east bay and diablo range until 8:00 this morning. the air will be very warm and top out temperatures in the low to mid-70s. look for the san francisco, oakland, san jose all possible record highs today, even at 78 in santa cruz and cloverdale. let's find out if you'll be hot under the collar because of traffic. >> so far everyone is keeping their cool, mike, because it is quiet out there. we don't have any reports of accidents. one report of an injured deer on 280 in woodside. looks like that is no longer there. pretty much we have open roadways and construction pretty much every where across the bay area is wrapping up. what we have is traffic over the altamont pass. 38 miles per hour as you make your way from tracy. 51 miles per hour. not too shabby. it clears up nicely as you continues in that westbound direction. here's a look at walnut creek.

nice clear commute there. it's 5:01. developing news from the south bay. people living in downtown san jose breathing easier after police arrested a suspected arsonist believed to have started more than a dozen fires in a week. abc 7 news reporter katie marzullo has more. >> reporter: police have arrested a suspected arsonist suspected in serial arsons going on here responsible for this and 12 other fires. it comes one week after the first fire and investigators believe the man in this surveillance video was this guy. this video of him pacing in front of the targets. police also created a sketch and distributed it to some 3,000 people in the area but we don't know how this arrest came to be if either individual orsketch played a role in it. the covert response unit made the arrest after 8:00 last

night. they have not identified the person to us, still talking with him, still investigate jog overnight but we're told they will reveal more information this morning around 10:00 this morning. in addition to the house on east st. john's street one of the fires burned a classroom at a church. this has been a very trying week for residents in this area of san jose. they've been on edge. they have been leaving their porch lights on. hopefully this arrest will give them some peace of mind. our time is 5:03. developing news. firefighters contained a brush fire burning near the san mateo county coast. it broke out around highway 85 three miles from san gregorio. the fire broke out around 9:00 last night burning eucalyptus trees. ten homes were evacuated. breaking news overnight a teen is being treated for

serious burns this morning after catching on fire at a concord b.a.r.t. station parking lot last night. emergency crews airlifted him from the scene. b.a.r.t. police say the teen was working on a car earlier and accidentally spilled gasoline on himself. then elite a cigarette after he had been dropped off at the b.a.r.t. parking lot. his clothes caught fire. we'll have a live report from the scene in the next half hour. a deadly fire in newark. fire officials say a man died after a house fire. it broke out around 9:40 last night. fire crews had it under control in about ten minutes. an elderly man inside the house was taken to hospital but did not survive. it appears the fire started in the kitchen. no word yet on the man's identity. >> fire raced through a home and jumped to the house next door in palo alto. a viewer captured this video with a cell phone around 4:30

yesterday afternoon. those popping sounds were propane tanks exploded. a portable heater ignited the propane tanks. it damaged the adjoining house. santa rosa police are trying to determine what cause ad car to burst into flames with a body inside. investigators say they haven't been able to determine if the person in the car committed suicide or was a homicide victim. it happened in the parking lot of the place to play sports complex on west 3rd street just before 4:00 p.m. officials say the body was so badly burned they have not determined whether it was a man or a woman inside. it's 5:05 now. the flu has now killed three more people in the bay area. the total number of cases in the bay area and santa cruz county is now 21. napa county has confirmed its first flu death. a second was reported in contra

costa county. h1n1 is the predominant flu this season. gate flu shot and wash your hands often. centers for disease control and prevention has information where you can get a flu shot. we posted a link on our website. look under see it on tv. a man who was shot by an off duty san francisco police officer is due to be arraigned today on felony assault charges. it happened sunday morning at a chevron station on bayshore boulevard and gerald avenue. police sergeant says the female officer fired in self-defense when the man punched her in the face after a fender bender on interstate 280. an off duty firefighter who witnessed the accident followed the two cars to the gas station. he also says the other driver punched the sergeant before she shot him. 5:06. the u.s. circuit court of appeals ruled the federal government has a right to enforce its zero tolerance of state medical marijuana dispen

dispensaries. they argue pot can be used as medicine with a dock tears recommendation and shielded them from criminal charges and government lawsuits. but the three judge panel ruled the u.s. constitution bars the dispensaries from using the state law saying it did not apply in a matter such as this. new this morning people in southern california are a bit on edge after a string of small quakes leading up to tomorrow's 20th anniversary of the northridge quake. two small quakes in the area last night a 3.2 hit just before 2:00 this morning. 2.8 in orange county around 11:40. tuesday night a 4.4 quake rattled the los angeles area. ferrari riders will have to start paying for parking at the larkspur terminal lot. on february 3rd customers have

napolitano who was secretary of homeland security will return to the white house for the summit hosted by president obama and the first lady. it's designed to address how to improve access for low-income students. cost have doubled at uc before napolitano took over as president last fall. napolitano says she will talk about what uc is doing now to help low-income students and nuns new commitments. >> dozen of jc penney stores will be closing soon and hershey is take on a new product. >> reporter: good morning. topping america's money cost-cutting at jc penney. the troubled retailer is cutting 2,000 jobs and closing 33 of its stores. it's seen as penny's latest effort to return to profitability. the number of homes that entered the foreclosure process last year declined from 2012. the 747,000 homes that began foreclosure proceedings is the lowest number in six years. and there's word that chuck e.

