covering berkeley, san jose, and all bay area, this is abc7 news. a beautiful start in san francisco. more warm temperatures. high fire danger in the bay area. mike nicco has the forecast. the daughters of charity say they will sell their network of six hospitals including three in the bay area. the board of the catholic health systems says they are looking if proposals from catholic and non-catholic. they operate seton and a hospital in gilroy. >> several san francisco tenants claim they have been forced to live without heat or hot water with the landlord trying to force them out so he can convert the building to office space. they live at 1049 market street, an office building that was

live from the kgo-tv broadcast center this is abc7 news. good morning. it is tuesday it is 5:29. thank you for joining us. i am kristen sze. >> i am matt matt keller. your shorts may be coming back out. >> the shorts and the wind breaker. >> it is windy. it will be warm this afternoon. good news in santa rosa, three miles is the visibility with the fog lifting and the temperature is below freezing. we have been watching for black ice but so far, no reports. from our camera, the winds are not gusting in san francisco but it is gusting in the hills and that kept our temperatures in the 40's and 50's and spring board to upper 60's to mid-70's inland and same around the bay upper 60's to 70's and near 70 long the coast, a record high

with fire danger continuing today. i will tell you how much longer in the seven-day forecast. >> 42 bart trains are on time. ace train one is rolling. capital corridor train 448 and 551 canceled today and tomorrow for track repair. bus service is put in place. you will be able to get between sacramento and jack london square. as we head over to the drive to berkeley we have this problem involving oil on the frontage road on-ramp and no word if that is closed or what is going on but c.h.p. is headed out there and this is off of westbound 80 and drive time traffic 580, 34 the hot weather is producing other hazards. amy hollyfield is in the berkeley hills where a neighbor faces a major clean up job.

amy? >> look at this. it is windy and dry, look what happened. a tree came down and those are the conditions we are dealing with in mid-january, two trees fell in a berkeley neighborhood yesterday afternoon when it was really windy and the gusts were stronger last night. no one was hurt. firefighters say this is just unreal. they have never seen a january like this. you could hear them step on it, and you could hear it crunch and crackle and this is what we are worried about starting the larger fires. the dry windy conditions combined with a red flag warning in place right now for the east bay hills and for the north bay. it is still calm conditions but they are keeping this in effect until thursday night.

a house fire in antioch led investigators to an indoor marijuana grow. a neighbor saw the electrical panel sparking and called 9-1-1 at 9:00 last night. firefighters found a number of marijuana plants and called police. anyone was home at the time of the fire. a pg&e worker inspected the electrical panel to see if that sparked the fire. lighting used for indoor growing operations are then to cause wiring to overheat. volunteers near downtown san jose are looking out to stopping a serial arsonist who has set a dozen fires in the past six days. 30 people volunteered to keep an cry out in the overnight and last struck sunday morning. so far he has not used an accelerant and starts the fires by setting a blaze to objects

standing up against a wall. katie marzullo will have an update at top of the hour. >> the flu continues to take a deadly toll in the bay area with throw new flu-related deaths announced yesterday in santa clara, san mateo and santa cruz counties. among the latest victims is a 54-year-old sonoma county resident who had underlying health conditions. the flu is hitting we posted a link on our website where you can get a flu shot at abc7news.com and look under "see it on tv." the richmond city council will let voters decide if the minimum wage should be raised to the highest level with the city council expected to decide whether to propose boosting the minimum wage to $11 an hour or up to $15 an hour.

employers with fewer than ten workers are exempt. the lowest option is higher than the current highest minimum wage. a bus crash left 16 injured after it smashed interest a semi truck. the but was on the way to washington from los angeles with stops along the way. the c.h.p. is investigating but it appears the bus rear ended a big rig when a semi hit the brakes. sonoma county supervisors will consider the cost of creating a new park in the name of 13-year-old andy lopez. officials say the cost of the park could run between $2 million and $3 million. he was shot and killed by a sheriff deputy while carrying a coy ak-47 in october. a 21-member community task force met for the first time last

night and will make recommendations on how to review insurance dens involving deadly force by law enforcement and consider splitting up the sheriff and coroner's office. the meeting gave a group of teen activists known as andy's youth a chance to speak out about alleged harassment. >> andy's death is the breaking point. it should not have taken this to on the eyes to what is going on for the community. now we cannot let his death be for nothing. >> a temporary memorial to lopez has been rebuilt at the spot where he died after it was destroyed by fire believed caused by a burning candle. >> the largest union signed off on a new contract. 87 percent of the members ratified the four year agreement yesterday. the contract ends a bitter labor dispute that led to strikes in july and october followed by a battle over a family leave clause in the negotiated contract.

a minute. >> state lawmakers have introduced legislation to oversee senior care homes in california. this is in response to problems at valley springs manor when 14 parents were left in the facility after the state ordered it closed requiring the department of social services to investigate abuse and neglect within 24 hours and bolster the inspection process by requiring unannounced inspections at least once a year. >> retired police captain is facing murder charges for shooting two people inside a florida movie theater over tempting. authorities say the retired officer was angry when the couple start the texting during the movie previews. the 71-year-old curtis reeves shot and killed the man and wounding his wife. witnesses say the man told reeves he was texting his three-year-old daughter. an off-duty deputy subdued rebounds and took the weapon. they were this to see "lone
