pressing that women get their fair share, equal pay, equal respect. >> she's speaking out. we'll talk about that but that fatal shooting at a florida movie theater. retired cop now charged with second-degree murder after shooting a fellow moviegoer who was texting during the previews. abc's steve osunsami is on the scene just outside tampa. good morning, steve. >> reporter: good morning, george. this is a high-end theater with incredibly comfortable leather chairs and waiters and waitresses who bring food and drinks right to your seats. it was quite a shock when someone pulled out a gun. they were there to watch "lone survivor." >> more than ten guys. i'd say an army. >> reporter: long before the gunfire got started on the screen it was happening for real during the previews. police say it all started when retired tampa police captain curtis reeves, seen here wearing a white jump suit, got fed up with the couple on their cell phone in front of him and his wife.

police say that 43-year-old chad oulson seen in this news report from 2011, and his wife, nicole, pictured on their facebook pages, were reportedly talking loudly and texting away. >> curtis reeves asked him a few times to please turn off his phone. chad decided not to. >> reporter: the 71-year-old retired policeman went for the manager but came back alone. police say the two men started arguing. oulson trying to explain he was texting his young daughter. that's when witnesses say the retired officer pulled out a gun and aimed at oulson's chest. >> somebody throws popcorn. i'm not sure who threw the popcorn. and then bang, he was shot. he staggered two seats over, fell on my son and i. >> reporter: oulson's wife was wounded trying to shield her husband from the gunshot using her bare hand. >> she's a wreck. i mean she just lost her husband, the father of her little girl. >> reporter: at the theater people who were there tried to help, including an off-duty nurse who rushed to the bleeding husband and tried to revive him but couldn't. >> something happening like that in little wesley chapel, i never even thought it would happen. >> reporter: as for reeves abc news learned he retired from the

tampa pd in 1993 and was instrumental in establishing the department's first tactical response team. theme park busch gardens confirms he was once their director of security. authorities say he'll be charged with second-degree homicide. reeves has a son who is currently a tampa police officer. we reached out to him last night. he told us that his father is still his idol. reeves has a court appearance this afternoon. robin? >> okay, steve, thank you. now to the fallout from the southwest plane that landed at the wrong airport. the veteran pilots who were flying it have been grounded. and an investigation has been launched. abc's alex perez with the latest from branson, missouri. good morning, alex. >> reporter: good morning, robin. this is a tiny airport, and we've learned there weren't even any employees here when that southwest flight touched down. this morning, we are learning more about those pilots who landed southwest flight 4013 at the wrong airport.

both grounded, pending investigations by the faa and ntsb. >> i can't just start moving the airplane around or trying to reposition or anything like that. >> reporter: the captain, a 14-year southwest veteran, the co-pilot 12 years with the company. but still no word on how they could have brought a plane full of passengers so close to possible disaster. >> we're very lucky indeed especially considering there was a cliff at the end of the runway. >> reporter: the boeing 737 with 124 passengers on board took off from chicago's midway airport sunday. it was supposed to land at branson airport in missouri, but instead, he somehow landed here, seven miles away at the much smaller taney county airport. take a look, the runways face in a similar direction but branson's runway is more than 7,000 feet long and has an overrun zone in case planes go off the runway. the runway at taney county is some 3,000 feet shorter with

steep dropoffs at either end and has never had a 737 land there before. and that's why the pilot slammed on the brakes, the plane coming to a screeching halt 300 feet before it would have plunged right over the edge here. southwest finally moved the plane monday. and we now know authorities have taken the plane's black boxes to d.c. looking for answers. and we've also learned the ntsb will be interviewing the crew of flight 4013 sometime this week. robin? george? >> okay, alex, thank you very much. again, twice in two months this has happened. >> strange. and a lot of questions still to be answered. we're going to turn now to that strange and scary series of fires hitting northern california. police in san jose trying to track down an arsonist on the loose before he strikes again. aditi roy has the details. >> reporter: raging fires, charred homes, and skeletons of buildings. authorities in san jose, california, say it's the work of a mystery arsonist who set 11 blazes in 6 days since last wednesday. >> people should not be living in fear. >> reporter: authorities want to talk to the man in this

