good morning, everyone. i'm john muller. >> i'm marci gonzalez in for diana perez. we begin with new details overnight about that shooting at a middle school in new mexico. two students were badly hurt and the 12-year-old suspect has been taken to a psychiatric hospital. >> we're learning it could have been much worse except for the heroic actions of a social studies teachers. here's abc's mary bruce. >> reporter: it is an all-too-familiar scene. terrified student, panicked parents, another school tragedy. police say a 12-year-old student brought a shotgun to this roswell middle school walking into the gym and opening fire. >> one student or female subject possibly shot. >> reporter: two students were hit. the suspect's motive remains unknown, but the shooting could have been far worse were it not for the rapid response of teacher john masterson. >> he starts to turn and sees that the young man shoots and

shoots. mr. masterson begins to talk to him to put it down. the young man put the gun down and raised his hands. >> reporter: a taste police lieutenant who was dropping off his own child ran to help. the shooter remains in custody. those who know him find it hard to believe. >> great kid. i'm shocked. dumbfounded. >> reporter: the victims a 13-year-old girl and preteen boy were flown to a hospital in lubbock, it can. she is in serious condition, he is critical after two surgeries. hundreds gathered at this vigil last night as the search for answers begins. >> pray for the victims. >> reporter: school shootings have become commonplace since the massacre at sandy hook. by one count there have been at least 30 more school-related shootings in the country, at least 26 people killed. classes have been canceled for the day as this community tries to come to terms with this tragedy. students are expected to return tomorrow and counselors will be on hand to help. mary bruce, abc news, washington.

florida judge has denied bail for curtis reeves accused of shooting a fellow moviegoer to death. he got into a heated argument with chad oulson over oulson's refusal to stop texting during the previews. oulson tossed a bag at popcorn at him and reeves killed him. he is charged with second degree murder. that other major story we've been following overnight, the danger of high winds pushing fires out of control across california. that threat has fire officials on alert keeping a watchful eye for even the slightest hint of trouble. california has the perfect combination of conditions right now for a major fire outbreak. extremely low humidity, widespread drought and strong santa ana winds. >> it is drier. i can feel it. >> reporter: a small fire on kimmel island between san francisco and sacramento grew quickly and burned across nearly 50 acres. at least one building was lost,

and a small island was evacuated. in southern california, fire crews worked fast to limit the damage from a fire right alongside the famous pacific coast highway. aircraft brought in to drop tons of water on the flames as they burned just feet from multimillion dollar clifftop hopes. none of them were damaged but elsewhere residents weren't so lucky. >> my house is gone. >> reporter: that man's house and at least one other were lost in a riverside county fire. about a dozen other buildings and 40 vehicles also burned. the red flag warnings where fire danger are expected to remain in effect until at least tonight. firefighters say it is so dry, conditions in some areas of the state are more like what they're used to seeing at the height of fire season in september or october. >> the weather is certainly unusual, and so we're being vigilant and monitoring the weather. >> reporter: part of that weather are those gusty santa ana winds blamed for bringing down

plenty of trees including a 45-footer that crashed on to a school building in san bernardino. and state fire authorities are so concerned, they are hiring seasonal firefighters ahead of schedule across the state. about 125 of those firefighters are coming back to strengthen the ranks in the bay area alone. new jersey governor's has apologized again for the traffic scandal which threatens to undermine his political future. chris christie now vowing that his commission would cooperate to make sure public trust is not violated. >> the last week has certainly tested this administration. mistakes were clearly made and, as a result, we let down the people we're entrusted to serve. >> you can learn more about the bridge investigation today. the aide christie fired, bridget anne kelly, is being called to testify before lawmakers. kelly wrote the now infamous line, "time for some traffic problems in ft. lee." there's new insight this

morning into the mind of terror mastermind khalid shaikh mohammed. documents written by mohammed from his cell at guantanamo are being made public. the 9/11 mastermind says it is wrong for muslims to spread their faith through violence. mohammed also says that western nations like the u.s. are being destroyed by homosexuality and divorce. all right, new reports just out this morning reveal the government's spy agency is eavesdropping on computers around the world. "the new york times" reporting that the nsa installed surveillance software in 100,000 computers. it has allowed the u.s. to keep an eye on the chinese army, the russian military, drug cartels and potential cyberattackers. the nsa claims the technology has not been used here in the u.s. some businesses in downtown charleston, west virginia, have re-opened, deemed safe after a chemical leak tainted the city's water supply, but more than 60% of residents are still not able to use their taps. schools in the four counties affected by the contamination

will be closed again today, and downstream 250 miles away in cincinnati, officials have shut down two river intake valves until the toxin flows by. a federal judge in oklahoma has ruled that the state's ban of same-sex marriage is unconstitutional, but same-sex couples won't be able to get married until the appeals process is exhausted. oklahoma's governor argues that the ruling ignores the will of the people who approved the ban by a 3-1 margin. utah is too on hold to allow appeals. a bit of deja vu for president obama. welcoming nba champs, the miami heat, to the white house for the second straight year. >> the president praised the team for its accomplishs on and off the court and delivered a healthy amount of ribbing joking that despite those two titles plus another in 2006, the team still struggles for respect, something that he can maybe relate to. he's a big fan, that president obama. ever see him play? >> yeah, i've seen a few, actually.

