live from the kgo-tv broadcast center this is abc7 news. >> he was a 23-year veteran with the department in charge of detective unit. >> the police chief holds a police conference on a shooting that killed sergeant tom smith in the line of duty describing him as an officer and a family man, the first killed in the 42-year history of the transit police department. >> the news conference is shedding new light on the life and work of the bart police officer accidentally killed by a

colleague. >> we have coverage and matt keller is at the apartment where the shooting happened in dublin. first though, to amy hollyfield at bart headquarters. amy? >> yes, it was a somber press conference with the bart police chief choking up several times. the department did release a new picture we want to show you of sergeant tom smith killed while serving a search warrant yesterday afternoon in dublin. the chief described him as having a can-do attitude and was a happy family man. he leaves behind a wife and daughter we have if you details about what happened at the apartment yesterday. there were a total of eight officers there, five detectives from the bart police department and two uniformed officers from bart police and an officer from alameda county sheriff. the sergeant who was shot was wearing plain clothes. the chief said his officers are trained to do these searches but going into someone's home he says is one of the most

dangerous things they do. >> we are in shock. disbelief. numb. we are grieveing. please give us some time. >> the chief said they were there to recover stolen goods. they were looking for things including a laptop and a laptop bag the chief says that the officers did know that the suspect was already in custody but they did not know for sure there that apartment was empty. the door was unlocked. they went in they had guns drawn and thought possibly someone could be in. they have not said why he was shot. that is still part of the investigation. they still need to come up with a timeline and republican -- reenactment. they will not release the name of the officer who shot sergeant smith until next week. the chief wants to give him time to grieve. he met with the store last night

and says he is terribly upset. >> amy, thank you. the 42-year-old officer is survived by his wife, kelly smith, who also is a bart police officer. the couple has a six-year-old daughter lives in san ramon. a memorial is growing (o) line if sergeant smith and a number of facebook friends changed profile pictures in the hours after the shooting to the image you see on many accounts, the thin blue line representing fallen police officers around the world. >> bart police say the man whose apartment was searched in dublin is a suspect in several robberies on bart property and he was already in custody. matt keller is at the scene where people are wondering what happened and why. matt? >> it is quiet here this morning as the apartments in dublin. the investigators are gone. the feelings are still the same. people are wandering what happened and why. >> the front door to the

apartment in dublin looks like every other door but what happened inside yesterday was unusual and tragic, investigators swarm the area after sergeant tom smith was accidentally shot and killed by another bart police officer while conducting a search of an apartment of a robbery suspect. daniel lives in the complex. >> i didn't hear anything to do with the gunshots. what i heard was the police cars arriving the i heard the commotion. i live above the unit where it happened. i heard the helicopters. when i came outside i was totally surprised to see this place taped off. >> he said the young man who lives this the apartment is friendly and polite and has lived in the complex for a while. >> just a regular kid. just in and out. i don't think he drove. he always walked. he lives with his mom, i think. he would say hi and that was it. >> law enforcement community and other government agencies are honoring sergeant tom smith. flags are at half staff at fire

stations, c.h.p. headquarters and the county jail. bart riders were offering condolences. >> a very sad thing for both families, the fern who -- the person who accidentally shop him and, obviously, the victim. just a very sad anyone. >> people we spoke with have questions especially for bart police, wondering how this could happen the. >> every shooting seems to be an accident or not intentional and i think these -- i'm for the police but if they can't handle their guns, maybe they need another type of weapon. >> the governor announced flags are then at half staff at the state capital in honor of sergeant smith. funeral arrangements have nut been -- not been announced. there was a short solemn procession as the body of tom smith was moved out of the medical center in castro valley.

check. the university president told students the incident may have been a machinery backfire. >> a soldier born and raised in salinas was killed in his third tour of duty in afghanistan. the department of defense says 43-year-old army chief warrant officer died when the outposts with attacked by insurgents in kandahar province on monday. his family said he dreamed of retiring in hawaii this four years where he cannily wife -- where he and his wife own a home. >> in has been a second c.h.p. shooting within 24 hours when a suspect was killed last night around 9:00 near bancroft avenue. officers say it happened as the chase with an s.u.v. came to an end. one of the passengers tried to run and flashed a gun at the officer who shot and killed the passenger. investigators say a loaded gun was fund and the driver of the s.u.v. took off, police are looking for that driver and other passengers. early tuesday morning, the c.h.p. also shot and killed a man they say was driving a