surveillance video who they believe is connected to the fires. you can see him walking back and forth four times minutes before another fire burns across the street. when you see the destruction here, what do you want to say to the arsonist? >> stop. stop this craziness. >> reporter: sharon and vincent barely made it out of their home alive after it went up in flames early saturday morning. this church has been hit twice. the damage, $70,000. investigators say the arsonist strikes in the early morning hours working within a five-mile radius. >> he's operating at a set period of time within a specific area. we're hoping that we can bring this thing to an end. >> reporter: no one has been injured in the fires. this couple who say they don't have insurance and may not be able to go back home now just hoping it doesn't happen to anyone else. >> we had planned to take our retirement here, of course, but unfortunately this is not going to happen. >> reporter: for "good morning america," aditi roy, abc news,

san jose, california. >> let's hope they solve this soon. now to josh and today's other top stories. we begin with a daring rescue after a man took several people hostage inside a 7-eleven store. now, police had to make a split-second decision when the suspect came out. as you can see here, holding this woman. now, a warning, some people may find the images you're about to watch hard to watch, but i assure you everyone survived. >> reporter: it plays out like a hollywood thriller, but this scene outside a denver 7-eleven monday was all too real. a gunman taking three hostages inside the store for about an hour before emerging with this woman, using her as a human shield, as he ignored hostage negotiators' demands to surrender. then the whole thing comes to a jaw-dropping end as police open fire. [ gunshot ] the suspect goes down and the hostage makes a run for it, dodging behind a s.w.a.t. team van. >> we heard a loud bang and saw the guy's face just fell back

like if it was a car accident, like whiplash. >> reporter: the bullets just inches away from the hostage herself, a potentially risky move, but one they say they had to make. >> he attempted to pull her back if the store. out of fear for her safety, one of the officers fired a shot striking the individual. >> reporter: this morning, police say the suspect is in critical condition. as for the hostage we're told she's a bakery delivery woman who was making her usual stop at the 7-eleven before it came to a very unusual end. for "good morning america," clayton sandell, abc news, denver. >> clayton, thank you for that. meantime, there is growing anger this morning against two police officers in california who have been acquitted in the fatal beating of a homeless man. now, surveillance video showed the fullerton police officers striking the man with a baton and then shocking him with a stun gun. officers say he was being combative. the fbi is now reviewing the case and decision. new worries about obamacare and rising insurance premiums. enrollment among young adults is

far lower than the obama administration's target. people under age 35 make up less than a quarter of those enrolled thus far. that is a concern because young and healthy people generally pay more into the system than they take out, thus, subsidizing older adults. and the drinking water contaminated in that chemical spill in west virginia is causing new problems at this hour. it is flowing down the ohio river and will reach cincinnati today. that city is closing two river intake valves in an attempt to protect its water supply. meantime, after six days, water service has finally resumed to some of the population impacted by the initial spill in west virginia. and in florida, the danger of texting behind the wheel on full display here. a man drove off the road as you can see there, struck a tree, flipped over. police in ft. myers released this video as a warning. so please, if you're watching, the driver wasn't seriously hurt, but when you're in the car

us, josh. >> breaking news. now to a possible breakthrough, though, in the worldwide search for missing madeleine mccann. the little british girl who vanished while vacationing with her parents in portugal in 2007. police may be closing in on key suspects in the high-profile case. and abc's lama hasan has the latest from london. good morning, lama. >> reporter: good morning to you, robin. well, the arrest could potentially turn out to be scotland's yard most significant to date, getting them a step closer to solving the mystery of what happened to little madeleine mccann. british police are seeking evidence that could lead to arrests in connection with the disappearance of madeleine mccann. according to british newspaper, "the daily mirror" british police are looking to quiz three alleged burglars who had been active in the neighborhood where mccann went missing. scotland's yard re-opened the investigation into maddie's disappearance three years ago. maddie mysteriously disappeared from her bedroom at this

portuguese vacation resort while her parents dined with friends at a nearby restaurant. the pain never disappearing. >> when it's a special occasion when you should be your happiest and madeleine is not there, that's when it really hits home. >> reporter: this could be the biggest lead in the investigation so far. detectives want to question the men about their cell phone records that show they made numerous calls to each other hours after she went missing. around the time maddie disappeared, this had been a spike in the number of breakins. two of them taking place in the same apartment block where the mccann family was staying. thieves gaining access through a window. one theory is she might have been abducted as part of a botched robbery. overnight, scotland yard did tell abc news "we can confirm that a second international letter of request has been sent to the portuguese authorities by the crown prosecution services this week."

