and stopped because of a broken headline the video shows a chp officer pulling over a car, then, state park ranger jenny donovan is in the passenger seat. her part neshgs dona, is the driver. she does not want her full name used the officer talks to the couple. donovan identifies herself as a peace officer. >> i'm a police officer. >> are you? >> yes. >> state parks yes. yes. >> officer phillips takes dona to the side of the car and gives her a field sobriety test she complies but refuses to take a breathalyzer he tells her he'll have to take her to jail, dona yells for her partner. >> jenny! i need to know. >> stay in the car. shut the door, stay in the car. >> she's going to jail? >> shut the door, stay in the car. is there going to be a problem? shut the door and stay in the

car >> she said came out of the car not to interfere with the officer or help her >> trying to say if i can get her to calm down i can help you out. he just came at me. >> condonovan tore a rotator cuff. her attorney believes he had other options >> simply by quote, unquote failing the attitude test does not give a right to use excessive force. >> donovan doesn't understand why phillipss was so violent with her. she does have some suspicions. >> gender or or lesbian he didn't like the way i looked or something like that. >> donovan charged with resisting arrest and public drunkenness. as we noted, they were all dismissed however, she was fired from her job. she says, because of the

arrest. donovan is appealing her dismissal. the state parks department had no comment. >> there is this a private security guard shot and wounded a burglary suspect today. sky 7 hd was over the scene of the shooting in the oakmoore district. a guard from a firm called security code three saw what he believed to be burglarers. police say one of the two suspects threaten the guard with a sharp edged object. and at that point he was shot in the leg. police are looking for another man tonight this, happened along waterhouse road and in an area of the oakmoore neighborhood. >> bart police chief is defending one officer tonight caught on video daysing a passenger who appeared to be drunk and combative last month.

time ago when it was still raging. this is an apartment building. flames just shooting out of the roof. firefighters battling that blaze and all of a sudden the fire just exploded out of the windows crews had to climb to the ground. good news is that there are no reports of injuries. a suspect tied to the disappearance of sierra lamar is pleading not guilty tonight. garcia-torres was in court today it took a secret indictment to get this case moving. abc7 news reporter david louie is live tonight with the story. david? >> reporter: the attorney for garcia torres seeking to have transcripts sealed to try to find a flaw that could lead to overturning the indictment. so until that matter is resolved, the date cannot be set until

probably mid april. garcia torres wore a well pressed tan suit walking into court nearly two years after sierra lamar disappeared on her way to a bus stop. she was 15 at the time. garcia torres has been indicted with felony kidnap and murder charge that's could lead to life in prison. a decision has not been made whether to seek the death penalty. his attorney entered a plea of not guilty on his behalf. sierra lamar's parents were not here, but search team members were and said today brings justice one step closer for the family. >> i haven't had answers in two years. there is one person we know of that has the answers and it's not sharing it. it's difficult. >> garcia torres charged with murder throw the body or crime scene has never been found. however, investigators say his dna was found on clothing belonging to lamar buried near the spot where she was last seen. legal analyst stephen clark says lack of a body may be
