good morning, america. happening now, the heaviest rains in years set to take hold over southern california. mud slide alerts and the red carpet at the academy awards rolled out early to beat the storms. plus, a winter storm watch for the mountains. developing now, danger in the skies. two new reports of lasers hitting passenger plane cockpits just outside boston. >> i've got a laser pointing at us, green laser pointing at the airplane. >> drivers in the area also reporting lasers in their eyes the police on the hunt for the latest culprit. caught on tape, special delivery on the sidewalk. the baby who couldn't wait even a new york minute. >> i went, no, that's my cab. >> the mom missed her ride and went into labor right there. we'll hear from her about that curbside delivery this morning. ♪ let it go >> and it's a song that's got america singing.

central and southern get a little bit into early tomorrow morning. and then the heaviest, the part we're concerned with starts at 3:00 a.m. on friday morning. this is not just heavy rain at times. it is thunderstorms. it's a potential for mud slides, especially in some of those spots that have had the wildfires so this would be the rain through the weekend. four to six inches especially north and west of los angeles. two to three, though, in l.a. that's going to bring them closer, it will be good. overall we'll look for spots that will be bad friday into saturday. >> some wet oscars. thanks. other top stories from josh. we begin with a rare and public apology from general motors. a car defect has now been linked to 13 deaths. that is double the number that was first reported. the problem is a faulty ignition switch that can cause the key to unexpectedly turn the car off. again, it's been blamed for dozens of crashes. the result, it's been a massive recall, 1.6 million cars are now affected. most of them chevy cobalts.

along with some saturns and pontiacs. gm admits it may have been too slow to recall the cars. and a scare in the sky for two airline pilots over boston. someone on the ground tried to shine a laser into the cockpits of two planes, one approaching logan airport, the other a delta flight to atlanta. >> i've got a laser pointing at us, a green laser. >> any idea where that came from? >> all i can say is was on a river, south bank of a river. >> thankfully the planes did manage to land safely but it's become such a serious threat now to pilots that the fbi is now offering a $10,000 reward to anyone who catches someone doing it. please, please, do not. meanwhile, asiana airlines is being fined $500,000 for the way it handled that deadly crash in san francisco last year. authorities say that it took the airline in some cases five days to contact some victims' families. and swiss bank executives

will be answering questions on capitol hill today. they stand accused of helping their wealthy american clients hide up to $12 billion from the irs. a senate investigation found that credit suisse used among other things a secret elevator, hid cash in panty hose and even stuck bank statements in a "sports illustrated" magazine all to avoid detection. speaking of detection, take a look at this. that. nasa has released new video of a massive flare erupting on the sun, the largest of its type. it's a gas explosion. it unleashed winds topping 4 million miles per hour. how do they know that? thankfully the flare was not pointed at the earth. so no problems are expected here, but whatever planet it may have been pointed at, you have our prayers. finally, have you ever been on a whale watch? well, i don't know if you had as much fun as this woman.

>> there's a fin. >> oh. >> oh, my gosh. >> she took a fin right to the head during a whale watch off baja california. and look at the picture up close here. yeah, not to worry. yeah, she's fine. look, if you go whale watching, there's one way to watch a whale. >> can't get more up close than that. >> yes. >> thank you, josh. >> yes. to the bill in arizona firing up a national debate over religious and gay rights. governor jan brewer under a lot of pressure to veto the measure that would give businesses the right to refuse service citing religious beliefs. protests overnight right outside the governor's office and abc's cecilia vega has the story. >> reporter: governor jan brewer has just four days to decide whether to sign or veto a controversial bill that allows businesses in the name of religious freedom to refuse to serve gay people. >> your message to jan brewer right now? >> veto, now. >> reporter: this has become a nightly ritual. protesters on the statehouse lawn and promise to be out here

every night until the bill is vetoed. for the governor, the pressure is mounting. major companies are taking sides declaring the law bad for business from marriott hotels to apple, american airlines and now yelp whose ceo wrote in a letter to brewer "every consumer has a right to be served by a business without fear of discrimination." the nfl says it too is watching the decision closely as next year's super bowl is set to be played in arizona, the league issuing a statement saying "it supports tolerance and inclusiveness" and arizona senator john mccain tweeting "i hope governor brewer will veto" as some stores and restaurants hang signs declaring business open to everyone, the bill's backers are hoping the governor hears their side, too. >> i want for us to be able to have our businesses and also be able to have our values respected. >> reporter: maia of the christian business networking says she's received death