after the french magazine, closer, published pictures of a man they say the hollande riding a motor scooter coming and peting gayet in this paris apartment, not far from the home he shares with valerie trhierweiler, whose spokesman said suffered a big emotional shock. the news hit her like a high-speed train and hospitalized for depression and extreme fatigue. >> people traditionally haven't sympathized with her. she doesn't have a charming personality in public. but i think now, they're beginning to see her as a woman scorned. >> reporter: while she does act as first lady, she and the president have never been married. the french president has not denied the affair. he said he greatly deplored the invasion of his privacy and even threatening legal action. according to a new french poll 77% of french voters surveyed thought the president's liaison should remain private. and 8 in 10 said their opinion of him had not changed. but this was before the

amy, thanks. lara, you have a bit of a warning out west. >> a bit of a warning here. it is the time of year that bears should be sleeping in. but this year, officials are warning more and more bears are out of hiber nation. and they're popping up in, as you can see, the most unlikely of places. the slopes are alive with skiers and bears? you might not expect to see old smoky on the trail but skiers at heavenly mountain, one of the country's biggest and most popular ski resorts, have started to see them regularly on the slopes. alarming officials who are warning, it will likely be a more common sight. with warmer conditions, bears aren't hibernating like they should be and are on the prowl which could cause some serious problems. >> what it tells us is that these bears have become too acclimated to humans and see them as a source of food. >> reporter: unusually warm and dry conditions are forcing them out of slumber to look for food and water even on the slopes. it's called urban interface. they don't hibernate when they have easy access to food provided by people.

quarterbacks could face, if convicted, 20 years in prison for the 2012 death of teammate jerry brown, brown was the passenger the night brent crashed his mercedes. >> 911. >> there's a car in the middle of the road on fire upside down. >> reporter: police dash cam video shows the overturned car still smoking. first responders are astepping to brown who later died and brent during a field sobriety test where police say he couldn't recite the alphabet and admitted he had a buzz going on. in opening arguments monday prosecutors used that video to illustrate the basis of their case, that brent's blood alcohol level was more than twice the legal limit, the district attorney saying "the blood does not lie." but brent's attorney told jurors that the 320-pound former lineman could safely drink more than most people, saying "josh brent is as big as a house. he was guilty of being stupid and driving too fast, but he was

not drunk." size as a defense? the doctor we spoke to says, it doesn't add up. >> one's impairment has absolutely nothing to do with their size and weight and height. >> reporter: as for brent and brown, the two were said to be like brothers. >> can't get any tighter than those two. >> reporter: even brown's mother says she has forgiven brent but prosecutors say that doesn't change the facts. they claim receipts prove brent bought several cocktails and three bottles of champagne that night. brent has pleaded not guilty. and brent reportedly told police he shared that liquor with friends at a nightclub. meanwhile, the police report from that night also says brent had been driving with an expired and suspended license, robin. >> all right, gio, thank you. we'll bring in abc chief legal affairs anchor dan abrams. let's get right to it. the lawyer using size as a defense. >> it's not particularly effective. as you heard the expert someone 300 pounds just has to drink

more to get to that same level as someone 150 pounds so once you get that number, that 0.18, that's already incorporated your size. look, typically when you're in the position he's in, you want to get blood alcohol tests thrown out before the trial. you see that happen a lot. because they say it was unreliable. there were various problem, et cetera. they didn't succeed. they're still trying to have the jury minimize that but they're in a tough spot. >> this is a very tough case for the defense. >> and the key in my view is sentencing, which is i think they know he's going to get convicted of something here. and, remember, he's not just charged with intoxication manslaughter. he's also charged with regular manslaughter. jurors could decide we don't think, let's say for argument sake there's not enough evidence he was intoxicated but driving over 100 miles an hour could be manslaughter even if they don't think he's drunk so when you have a range of probation to 20 year, this jury, which is going to decide the sentence, very

unusual. >> the jury is going to decide the sentence. >> that's right so i think what the defense is doing is playing here for the sentence. they know there's going to be a conviction or certainly suspect it. they're going to try to argue everything they can and hope to get some sympathy in particular because the victim's family members support him. >> his mother. his mother has forgiven brent. she has forgiven brent and would like to testify at the sentencing. >> exactly right so while her testimony might not be relevant to guilt or innocence when you're talking about the dense her testimony could be very rell vaptsz and i think that's what this is about. >> very interesting. >> thanks, guys. to the debate taking off from one of america's most expensive and sophisticated restaurants, it all began when a couple's crying baby bothered other customers at this restaurant in caught and the chef took to twitter with this question. should he have asked the family to leave so the other diners could eat in peace. abc's linsey davis has the story.
