its planning or execution.

attention shopers, low man's liquidation starts this morning including three in the bay area selling merchandise at big discounts. the giant has been in business for more than 90 years but filed for bankruptcy protection in december. they are known for carrying high-end brands as discount prices. the bay area stores are in san francisco, san ramon and sunnyvale. >> the nfl is defending itself over ticket prices following a lawsuit filed by a football fan who says super bowl tickets are too expensive for the average man. the league is being sued for not providing enough super bowl ticket at face value. the new jersey man claims the nfl only released 1 percent of the tickets to fans and says that is far short of the 5 percent required by new jersey state law to protect against consumer fraud. >> he says the practice drove up the cost his tickets to $4,000 from a re-seller and the nfl says it is in compliance with the law.

>> there is still a chance another game could be played at candlestick if the 49ers beat the panthers on sunday. many fans already are buying up seats, literally. seats from the stick are sold because the stadium will be torn down after the season. we 3,000 pairs have been purchased since going on sale last month at $650 a pair. that means nearly $2 million has been raised so far which goes to san francisco rec and parks department. there are plenty of seats left but the rice is up, a pair now is $750. the san francisco brewing company has done it again. >> that is right. here is a picture to prove it, creating a special beer to celebrate san francisco's love if the 49ers and to encourage them to make it to the playoffs, with a close up, the brewing company says they came up with the idea following sunday 49ers win over the green bay packers and you can get it on draft and in the mission and in

where the clouds are starting to part over us. they are still hanging around in a few hours and if you look behind me the sky is blue and it is fairly clean but for hose and over to pleasanton where they had the fires but even there the air is doing well and dome -- shows radar and satellite, notice, the clouds are the only thing you are seeing and we did not see much in the way of radar returns because the drizzle was is light. our next system showing to the north and that will bring us a better chance of rain on saturday. as far as what happened today, to give you an idea of how scattered it was, on the embarcadero, you go two miles away to the official observation for san francisco and there was .02" of rain. we had .01" at oakland and san jose international airport. temperatures are warmer than this time yesterday mostly in the mid-to-upper 50's and warmer in the afternoon when we start

to break through the cloud cover which we have not done at sfo yet. you may still have some delays up to 53 minutes. call ahead. partly cloudy, warmer in the afternoon, the next chance of rain is saturday and record highs and poor air quality in the forecast next week. in san jose, we have partly cloudy conditions right now and the temperature will jump about three degrees over yesterday to 61 and same in san francisco up to 59, concord and fremont and santa rosa at two degrees waller at 61 and 62 and oakland jumps up one degree. you get another minute and three seconds of sunshine pushing us, everyone else into the upper 50's to low 50's but the coast has clouds lingering and we will have temperatures in the mid-to-upper 50's and you can see the cloud cover at the coast tonight while the rest of us are partly cloudy and up to ten degrees cooler because of the lack of clouds. mid-30's inland and 40's at the bay shore. weak cold front pushing through and a brief break today and