threats over her public support of the bill but she is not backing down. >> you think it's not about gay rights? >> i think the bill is about religious freedom and the ability to have religious freedom. >> she has remained tight lip on how she plans to act on this bill. she did late last night send a tweert out to her followers. followers saying "i assure you, as always, i will do the right thing for the state of arizona." george, that clock is ticking. she has until saturday to decide. >> okay, cecilia, thanks. to the white house. president obama is facing tough questions about his nominees for ambassador. critics are saying that too of the plum jobs are going to cronies with more cash than competence pushing hard to reforms. jon karl has the story. >> reporter: sometimes it can be downright embarrassing. president obama's pick to be ambassador to argentina has never set foot in the place. >> mr. mamet, have you been to argentina? >> senator, i haven't had the

opportunity yet to be there. >> reporter: neither have the president's picks for iceland or norway. >> mr. barber, i take it you've been to iceland. >> sir, i have not had the privilege yet. i look forward to -- >> mr. tsunis, have you been to norway? >> i have not. >> reporter: the would be ambassador to hungary had a hard time answering basic questions about the country. >> what are our strategic interests in hungary? >> we have -- our strategic interests in terms of what our key priorities -- >> have any [ bleep ] people been to epcot center? have you been anywhere? is there a rule that ambassadors can't have set foot in the country they're going to ambassador? would it ruin the surprise? >> reporter: here is what they have in common. they each helped raise more than $500,000 for the obama re-election campaign. like previous presidents, president obama has reserved about one-third of his ambassadorial appointments for political supporters, most of them big donors. >> more than half of the

political appointees he made to these posts gave or bundled, helped to raise more than $500,000 for his re-election campaign. is that a coincidence? >> look, the president takes an approach where he finds qualified nominees for these posts from a variety of walks of life. >> reporter: one nomination that the foreign service association will be watching very closely is u.s. ambassador to france, the post is currently vacant. the question, george, is will it go to somebody who raised big bucks for the obama campaign and if so will that be somebody who also knows a little about france? >> that has been vacant for awhile. jon, thanks very much. boy, you would think people would do their homework. >> you would think so, yes. to the new headline on fertility that could allow doctors to eliminate certain genetic diseases in babies and give new hope to women who can't have babies. abc's chief health and medical editor dr. richard besser is here with much more. rich?

>> robin, the science that the fda is considering is extremely complicated. as i was studying the reports late last night, i have to say at times it felt like this. like i was reading science fiction. look at this. combining the genetic material of three people to make a baby could wipe out potentially a whole category of incurable inherited diseases. the procedure sometimes called three parent ivf starts with the mother's egg. if there's problems with the mitochondrial dna, they left out the eck's nucleus. with all the genes for height, weight, color in tact. and move it to a healthy donor egg. with healthy mitochondrial egg. now the enhanced egg can be fertilized in a lab by the father's sperm and the embryo would be implanted back in the mother like regular ivf. researchers in oregon tried this in monkeys. it worked. they also tried it in human eggs but never implanted them. the fda saying the controversial procedure wasn't yet approved for human trials. this morning, questions remain. is it safe and is it a good idea?

>> so, rich, talk about the dna that is the centerpiece. >> yeah. so this is called mitochondrial dna. they have mitochondria that provide them with energy in their eggs. if its infective, they may have a baby with a birth defect. >> promising technique? >> you know, it is. the idea you can make a fix before a baby is born so a couple can have a healthy baby is terrific. it's been done in monkeys. i think it could be done here. >> of course, there are people that are concerned about the risks. >> that's right. >> what are they? >> i mean, there are risks. the idea that the change you make could lead to a birth defect that you aren't aware of or a problem in the next generation. how do you do the studies to even sort that out. >> the ethical component of it. >> is this on the path to designer babies. you know, you make a change that prevents a deadly disease is one thing but are you on your way to selecting characteristics in a baby and do we really want to go there. >> even that's not the intent but you don't know if that's the direction it could go. >> that's right. that's something they have to sort out before they move forward.