welcome back. wells fargo is now the nation's most profitable bank. it earned just under $22 billion last year, a $4 billion jump from the jpmorgan chase bank which replaces it -- it replaces it, that is, in the top spot. jpmorgan chase's profits were hurts by a series of massive legal payouts that it had to make. >> and both of those banks released earnings reports on the same day as stocks staged their biggest rally of the year so far. the dow surged 115 points making up most of the ground lost on monday. the surge continued overnight with major asian averages all posting strong advances. and the debate over extending benefits for the long-term unemployed has stalled in the senate. so far, democrats and republicans failed to reach a compromise on how long to renew the benefits and how to pay for them. the extension could cost at least $6 billion. two democratic senators demanding answers from target about the massive data breach.

the company says credit, debit and personal information for up to 110 million consumers could have been compromised. more than a dozen lawsuits have been filed against target including one that claims it ignored warnings about security weaknesses as far back as 2007. finally toyota is signaling it's getting back in the sports car business. that signal came in the form of the company's st1 in detroit. toyota says it is just a concept car, and it didn't release any specifications about the car. definitely looks pretty cool. maybe something like it will be unveiled in the future. >> i can see you tooling around in that, marci. >> oh, yeah. >> red sports car. >> why not. >> why not. when we come back, high drama on the high seas. new video this morning of the coast guard reaching a sailboat just in time. and buzzer beater. a college basketball game ends in dramatic fashion.

people across awe clair, wisconsin, digging out from a record snowfall. the city got 9 inches of snow yesterday accompanied by some powerful winds. drivers struggling to navigate treacherous roads. they were facing blowing snow and dangerously low visibility. now a look at morning road conditions. a windy commute for drivers in the west, snowy highways from the dakotas to the great lakes. rain and snow also make for a slick ride from vermont to western pennsylvania. now, if you're flying, blowing snow could cause airport delays in minneapolis and detroit. a california biotech executive will stand trial for allegedly shooting two men, the brother of his estranged wife and a former business partner. >> the victims were attacked separately in their la jolla homes as the children slept. security cameras captured a confrontation between hans peterson and his brother-in-law ronald fletcher testified at the hearing about this violent struggle. >> when i grabbed the gun, he fired and shot me in the stomach. i was in shock.

i was fighting for my life, so i had the gun and i pointed at him and tried to shoot him. >> reporter: peterson's business partner was shot earlier. peterson's wife says he was in the middle of a divorce and facing financial problems the detectives swarmed justin bieber's southern california mansion looking for evidence in an egg throwing incident that caused about $20,000 in damage to a neighbor's home. they knew they wouldn't find any smoking eggs, so to speak, but they were looking for surveillance video or any other evidence that might shed light on the incident. what they did find was a guest of bieber's, who they arrested for felony drug possession. >> he was staying in a bedroom when we came in. and that's where the drugs were located in plain view. i believe it's xanax and ecstasy. >> bieber's friend was released from jail overnight. police say during the raid bieber was home and did cooperate with detectives, but they did not question him. if he is charged in the egg throwing case, it would be a felony. a coast guard helicopter rescued four people off the coast of virginia from their

disabled sailboat. they were traveling from new york to the british virgin islands when they lost control of their boat. the coast guard jayhawk safely hoisted them one by one from the 42-foot boat. none of them suffered any injuries. a federal judge has dealt a blow to the nfl's proposed $765 million settlement with 20,000 retired players. that money was to settle claims that sustaining hits while playing led to serious long-term brain injuries, but yesterday, that judge denied approval of the plan questioning if it includes enough money. >> $750 million sounds like a lot, but in reality it might not be enough to cover these players then their families, not just now but for the decades to come. >> and the money from the proposed settlement is supposed to last at least 65 years. the nfl says it is both fair and adequate. the judge asked to see more financial data about the deal before scheduling a hearing about it. if you were on social media last night, you may have noticed arkansas and kentucky trending.

parking lot at the investigation is in the sixth hour. a man stayed at the executive inn hotel. last night at 10:30 he heard arguing and a pop, pop, pop, pop. officers and paramedics arrived after that. they found the victim lying in the parking lot with a gunshot wound, a man in his early to mid-20's. >> officers arrived. there are hysterical people in the parking lot and the victim was in the parking lot deceased shortly after that. >> lieutenant said they talked with people staying in the hotel to get as much information as possible. they are allowed to stay in their rooms. they are working on limited information describing the suspect vehicle as "dark sedan." homicides are rare in milpitas the first in 2014 with only one homicide all
