supposed to use them in a defensive position. >> rainy says it should have been recorded by the bart officers lapel camera but he hasn't seen that video. at this routine in any use of force case the independent police auditor will investigate. >> a former state parks ranger is suing a chp officer, charges were dismissed but jenny donovan was fired because of the arrest and trouble that followed. >> jenny donovan was a sworn peace officer. she and her partner driving home at night. stopped because the car hadded a broken light. what happened next was captured on a car camera. the incident happened in

september, 2012. the video shows a chp officer pulling over a car. her partner dona is the driver. she doesn't want her full name used. donovan identifies herself as a peace officer. >> i'm an officer >> are you? >> yes. state parks. >> officer phillips takes dona to the side of the car and she complies with everything but refuses to take a breathalyzer. he tells her he'll have to take her to jail. dona then yells for her partner. >> jenny! >> i need to know what she's going to do >> stay in the car. shut the door and stay in the car. is there going to be a problem? shut the door and stay in the

because of her arrest. abc7 news >> a san francisco jury convicted this 23-year-old man for a robbery and assault happened during last year's pride celebration. christopher porter belly was suspected of robbing a woman then kicking her in the head >> breaking news involving bart tonight and a measles scare. a uc berkeley student got sick overseas but rode bart before he realized it and thousands may have been exposed. leanne? >> well, dan, anyone could have been exposed because bart trains travelled to many different parts of the bay area. in

toll. san mateo county reported another flu fatality bringing total to 46 so far this season. >> oakland police investigating an incident in which a private security guard shot and wounded a suspect in the oakland hills there. >> carolyn, an oakland police officer told us that there were two men involved, one suspect. one drove off, another ran off and then shot in the leg. neighbors are hoping it will make would be criminals think twice private guards are the latest crime fighting tools from some oakland neighborhoods the guard who works for the company is on routine patrol. he

found in his car and his dna found on her clothing. her body, however, has never been found friends say the hearing brings justice closer for the family. >> they haven't had answers in two years. one person we know has the answer is not sharing it and it is difficult >> a hearing to hear the trial date is set for april 16thth >> abc7 news obtained video of the latest fatal pedestrian accident. we're only going to show you part of the video. you can see the victim 1:00 a.m wednesday, he then begins to jaywalk across van ness avenue. this is where we're going to stop the video because just seconds later the victim was killed. the driver has been out on bail on a grand theft charge.

a federal appeals court handed town a decision that could make it legal or anymore anyone to carry a concealed weapon. judges ruled california is wrong to require applicants to show good cause you shouldn't need one, the majority reads and reads the right to bear arms includes the right to carry an operable firearm outside of the home for a lawful purpose of self-defense. the ruling is likely to be appealed to the u.s. supreme court. >> three former california governors backing a november ballot to speed up the state's death penalty system the ex-governors threw their