>> thanks rich. >> thank you, guys. we'll get the latest on that kerry kennedy trial. the 54-year-old daughter of robert kennedy expected to take the stand today defending herself against charges for driving under the influence of ambien. abc's mara schiavocampo is tracking this case. >> reporter: tuesday the court was packed with kennedys. the famous family out in full force for kerry kennedy's misdemeanor drugged driving trial including her mother, 85-year-old ethel kennedy who is rarely seen in public. some also showed up on the witness stand, rory kennedy testifying her sister, quote, has a reputation for sobriety and general healthy living." another character witness, family friend reverend jerry creeden. >> his great heart -- >> reporter: who spoke at senator ted kennedy's funeral. of kennedy the minister said i've never seen her drunk. the 54-year-old niece of president john f. kennedy is facing a misdemeanor charge of driving while impaired in july of 2012. allegedly hitting a tractor trailer after she claims she

took the prescription ambien with her breakfast instead of a thyroid pill. >> i remember getting on the highway and then i have no memory until i was stopped. >> reporter: tuesday kennedy clutched rosary beads while the prosecution made their case saying she should have realized she was impaired. a forensic toxicologist testifying ambien is a fast-acting drug and could have taken affect in as little as 15 minutes. but the defense says kennedy made an honest mistake and that the prosecution has not proven its case. >> hopefully the jury will agree. >> reporter: in a case where no one disputes the facts, it will all come down to kennedy's judgment. >> the issue ultimately will be whether she realized that she was under the influence of ambien and yet continued to drive. >> reporter: if convicted, kennedy could lose some driving privileges. she also faces up to a year in jail. it's unlikely she'd actually serve they time, though, because she doesn't have a record. kennedy has pleaded not guilty and the trial could continue through the week. robin?

>> all right, mara, thanks very much. to the latest on the mysterious shooting of a prominent new york real estate tycoon and political power broker at his castle, one of the biggest private homes in the u.s. gary melius says he has no idea who would want to harm him. abc's gio benitez has that story for us. >> reporter: this morning, with his would-be assassin on the loose, the owner of one of america's largest and most exclusive properties, new york's oheka castle, is afraid for his life. insisting he does not know who shot him. with around the clock police protection, 69-year-old gary melius tells us from his hospital bed, i look forward to coming home. i look forward to getting back to work. oheka castle is the kind of place most only see on tv. with gardens fit for kings. but monday afternoon with melius sitting in his car a gunman wearing a black mask fired up to three shots, one bullet hit him in the head but never penetrated his skull. he went into shock.

melius who spent $30 million restoring the iconic castle is so politically connected, top elected officials were at the hospital distraught. >> it's terrible. terrible. >> reporter: just months ago melius, a political donor was at the center of an enormous scandal accused of using his access and connections to get the nassau county police to arrest someone. the police commissioner resigned soon after. both he and melius denied wrongdoing. but who would want melius dead? police don't have a motive or suspect. but according to "the wall street journal," surveillance video showed two men waiting in a vehicle for two hours before the attack. when melius sat in his car, the masked gunmen started shooting into the driver's side window. melius also telling us "if this near-death experience has done anything, it is a reminder to live each day, celebrate life and embrace your family." and back here at the castle

police are launching day three of that manhunt but they say melius is still having a really hard time remembering the details of that shooting, robin. >> good to see he is recovering. all right, gio, thank you very much. lara, i guess there is gold in them their hills. >> unbelievable story. it's true, robin. this is a california couple who goes out on a walk with their dog and they come home multimillionaires after stumbling on a veritable pot of gold. ♪ okay, this may not be a national treasure but coin collectors say it may be the biggest buried treasure ever found in the u.s. a collection of coins worth more than $10 million. it was found by a couple out doing the same stroll they do every day. >> there are many coins here that are better than anything anyone's ever seen. >> reporter: gold coins, some incredibly rare, the husband, wife and dog were on a path on their california ranch when they saw what looked like a rusty can

