also, lots of news to get to as well. we'll is latest now on that breaking story. the 34 officers responsible for watching over our nation's most powerful nuclear arsenal, removed from duty after accusations of drug use. pierre thomas will be with us. we'll get to the headlines out of the oscar nominations revealed this morning. chris con elle has been tracking it all. good morning, chris. some big surprises, some unexpected snubs and lot of mcconaughey and several films snatching a fistful of nominations as the race for oscar now begins. we are pleased to announce that the film selected as the best picture nominees for 2013 are -- >> "american hustle". >> no surprise, the party is on for "american hustle" with ten nominations, jennifer lawrence, amy adams and christian bale and of course best picture.

share it. i think, you know, it's really affecting a lot of people in film. >> going to lincoln, it's the last thing i do. i don't care what you people think. >> reporter: not to be outdone, 77-year-old bruce stern for "nebraska" which received six nominations, including for director alexander payne. >> any kind of boos? >> no. >> "wolf of wall street" and jonah hill and leonardo dicaprio. and meryl streep and julia roberts winning recognition for their role in "august: osage county." >> mom, please, this is important. >> eat your fish, eat your fish, eat your fish. all right. surprisingly passed over in today's nominations, oprah winfrey and emma thompson. i guess there's only room for so many. we'll find out who wins on march 2nd. for now, let the race begin.

josh? >> chris, thank you. of course we'll hear more from matthew mcconaughey and we'll be joined by jared leto. his costar and fellow nominee for their roles in "dallas buyers club". also, we'll break now for those breaking news overnight on that shooting at a supermarket in indiana. the gunman was pointing his weapon to the third person before police intervened. abc's alex perez as the latest. good morning, alex. >> shots were fired. everyone was evacuated. >> reporter: this morning, witnesses describing the pure horror that unfolded inside this elkhart, indiana grocery store late monday night. >> you're thinking of your kids safety, your safety. >> it's a huge crime scene. the area where the shootings happened in the store are

basically from one end of the store to the next. there were several rounds fired in there. >> reporter: police say a man in his 20s entered martin's supermarket at around 10:00 p.m. he shot and killed a female employee, who appears to be in her late teens or early 20s before walking across the store and killing a shopper, apparently in her 40s. the women were found 12 aisles apart. police say the gunman was pointing a semiautomatic handgun at the third person's head when they arrived and they killed him before he was able to shoot again. >> thankfully the officers were able to respond fairly quickly. >> reporter: police describe the suspect as a white male in his 20s who lives in the area carrying a semiautomatic handgun and large knife was also found near his body. his motive and possible connection to martin's grocery store unknown at this time. while the victims he targeted do appear random, police say there are still plenty of questions to answer. >> we haven't really drawn any conclusions or anything out of it at this point. we do have a lot of things to look at as far as video surveillance. >> reporter: the store has video surveillance cameras and they're hoping that will help them figure out what may have

motivated the gunman to open fire. josh? >> alex, thanks for that. we turn to the escalating scandal rocking the air force. 34 officers in charge of our nuclear missiles implicated in the cheating investigation and abc's pierre thomas now has the latest on something of a disturbingly familiar trend here in washington. pierre, good morning. >> reporter: good morning, josh. that's right. today we have more deeply disturbing news about the people responsible for the most dangerous weapons on the planet. their job, to watch over the nation's most powerful nuclear missiles. destructive force capable of laying waste to whole cities. now, this morning accusations of drug use, potentially widespread cheating on the training tests by some of the air force officers responsible for launching those missiles. >> this is absolutely unacceptable behavior. >> reporter: a development so serious that the air force's top two officials came to the pentagon briefing room for a hastily arranged press conference. >> it is completely contrary to