stolen car and sent them on a short chase before running off with a leaded gun. >> health officials are reporting two more flu degrees in the area, a total of 25 people have now died from the flu this season in the bay area and santa cruz county, the latest victims include a person in san francisco. that brings the city total to two. the other new flu victim is in sonoma bringing that county's total to four. there will be more details later today. >> this winter warm-up is leading to another red-flag warning and mike nicco joins us outside the studio to tell us when the danger period begins. >> we have time to get ready, to build the perimeter around your house or belongings. as far as humidity, we know the ground is dry, the air is getting dryer as the northeast winds develop, santa rosa is 32 percent and napa is 33 percent, we expect that to go up at note but with the dry down sloping

northern wind, they will not recover and the winds are gusting from 15 to 21 miles per hour and will pick up from 30 to 35 miles per hour tonight and we have the high fire danger from 10:00 in evening through 3:00 tomorrow afternoon for the north bay mountains above 1,000' up to the lake county, mendocino county under a fire weather watch and the fire conditions are not so high there. we will have a warm seven-day forecast coming up. >> governor brown delivered the state of state address this morning painting a rosy picture of california's economy but, also, washes of the dangers posed by the drought. our news anchor reports. >> governor jerry brown used the start of his state of the state message to crow a little bit about the turn around from a huge budget deficit to a growing surplus. the former seminary student warned lawmakers not to blow it. boom and bust is our lot.

effective with those who suffer mental illness or drug addicted. >> observers believe the governor will try to use the accomplishments in the hunt for a second term. chico assembly man and chief republican whip stressed the water crisis in his response to the governor's address saying water needs to be the driest -- top priority, the biggest drought in 500 years in this area. we need proper allocation and use of water throughout the state. >> the central valley chicken processing plant shut down over sanitation issues has re-opened. foster farms resumed operations in livingston this morning after closing voluntarily for ten days and the federal government closed it for three days before that after finding cockroaches at the site. they have taken sanitation measures in and all employees are back at, on, the latest trouble at the plant.

>> in ukraine, third night of violence. two people have been killed. hundreds have been injured in intense clashes with police. right now, it is 9:00 at night in kiev. police stormed barricades filled with anti-government demonstrators in the central square. demonstrators have been rallying in the snowy streets sin the weekend. they are protesting new laws that criminalize and limit the right to protest. >> president obama is creating a task force to protect college students from sexual assault. the white house released a report which said one in five women have been sensually assaulted at college but only 12 percent of the victims report the assault. they have 90 days to come up with recommendations for colleges to prevent and respond to sexual assault and increase public awareness. the initiative wants to hold schools accountable if they do not confront the problem. the president has two daughters

stars and the community day open house. the hope is that a farewell concert with paul mccartney late in the summer or early fall. >> surfers around the world are holding their breath to find out if maverick surf competition takes off at half moon bay this weekend. in the last hour, organizers of the big wave competition posted on facebook that they should know by noon today whether mavericks will kickoff on friday. they watching it closely. conditions off the coast could be right for the daredevil contest but it could be too dangerous. 30,000 people are expected to pack half moon bay and 24 surfers from around the world, the best, will compete with the top prize $50,000. >> lots of danger but that is a lot of money. and bragging rights. >> the thrill of competition. mike nicco is looking for rain. >> coming up empty. short. not looking very good. i am still not finding rain in

briefly cooler tomorrow and friday with the cold front passing to the east and that is inducing the winds needed for the fire threat but the warm weather then comes back into the forecast. from sutro tower you can see the waves crashing on ocean beach this morning. 8 to 14 degrees warmer-than-average with sunsetting at 5:22. gilroy is 73, possibly record high. temperatures are warmer than yesterday but the record highs are harder to attain because a lot of them are in the mid-70's to even 80 in napa. we hit 7 in san jose and cupertino and the 80 is the record high. 72 at half moon bay, the warm spot, on the peninsula. and 68 in pacifica and 70 in redwood city and upper 60's sunset and downtown and south san francisco and low-to-mid 70's through the north bay valley and mid-to-upper 60's near water and upper 60's for the rest of the neighbors and upper 60's to near 70 in the east bay valley. we have 30's in the valley,