cheese has been sold. the successful child friendly franchise started up during the 1970s. pizza hut begins offering what it's calling lighter more airy versions of its hand tossed pizza today. the company says you might see some imperfections because the idea is to make sure the pizza appear more authentic. it's 5:15. parents hit with hundreds of dollars in unexpected charges when their kids bought virtual pet food, gems or other items while playing games on mobile device. the ftc says apple will refund $32 million. apple didn't make it clear that parents were buying something when they entered their passwords on certain game apps. apple is promising to upgrade its billing practice to make it obvious you're being charged. a hayward church faces major

repairs after a driver crashed through its walls and landed on the altar. this picture was taken shortly after an elderly woman smashed through the church. nobody was hurt. the church organ not so lucky, the car smashed it to bits. >> there was an organ there. she hit the organ that slowed her down and her car was half on the stage. the 81-year-old driver told police she hit the gas pedal instead of the brakes. the hayward woman was cited for speeding. the church will hold services elsewhere while it rebuilds. the food pantry will continue to operate and still accepting donations. happening today san francisco's board of supervisors will honor two employees who rescued a puppy. remember the gem the poodle puppy found last month among the bottles, cans and other

recyclables. greg fost certificate one of the employees who will be honored tonight. he saw the puppy moving on the conveyor line and stopped the line immediately. gem will be available for adoption once she's recovered from bite marks and other injuries. the mayors of san francisco and seattle are upping the ante in their friendly playoff wager. both cities agree to give the winner home made ice cream and chocolates. mayor ed lee countered and got a prompt response from seattle's mayor. >> i want to give the 12th man up there maybe the left field bloody mary mix. >> they will need it after the celebration. >> you know, it's bloody mary mix. you got to add the other stuff.

anyway, let's talk about the weather and the records that will fall. so warm, so dry. >> is a lot different than seattle. they will be 30 degrees cooler. in the 40s up there for the game. time with rain coming in towards the fourth quarter. our big story still red flag fire warning hanging around until 8:00 this morning for the east bay hills where you see in red the winds are up high enough that we still have some fire concerns. most of the country is pretty quiet. you see a little bit of snow moving through the midwest. and heading in to the ohio river valley. a little bit of it moving into northeast. otherwise a pretty dry pattern for most of the country right now but definitely seeing the coolest of the weather. coming across the golden gate bridge, 56 when you get into christie field and organization beach. downtown is the only spot not in the 50s at 48 and if you're coming through the ferry building 55 degrees. walking from the ferry building

to the financial district you'll notice a drop in temperature. 31 in american canyon. enough moisture in the ground in fairfield we may see frost. 54 in richmond. 35 in walnut creek. pleasanton 73. half moon bay 68 degrees. wow i wonder how it is sleeping at half moon bay when it's 69 in january. we have gusts around 20 to 25 miles per hour. sunny, warm and calmer. record highs possible but because of this the fire danger will start to wane. it won't go away completely because it's so dry. our extended period no changes. still very dry. let's take a look where we're going to have records down south. san jose at 73. gel roy 76. warm spot again santa cruz, 78. your all-time record high for january is about 83 degrees.

mountain view 73. redwood city 73. throw mid-70s through most of the north bay valleys. low to mid-70s along the east bay shore with oakland 73. inland we have 69 at brentwood low to mid-70s elsewhere. tonight's temperatures all over to scale 30s inland to 40s along the bay to 50s along the coast and into san francisco. has much changed since you were asleep? not really. this trough will get closer and that's brings us the high clouds saturday and sunday but not close enough for rain. temperatures will taper into the 60s across the board by tuesday and wednesday of next week. have a great day. >> we have a couple of accidents as we head into the east bay. first one on 680 southbound side as you come up to monument boulevard. it looks like it's over to the shoulders. not blocking any lanes.

5:24. here are seven things to know today. number one, developing news. firefighters have contained a brush fire burning near the san mateo county coast. it broke out along highway 84 near san gregorio. crews got it under control around 1:00 this morning. no homes were damaged. number two san jose police say they made an arrest in a series of arsons, a dozen fires set in less than a week. officials say they arrest ad man shortly after 8:00 last night and abc 7 news reporter, katie marzullo is live in san jose. number three, police in indiana are investigating why a man walked into a grocery store and shot and killed two women last night. police say one woman was an employee, the other was a customer. police say officer had to shoot the gunman who was pointing his gun at a third person when police got there. number four authorities have recovered the bodies of a

and at 5:29 we're eight minutes away from the nomination for the 86th academy awards. you're looking live at the samuel goldwyn theater. good morning i'm eric thomas. we have developing news overnight in san mateo county where firefighters got the upper hand on a brush fire and contained it early this morning. the fire broke out shortly before 9:00 last night in a rural part of the county in r san gregorio near highway 84. you could see the flames here. cal fire says it quickly spread into eucalyptus trees and raced up a mountain side threatening homes on the other side of the ridge. ten of those homes were evacuated. good news is the winds died down and the flames were not able to pick up. firefighters had the four acre blaze contained around 1:00 this morning. no structures burned no injuries were reported.