sticking out of the ground. >> full of dirt and they saw just the very rim of one coin sticking out and immediately knew what it was. >> reporter: the couple unearthed more than 1400 u.s. coins, all dating from the late 1800s and all in pristine condition. for safety concerns, the couple says they want to remain anonymous. they haven't even told extended family members and say no bank is safe enough either. the couple is keeping the coins right where they found them, saying in a statement, they dug a hole in the woodpile and cut a slab of green board to cover it. put the coins in plastic bags then put them in a box inside an old ice chest and buried them. most will be put up for sale on amazon while the couple will hold on to a few keepsakes. among the coins that they found, if you're a coin collector, the 1866 no motto double eagle. that one coin is worth $1 million. >> the no motta double eagle? no. >> good, ginger.

sensational trial complete with sex, money and murder, this one was worth the wait. it has it all. is she a socialite, a sociopath or both? 56-year-old pamela phillips on trial for the murder of her ex-husband, high-flying commercial real estate developer gary triano. prosecutors say she wanted his $2 million life insurance policy to keep up her lavish lifestyle after their divorce. >> she was looking to get very rich. >> yes. >> reporter: hugh bancroft took the stand tuesday. his family once owned the majority stake in "the wall street journal." he testified about vacationing with phillips and loaning her hundreds of thousands after the divorce. >> pamela was dating some very wealthy men after she tworsed gary, isn't that true? >> yes. >> reporter: prosecutors say her greed let her to pay a hit man. her one-time boyfriend ron young to plant a pipe bomb in her ex-hubby's car at this arizona country club back in 1996.

gary triano was killed in the explosion just after finishing a round of golf with friends. >> his head was slumped over, his right arm and hand were gone. >> reporter: phillips became a mother on the run living it up in aspen until she was arrested in this luxury hotel in 2009. she pleaded not guilty and her attorney says her ex had lots of enemies. >> gary triano lived on the edge. he borrowed a lot of money from all sorts of people. many people who maybe were connected with organized crime. >> reporter: the hit man in this case is already serving life in prison. if convicted, his one-time girlfriend may just join him there. george. >> ryan, thanks. let's talk about this with abc's chief legal affairs anchor dan abrams. prosecutors zeroing in on this insurance policy. >> that's right. they're calling witnesses to say

that she was in dire financial straits. but most importantly, the one thing that she wasn't going to do when she was suffering financially was not pay the premiums on that insurance policy. >> on her ex-husband. >> that's right. they're divorced and they want to call witnesses to say she was borrowing money. she was making sure that those premiums were paid off. they say that's the motive and the other key to the case becomes linking her to young -- to her alleged boyfriend. >> taking a long time to build this case. this happened 20 years ago. what is the defense strategy in this? >> the defense strategy is broadly to impose reasonable doubt. but what they want to do, look at other possible suspects here. this is a guy who a lot of people were after. this is a guy who was involved in a lot of lawsuits, owed a lot of people money, had a lot of enemies, the defense saying that's the place to look. >> so in some ways they want to figuratively put him on trial which means she doesn't take the stand. >> i don't think there's a chance she takes the stand. there's too much at risk for her. too much for her to explain. they want to just say reasonable

doubt and most importantly they got something specific with that reasonable doubt which is look at all of these other people who might have been possible suspects here. look at all these other people who might have wanted him dead. not an easy defense. >> even though these are tough questions for her, all the evidence circumstantial. >> that's right. circumstantial and, remember, she's not the one who actually put the bomb there. the allegation is that she hired someone to do it. but under the law, if they find her guilty she's just as guilty as the person who put the bomb there. >> dan abrams, thanks very much. >> all right, george. to that very special delivery we've been telling you about all morning, the mom who missed her ride and gave birth right on a new york city sidewalk. only in new york, kids. only in new york. abc's john muller has the story. >> say hello, ila. >> reporter: she's the miracle momma who brought curbside delivery to a whole new level. this incredible video shows 39-year-old polly mccourt giving birth on a busy manhattan sidewalk monday after going into