our core values. >> reporter: 34 officers have been removed from duty at a montana air force base after 17 allegedly cheated on a recertification test and the rest failed to report the scandal. as a result, every officer in the nation's missile launch program, all 600 of them, are being retested. >> this is terribly important because there is no room for mistakes with nuclear weapons. >> reporter: the cheating scandal comes just a week after three launch officers were accused of recreational drug use, the troubles part of a disturbing pattern. a top commander was fired last october after allegedly drinking so much on a visit to moscow, he needed assistance standing. in 2007 four top ranking air force commanders were relieved of duty after a huge oversight left six live nuclear warheads attached to a b-52 bomber flown from north dakota to louisiana and not discovered for 36 hours. this morning, the air force is vowing to root out anyone cutting corners and they

maintain the arsenal is in safe hands. robin, josh. >> again, i know you'll be staying on that story for us, pierre, thank you for that. we turn to amy robach in with today's other news headlines. amy? we begin with new openness from the catholic church for the first time the vatican is testifying in public about child sex abuse. right now top officials being questioned by the united nations over allegations the church enabled thousands of children to be abused by protecting pedophile priests. today a leading bishop admitted there is no excuse for sexual abuse and the vatican welcomes any suggestions to help promote children's rights. new video emerged of bowe bergdahl. the american soldier held captive for nearly five years. military officials say the army sergeant looks to be in worse health than before who have seen the video. they believe he is being held by the taliban in pakistan. a bipartisan senate investigation spreading the blame for the attack on the u.s. consulate in benghazi saying the state department military and intelligence community are all

at fault for missing warning signs. it also points out that ambassador chris stevens who died in the attack refused to accept extra security on two occasions. well, apple has agreed to refund $32 million to unsuspecting parents whose kids racked up huge bills. while playing games on mobile devices. the ftc says that apple failed to tell parents that entering their password actually started a clock during which their kids could buy unlimited extras without parental consent. maybe this isn't a surprise. it wasn't one to me. some kids spent $500 in 15 minutes. it's that easy. down under this morning the temperature hit 109 degrees at the australian open. wow, maria sharapova actually endured three hours in the blazing sun finally before winning three sets and then taking a full body ice bath. officials had to stop all other action due to the heat. look at that. >> yeah. well, a new record in the big leagues. largest salary ever.

dodger's picture clayton kerr shaw has agreed, it was a tough decision i'm sure, agreed to a seven-year deal that will make him the first player to earn $30 million per year. you're clapping, josh. >> that's a slow clap. the man earned every penny. >> oh, sure. >> welcome back, clayton. >> a good one, cars these days will do all sorts of thing, some even allegedly park themselves. but apparently those self-parking features can malfunction. that's what happened according to the driver of this bmw in florida. he says his car drove over an island. you can see where it ended up in the parking lot at target. bmw says its parking assist feature is only for parallel parking and the driver has to control speed. why do you need help pulling into a parking space in target? i don't know. oh, well, you can see what happened. >> yes, we can. >> warning. >> thanks so much, amy. now to a city on edge. san jose, california, where authorities say a serial

arsonist has set over ten fires since last wednesday. overnight, police arrested a suspect in the case and abc's john muller has the latest. >> reporter: take a look at this extraordinary surveillance video of a serial arsonist setting fire to a home in san jose, california, where a family is asleep inside. he enters the porch, pulls a container and a lighter from his pants, tries to set a chair on fire and comes back three times before he is successful and the fire is roaring. fortunately, several men driving by saw the flames, called 911 and used a garden hose to put out the fire. the homeowner says he's lucky to be alive and calls the act infuriating. >> i'm sitting here watching this and this is me and where i live and not only my house but 12 other that we know of. >> reporter: overnight authorities in san jose say they have arrested a man who fits their person of interest but have not released any details on this man who has put an entire city on edge setting at least 11

blazes since last wednesday. his target, old houses, a warehouse, this church has been hit twice. the damage, $70,000. >> people should not be living in fear. >> when you see the destruction here, what do you want to say to the arsonist? >> stop. stop this craziness. >> reporter: police are expected to release details of the arrest this morning but for now san jose's nightmare appears to be over. for "good morning america," john muller, abc news, new york. >> thank you, john. we're going to turn now to what some would have you believe is growing panic for patriots fans. star quarterback, tom brady, missing practice on wednesday. now, just days before the big showdown against the denver broncos. for a chance to play in super bowl xlviii. the team is saying he's sick but not a whole lot else. boy is that new. gio benitez with the latest. good morning. >> reporter: we are investigating this.