mike has more on the winds and the temperatures today. >> thanks very much. the fact we still have that red flag fire warning, high fire danger for the east bay hills, gusting to 37 miles per hour right now. the diablo range up in the north bay mountains gusting 20 to 30 miles per hour. hopefully those winds will start relaxing around 8:00. the fire danger will lessen. you can see blowing now. record highs, sunshine upper 60s to mid-70s. the coast we're in the low to mid-70s. leyla? >> two accidents linger on 680 and 580 southbound side of 680 manhattan. involving two vehicles over to the shoulder. right now you're looking at a nine minute commute to head out of concord to walnut creek. as we jump down into dublin, outside of 580 at hacienda drive. now the westbound traffic building especially as you approach the dublin interchange. as we take a peek at the toll

plaza on the bay bridge starting to load up. extra cars funneling in from the main. it's just about 5:32. developing news. san jose police say they've arrested an arson suspect who is believed to have been involved in more than a dozen fires that were set within days of each other. officials say the department's covert response unit arrest ad man shortly after 8:00 last night. police are not releasing the suspect's name or any other information. they are holding a news conference this morning at 10:00 to provide details. abc 7 news reporter katie marzullo is in san jose and will have a live report for us at the top of the hour. breaking news overnight, a teen is waking up in the burn unit of a bay area hospital following a bizarre accident in the parking lot of an east bay b.a.r.t. station. amy has the details for us. >> reporter: freak accident that caught him on fire. it happened here in the passenger loading zone here at

the concord b.a.r.t. station. a barj was in the car. there were others in the car. they don't know at this point how many. the teenager had been working on a car earlier in this night so he had gas on him. well, officer say someone in that car lit a cigarette. and the spark from the lighter caught the vapors on his clothing on fire. so his clothing ignited. he was on fire. the teen suffered burns to his arms and his chest. this happened at about 11:35 last night. he was airlifted out of here. they were so worried about him that they flew him over to the hospital. the police do tell me this morning it looks like he's going to be okay. they say his injuries are not life threatening but he does have burns to his arms and his chest. reporting live in concord, amy hollyfield abc news. >> new this morning oakland police are investigating a fatal shooting. officers found a man in the street near 14th avenue and east

21st street after being alerted this morning. he was shot in the head and pronounced dead at the scene. police have not released any suspect information. members of the u.s. chemical safety board decided to send a report on the 2012 richmond refinery fire back for modifications before voting on it. board held a hearing on the staff report last night in the richmond city council chambers. a huge fire at the chevron refinery two years ago sent thousands of people to hospitals complaining of breathing problems. this new report is expected to recommend tougher state regulations, requiring refineries to show that they operate safely and working proactively to fix problems. one member says more immediate remedies are needed. the staff was given up to four months to modify their recommendations. ac transit has launched an investigation into an incident caught on tape showing a bus driver denying access to a

disabled man. it happened in san leandro. the video was posted on youtube on friday. the bus driver says there's no room but the man protests. minutes later lift is deployed. ac transit responded in a post on youtube reading quote, for safety sake there are reasons why the bus operator may have refused this wheelchair passenger. ac transit says the driver is being interviewed and the video is being reviewed. happening today, a severe water shortage is forcing marin county to tap one much its stands by revoyeurs. the marin municipal with your district will pump water out of phoenix lake. it's one of its two reservoirs. it was done briefly two years ago during a dry spell but hasn't been used as a water supply 30 years. if water levels don't improve by april marin may impose rationing

for the first time since 1991. right now they are asking for voluntary conservation. very dry. >> going to be that way for a very long time. climate prediction center happens to do most of the medium and long range forecasting. they say we have equal chances of moisture coming in at average levels the rest of winter. but just looking at the pattern at least the next two weeks i don't see any rain coming in. that means we have to make it up in february and march and that's the only hope we have. next 12 hours we're starting in the 30s. 60s along the coast this morning. all of us will be in the 60s. warm. nice day to sit outside and enjoy the sunshine and temperatures in the low to mid-60s. peak in the 70s during the afternoon hours and fall back into the you upper 60s at 4:00. we'll set some records by the time we get to 4:00. floyd 50 fz you have any evening festivities. i've seen a lot of kids out playing basketball, practicing already. let's take a look at the three

day forecast. low 70s tomorrow. another chance of records. records may be less likely this weekend. stay above average. mid-70s to 70 degrees. if we keep our report in the san francisco area along the peninsula we have a report here of a stalled vehicle and some construction. so first let's take a look at the peninsula. highway 84 from el camino, lanes will be blocked until 6:00. south san francisco, southbound along 280 as you start making that trek towards daley city, a stalled vehicle there. some slowing us a 0 approach it. one lane blocked could cause a little bit of a delay. 680 walnut creek to dublin, 13 minute commute. 101 southbound from santa rosa in san francisco, 49 minutes. and highway 17 through the santa cruz mountains right up to the cats 22 minutes will get threw. this is a live picture coming away from sausalito.
