and wanted for assault with deadly weapon incident out of sacramento so when he sped past chp at 7:30 tonight the officer medley recognized the truck. pulled it over and used his bull horn to instruct the driver out of the truck. that's when the chp says the man jumped out and charged the officer. >> other officer on scene fired one round from the departmentally issued shotgun striking the subject. the subject did go down. he went partially in the lane. as soon as that happened our officers use caution approached used subject from the lane of traffic and provided first aid or attempted to provide medical first aid to him. >>reporter: the suspect identity has not been released but he was taken to the hospital with a single shotgun wound. this is the third chp officer involved shooting in the past two weeks. on january 21, officers shot and killed 2 men in two separate incidents in oakland. right now cal-trans tells me eastbound i 80 will be partially closed at

least until midnight. reporting live in dixon, abc 7 news. >> all right thank you. >> fact finding report on the handling of san jose state racial bullying case is out tonight. that report says university officials did everything they could as soon as it was brought to their attention. but that could have happened faster the report say says. of lillian kim has details. >>reporter: alleged abuse happened in building c where 4 male san jose students are to have tormented african american roommate by fastening a bicycle lock around his neck, hanging a confederate flag in a common area. independent investigation says the racial bullying wept on for weeks. because the victim wished to keep the matter private. but once staff members learned the accident of the problem the university did everything it could including offering the victim support services, initiating a criminal investigation, relocating the 4 roommates and suspending them.

daughter will make the first court appearance tomorrow. 3-year-old kaley slushier found dead saturday in her mother napa apartment. investigators say there were also signs of sexual abuse. an autopsy performed today will help investigators determine what happened. sarah krueger and ryan scott warner were arrested on sunday. napa police say they have actually visited the couple home several times to check on the girl. most recent was last thursday. krueger step sister told us today that krueger is not the kind of person who would hurt her own child. >> there was not that type of person. like she would, it was so hard for her to put kaley in time out when she did something wrong. it was not that was not sayer a.i don't know. >>reporter: the napa valley register reports kaley body will likely be released to her father parents tomorrow. her father is serving time rate now at san quentin state prison. >> teenager accused of shooting and killing his sister in oakland is going to stay in custody. judge decided today