good morning to you. the question right now, where in the world is tom brady? he had said last week he had a cold. this week disappeared at practice and fans, they're worried. it's the quarterback clash that everyone has been waiting for. the winner goes on to the super bowl. tom brady versus peyton manning but will it even happen? brady's playoff participation now up in the air after the new england patriots' star quarterback missed practice wednesday for the first time all season. we're told brady arrived at the stadium and then went home sick. but head coach bill belichick wouldn't say much more. >> i know you would love that but i'm not doing that. >> it's typical of him to play it close to the vest. he would not speculate about his availability on sunday nor would he address specifically brady's health. >> reporter: the $57 million man's mystery illness sparking talk on the airwaves. >> it's a big enough deal that he didn't practice during championship week. >> reporter: sending anxious patriots fans into a panic on social media. some playfully urging his wife

gisele to nurse him back to health. should fans brace themselves for a brady-less game day? the backup quarterback ryan mallett has his cleats ready just in case. >> i was playing payton today and mallette today. that's how i treated it. >> reporter: there is a ray of hope for pats fans. brady was so sick before the 2005 afc championship game that he needed iv fluids but he still played. >> that didn't force him to miss the game. he's not going to miss this one in denver. >> reporter: as for sunday's game, brady could announce his plans at a press conference friday. his team flies out to denver later that day with or without him. by the way, that 2005 game when he was really sick, brady helped the patriots win, 41-27. and while the team isn't saying anything about his illness, the practice report also says brady has an injured right shoulder so let's just hope he gets better soon. >> practice report said that virtually every week for his entire career.

popular original series on netflix, "house of cards" and "orange is the new black" and popular shows like "arrested development" may cost you a whole lot more. here's why. until now those internet providers like verizon, at&t and time warner had to treat everything on the web equally no matter how much bandwidth it used so whether streaming your favorite cat videos or checking e-mails, the cost was all the same but this week's court decision changes that and says verizon and many other internet providers can charge a company like netflix a whole lot more because netflix is streaming much bigger files like tv shows and movies, some analysts now estimating netflix could be charged as much as $75 million to $100 million additional dollars and who do you think may ultimately pay that hefty price? >> everything that the courts will decide will trickle down to you. it might mean you're paying for internet in an entirely different way. >> reporter: in a statement verizon who brought the suit says the decision will allow more room for innovation and consumers will have more choices to determine for themselves how

they are surprised the man found dead geoffrey farrar was said to have mentored for two decades a 31-year-old now accused of killing him. geoffrey farrar loved scaling these rocks at maryland's carderock park so much he even earned a nickname. >> people would call him carderock geoff. >> reporter: little did he know he would spend his final moments there. the 69-year-old found dead at the rock's base after climbing with three friends including the man he mentored for 20 years, david dipaolo. at first many thought it was an accident. >> we had an operating on the assumption that it was an accident just doing something that he loved. >> reporter: but now police say it was manslaughter. according authorities farrar and dipaolo were seen arguing right before the climb. their two companions said they went to the top of the rock face but looking over the edge they see no one. when they walk to the bottom they see 31-year-old dipaolo running up the trail and farrar

lying nearby next to a wooden beam bleeding from the head. his injuries were not consistent with the fall but more in line with a blow from a claw hammer found nearby on the ground. >> i can't imagine anyone needing to use a claw hammer for any rock climbing purpose out here. >> reporter: dipaolo fled the scene. more than a week later police say he admitted he did hit his friend farrar with a climbing tool but claims it was in self-defense. according to court documents, he says farrar tried to choke him fearing he was losing consciousness he whacked farrar in the head. the court documents say he later told police, i'm sorry this happened. i didn't want it to happen. i didn't know it was going to happen. authorities say david dipaolo was arrested near glen falls, new york, he's agreed to return to maryland to stand trial. >> sad. all right, reena, thank you very much. we turn to courtney love learning perhaps the hard way that what you say on twitter can land you in court. she's been charged with

