though, northbound 101 up to the nimitz and we have diminished speed at 38 miles per hour. everything else is at top speed. this is the maze along i-80 tail lights pushing west to the tolls and remark is moving smoothly and accident free. >> the first ever wrongful death lawsuit against ondemand car service uber is going to be filed today. six year old sofia was struck and killed in san francisco on he eve while walking with her mother in a crosswalk. police arrested the 57-year-old syed muzzafar, a driver for uber. the company said he was not working at the time of the accident and has been dismissed. the lawyer says he was working for uber and was waiting for a fare. amy hollyfield will have more in a report in the next half hour. san jose state university police are warning females to be alert

after groping incidents. nick is on campus with the details. >> nick? >> good morning, i have been on campus all morning and as students start to arrive to set up for different activitied i had an opportunity to speak to some of young women to see if they heard of the assault and what they are doing. all have said they are moving with groups are on walking with a buddy. both assaults took place on campus saturday night. police say a woman was groped by a man on a bicycle before 7:00 p.m. outside the event and recreation center. the second happened near the hoover hall dormitory. the attacker appears to be a white man in his 20's with a mustache with a black hoodie of the many students learned of the assault by text message from the university. >> some get the t right away and owes get it hours later because they is so many things to text so i get the text immediately.

it is scary, if you walk by the center you could have been hurt. >> the text included wanting to avoid walking alone at night and you can always ask if a security escort by calling the campus police. we have a call to the police to see if there is a change to any security measures but the message is getting through to students and young people who have all said they know enough to walk with someone or walk with a group and let a friend know where they going. antioch police want a person who shot a man inside a van that aned outside a jack-in-the-box restaurant yesterday afternoon. witnesses say they heard several shots and the victim was known to a trauma center but police have not said what led to shooting. >> in the central valley this morning, the c.h.p. says that a suspected drunk driver is

responsible for a car crash that killed three sisters and left another sister hospitalized in delray 20 minutes south of fresno. investigators say the women were driving home from a contain san when a red van crashed into them. the suspected drunk driver, a man, is in the hospital with major injuries. the three sisters all died. the 67-year-old sister is in the hospital in fair condition. >> happening today in southern california, a group of students from the bay area and los angeles are headed to court. they are suing the state over laws on teacher tenure, seniority and other productions that the plaintiffs say keep bad teachers in class. the nine students are part of nonprofit organization called student matter with a nonjury trial in los angeles home to the biggest public school district in the united states. teachers unions are fighting back argue that the suit unfairly targets older teacher.

take alternate routes. >> new details in a virus outbreak sweeping through a cruise ship. the centers for disease control says it sickened 577 passengers and 49 crew members on a royal caribbean ship. they are making its way to new jersey and the company provided these pictures of the international explorer with passengers complaining of vomiting and other symptoms. officials for the centers for disease control boarded the ship over the weekend. it could take a few days to pinpoint the source. >> federal regulators will do a safety check on 400 boeing 767 airliners. the f.a.a. will focus on movable tail sections that could jam and possibly cause pilots to lose control of the plane. the mechanism is known as an elevator which causes the plane to climb and descend. the issue has not been identified as the cause of any

accidents but the hazard was first identified in 2000 when the f.a.a. ordered enhanced checks to identify problematic elevator mechanisms. >> president obama is getting ready for the state of the union address tomorrow and we are getting a preview of what to expect. the "wall street journal" reports that the president is expected to announce the largest employers have signed a pledge agreeing not to discriminate against the long-term unemployed when making hiring decisions. xerox and lockheed martin and bank of america have signed the pledge. two survivors of the boston marathon bombing and openly gay nba player and stanford graduate will be guested of the first lady when the president delivers the address to the state of the union. we will broadcast the president's state of union address and republican response tomorrow at 6:00 p.m.

year's eve involving a popular wide service in san francisco what killed a six-year-old girl. the victim's family will sue uber today. amy hollyfield is in san francisco with that story. amy? >> the lawsuit asked, who is responsible when an uber driver is involved in a crash? the victim in this crash city -- still has a memorial here if san francisco. this is where six-year-old was hit by an uber driver and killed. sofia was in the cross walk with her family when she was killed on new year's eve before her 7th birthday. police arrested the driver, syed muzzafar, who worked for uber car service the uber said he did not have a passenger at the time so he wasn't working but syed muzzafar attorney said he was looking for a fare at the time and they say he was working. the family attorney says that is the problem with uber, the drivers look down while looking for a spare at their phone saying and i quote, "the use of the uber app by drivers violates

california laws designed to eliminate driver distraction. drivers are constantly interacting with the mobile device creating a serious risk for both passenger and the country." uber has not responded to the lawsuit. the family attorney says uber has refused the insurance coverage of the driver because they say the driver wasn't working at the time and the family attorney says that the parents are very upset that uber is not taking responsibility in the accident and wants to hold uber accountable. a san jose woman is greening this morning after her boyfriend was stabbed to death at her birthday party outside a home in the piedmont hills neighborhood in san jose around 1:30 yesterday morning. the 22-year-old was at the home with 3 other people celebrating his girlfriend's 21st birthday

details. >> students take it seriously. we have been speaking to some who arrived for different school activities this morning and see how they are approaching things after hearing the news. this weekend, both assaults took place on campus on saturday night. police say a woman was groped by a man on a bicycle before 7:00 p.m. outside the recreation center. the second attack happened at 9:20 near the dormitory. witnesses say the attacker is a white man in his 20's with a mustache and wore a black hoodie and black pants. many learns of the assault by text sent by the university. >> it is scary especially being a woman. we are more affected than person at night, especially. it is scary. >> the guys agreed and they believe that it is not something that necessarily concerns me, why fear being attacked but i do look out for my classmates or