labor unexpectedly in her apartment. she says her doorman tried to hail her a cab to the hospital but was stymied by rush hour rivals. >> he was trying desperately to hail a cab. a lady walked out 5 miters in front and hailed a cab and got into it. i went, oh, no, that's my cab. i turned around to him and said, i'm not going to make it. i'm not going to make it. i need to actually sit down. >> reporter: you can see in the video a crowd gathers, some offering her scarves to keep her warm then that incredible moment with her doorman propping her up and traffic whizzing nearby baby ila isabelle was born. you can see her here with her mom just moments after paramedics arrived in the nick of time to pull her out. then load a smiling mccourt on to the balance. >> let's put it this way. she's a real new yorker born on the streets of new york. >> reporter: this morning they're both doing great thanks in no small part to the kindness of strangers including one woman who gave her the coat off her back. to keep her warm.

you don't know why and she sits right next to liam neeson which is where i'd sit if i were in an action movie. >> absolutely, and i read that you wanted to do this movie because it really reminded you of the real thrillers we grew up with. >> like all those big action movies with the huge casts like "towering inferno" and "poseidon adventure" where you follow a large amount of people as they enter into a situation. you don't know who anyone is, how they're going to react. i always loved those movies. >> it's got you like this the whole time. we have a lot of facebook questions coming in. not surprisingly a lot about your co-star. >> liam. >> yes, sherry laird wants to know "is liam as awesome in person as he seems to be on screen"? >> he's super awesome. i think people always ask me why, why audiences respond to him as an action hero. and i think he has so much personal integrity and he's so human and wonderful and warm that you want to see someone like that take control. i mean, he doesn't feel like a superhero. he feels like a wonderful man.

>> i think the books are magnificent. i don't know if you've read them. i actually -- >> i'm starting to now because my daughters are getting into them. >> well, i bought them for my son years ago long before they were making them into movies. i actually bought him the third volume, "mockingjay." my daughter was reading them. i had nothing to read. she was playing ping-pong. i picked up the book and tore through them. i think they're wonderful. i mean they're really political books with adolescent overtones and pretty magnificent. >> i have to thank you. i spent many, many hours when my daughters were a little bit younger reading "freckle face strawberry." that's your children's book. and you wrote "my mom is a foreigner but not to me." is this going to keep up? >> that's a book about what it's like to grow up with a parent from another country. my mother was from scotland. so the person who is most familiar to you is foreign to the rest of the world.

but, yeah, "freckle face strawberry" is going to keep going and moving into early readers and i feel like that's a great place for the character and kids really respond to her. >> they sure do. no question about it. they're going into schools now. blake and i were cast first and they asked us to go out and have some fun, and we had a little bit too much fun, yeah. it was like a first date and then turned into a myriad of bars, meeting a three-legged dog and then getting kicked out of a house party. >> it was really good. >> and now they're best friends. >> and now we're best friends. >> that's awesome. and the show takes place over the course of the season in one night. >> yes. >> what's that like for you guys as actors? >> i think it's pretty fun because you kind of develop these characters over like -- over one day, so you see more of like who they are and our back stories are told through flashbacks so you know why these people are who they are today and you get to know their families and starts at birth and goes all the way to the present. pretty great. >> that's pretty cool. a great premise. you wear the same things so like how many of that costume do you have? >> dozens. they had dozens. >> i only had three of my cocktail waitress outfit, and i had to change once because i spilled many, many drinks on set and i was constantly running changing, and they would like go shampoo and bleach the fake beer

off my top, and i would have to go back, but i know only have three and have this necklace that's a friendship necklace between me and my mom and wore it in the pilot and they can't find it again so there's only one of them so that was a real danger on set. >> no, it is. continuity. it's key. continuity, speaking of which, zach galifianakis' character is sort of your guy. >> yeah, kind of. well, the writers of "the hangover" are the writers of our show, so i think they kind of base part of my crazy, kooky character on him and have this big burly beard and some are like it's the ginger zach galifianakis. i'll take it. >> this is half the size of it on the actual show. >> it's way more disgusting on the show. i'm only half disgusting. on the show i'm like repulsive. >> who doesn't want to watch? it's by the writers of "the hangover." these guys are great fun. it's called "mixology." it premieres tonight, 9:30 p.m.