defamation in the very first liable trial involving twitter. that particular social medium and nick watt has the latest on this groundbreaking case. ♪ >> reporter: courtney love is a lot of thing, guitar goddess. rock 'n' roll rascal and widow of kurt cobain, arguably the greatest grunger of them all. but did you ever think she might be responsible for the advance of jurisprudence in this great land. >> the courtney love twitter lawsuit is monumental because the judge has now determined that tweeting in california can potentially give rise to liability under the theory of defamation. >> reporter: because for the first time a twitter war has wound up in court. love is in the dark. libel is the charge or twibel as it's been dubbed. >> reporter: the courtney love case will now set a precedent that will result in the average private person being liable as

well. >> reporter: in this 2010 tweet she suggested her lawyer rhonda holmes had been bought off when she wouldn't help love in a legal battle with the managers of the late cobain's estate. love claims it was merely an opinion, that the internet is full of high personably and exaggeration and thought she was only tweeting it to two people, not to the world. this case could rewrite the rules of the much loved celebrity twitter war, you know, like miley cyrus victoria sinead o'connor, demi lovato berating prix rest hilton and george lopez calls kirstie alley overweight and kirstie calling george an alcoholic. >> don't tweet when you're highly emotional. don't tweet when you're under the influence of any alcohol or drug. >> reporter: sound advice for us all. meanwhile, the love trial continues. for "good morning america," nick watt, abc news, los angeles. >> all right, for more on this we turn to abc's chief legal

affairs anchor dan abrams. dan, we saw the case as it's laid out now. what does it hinge on for you. >> it things primarily, i think, on the question of is in an opinion or fact? this is standard libel law. in any libel case, there's a big question which is in this case, when she said that her lawyer was bought off, is that her just saying, i think my lawyer was probably bought off or is she literally stating a fact which is, i think my lawyer was paid to do something? if it's a fact, then she could be in trouble. if it's opinion, then she's protected. >> the internet and particularly social media seem at times very cast as an electronic wild west where, you know, perhaps we can do what we want in a lawless place but is this potentially precedent-setting. >> that's what she argued. the same standards shouldn't apply to twitter as applies to something that's been reviewed for weeks in a magazine, et cetera. how can awe ply the same legal standards she argued.

good morning. i'm eric thomas. in san jose, police say they've arrested an arsonist and plan to talk about it at a scheduled news conference this morning. volunteers distributed a composite sketch of the suspect developed by police from surveillance video in the downtown area. they arrested a man shortly after 8:00 last night. is he suspected of setting more than a dozen fires within days of each other this month. let's see how the thursday morning drive is going. ley leyla? >> eric, we do have a problem as you approach marsh road in the northbound direction. we have a two-car crash there, blocking at least one lane with one car that has spun out of control. southbound side, though, we do see plenty of bumper-to bumper traffic as you make the approach

♪ so many worthy nominees awoken with great news this morning. we spoke to two of them. the stars of "dallas buyers club" on the phone. jared leto. and matthew mcconaughey. let's take a look. jared leto, on the phone, just nominated for best supporting actor for his role in "dallas buyers club." jared, tell us what it was like. this is your first nomination. first of all, congratulations and how were you told about your nod? >> like everyone else probably awoken from sleep. yesterday i was on jury duty and told i got nominated.

only in america. >> only in america. >> i have to believe the judge will give you a pass today if you don't make it, jared. jared, you know, you disappear into the roles and this one was quite one to disappear into. what did this role specifically mean to you? >> it was the role of a life time. i hadn't made a film in almost six years and i read the script and fell in love. >> how gratified is it for everybody, jared, knowing how long it took to bring this to fruition? it took a lot of years, and a lot of people believing in this. >> it did. it took about 20 years to get this film made. that tiny little thing cost like $4 million. it's a testament to the hard work and passion of the people, the film makers. >> you poured yourself into your music career. why was this the film and this the role that brought you back to the big screen? >> well, you know, four of the past six years we've been
