persistent westerly flow. upper 50s to lower 60s. and mid-up ander 60s around the bay. a detailed look at the first weekend of spring and the look ahead coming up. katie. >> thank you. in san francisco a man with a gun is dead this morning. he was shot by police just a poplar park. it happened after 7:00 last night in the bernal heights neighborhood. a minnesota called 911 and said there was a man on the trial with a gun. man was not threatening anybody but he had his gun out when they encountered him. they shouted to the man to put the gun down and then there were several shots. >> this is a quiet area of the city. it's usual. it's not something to comes to mind to being a problem to the district. >> the circumstances leading up to the shooting are unclear. authorities say they will hold a town hall meeting next week to explain what happened. police vehicles were

landized during a hastily-organized anti-police protest in the mission district overnight. police received word of the protests in the area of bryant streets. you are looking at a photo a viewer sent us of police lined up on bryant street. during the march several police cars were vandalized with graffiti. no word on injuries or arrests. the 21-year-old giants fan who fatally dodged a giants fan last year will not first charges. the man stabbed him moments after a game between the dodgers and giants. investigators interviewed witness whose backed up montgomery's story that he was hit over the head with a chair and had no choice but to defend himself. the district attorney said his office was ethically obligated

to not prosecute him. a man and boy are dead after hitting by a freight train after talking to a chance. the boy died at the scene and the girl was airlifted to a hospital. people attending a little league game nearby said they heard a long blog of the horn but no word on the circumstances leading up to the stents accidents. the search for the mission malaysian plane is stretching into two weeks. the planes and 27 ships are searching an area but so far they have found nothing. chuck sievertson has the latest from abc news. >> two weeks after slight 370 vanished, the search for any sign of the air is regular water by air and by sea. thousands of square miles of motion have been scoured, every

has been arrested are calling in bomb threats to public schools 1100 miles away. they traced the calls from helena, missouri tigers to dublin and arrest the the boy at the dublin high school. after each call schools were evacuated and yesterday all classes, grades k through 12, were dismissed. the district attorney in helena is working with prosecutors in california to determine where the dublin boy will face charges. a disturbing case of abuse and neglect in salinas. it's so disturbing even investigators are having a tough time with it. 31-year-old erica, a former prison guard, and a 34-year-old have been arrested. they found boys ages 3 and 5 and an 8-year-old girl living in filth. all were suffering from severe million nourishment and abuse. the girl's condition was the

most serious. she was chained to a post to keep her from getting food. >> she was described as someone who looked like she'd been in a concentration camp. they were all malnourished. a devastating scene. >> the girl was hospitalized for several days. all the children are now in protective custody. the two women adopted the girl. and the youngest boy is the biological child of one of the women. >> and soccer parents say the 49ers aren't following through on their promise to provide new fields. their current fields are right next to the new levi stadium and on seven sundays when he are scheduled to play the families would be prohibited from using the park. to avoid the mess the 49ers were going to build three additional fields. but now it's following through. >> it's not part of a contract but it was said in a letter that

pattern we've already seen, going to see potentially more fires and larger fires. in fact, the past several years and the past decade we've already gun to see a significant size in the size of wildfires we respond to. >> thanks to the drought, the fuels in california are ripe for fire well before their normal time. despite the rains that turn the top grasses green, life beneath is tender dry and ready to burn. >> it worries us a great deal. again, this is something we would normally see in late july or early august and we are seeing in this march. if we don't get further water, more rain, then this is going to be common and we are going to see more and more fires like this. >> according to cal fire, from january 1st to march 15th of this year the state has already had more than 730 wildfires. last year there were 293 by this time. the average is 250. >> the black smoke.

beach bumps have considerably more choices than americans about how to protect their skin from the sun. sunbatheners europe and parts of latin america can choose from at least seven more uv filters. >> the united states needs to speed up. >> many dermatologists agree. they have joined force was sun block manufactures to push the food and drug administration to approve a backlog of stronger sunscreens that last longer and feel better on the skin. >> unfortunately the fda doesn't always accept the research and studies being done abroad so there tends to be more of a backlog through the fda. >> the fda has not approved a new sunscreen in 15 years. in 2006 the agency did approve the breakthrough chemical, but only for sale by one company. even though the europeans have been using it since 1993. the fda says they remain committed to allowing sunscreens with additional ingredients for

it's going to take about all day for it to come on out. here's a look from our sutro tower where we are look at some very chilly north bay numbers and the dewpoints have dropped into the upper 30s. 37 novato, 38 santa rosa with napa coming in at 40. a look at visibility in miles this morning. santa rosa three quarters mile, novato looking at some pretty tough conditions to navigate. but the coast is at five miles and everyone else looking pretty good. but that fog will extend locally inland through the santa clara valley and to salinas. then it will mix out after the morning and we will have slightly warmer temperatures around the bay and in the inland. but if you are at the coast, despite the afternoon sun, temperatures still in the upper 50s to lower 60s. but did you see the last height there? cooler with a chance of showers tuesday and wednesday. here's a look at the satellite radar come 'sive. high pressure off the coast, low pressure to the south and east of us and that allows for a

dominant cooling sea breeze. that will be the trend, although the high pressure begins to work its way in over the weekend. we will look for temperatures to warm a couple of degrees around the bay and inland, keeping us dry right on through monday. so katie talked to you about the drought watch and here is where we are, an exceptional drought and things have gotten worse over the past week or so simply because parts of the north bay were in a moderate drought but now notice they, too, are in an extreme drought with the exceptional drought to the south of us. no good news across california except when we look at the long-range outlook a little more cloud cover and chance of rain late tuesday, 6:00 a few scattered showers. but a better chance on thursday. maybe a .1 to .2 inches. this goes out ten days. right through the first day of april looks like we are looking

video from colorado. the black things you see twirling around in the air are burning tumble weeds. a dust devil took over and they had to back off but one firefighter kept video rolling and the unexpected dust devil ended up burning an extra acre of land. no property was damaged and luckily no one was hurt. wow. a ten-day old baby gorilla saw her mom for the first time yesterday in san diego. the baby has been fighting fem own yeah since her birth by emergency c-section. this is the first of many steps to physically reintroduce the baby to the group of gorillas. one of the gorillas is the baby's mom. this is the first time the gorilla left the veterinary hospital and has had contact with her own species. >> we are beginning slowly and beginning with visual introduction so as a group they can see the baby for the first time. >> they are remaining close to

the lowest numbers return in the lower 70s. so will the weekend be dry? it's the first full weekend of spring. we will talk about the prospects of rain coming up. katie. >> thank you. president obama said the u.s. economy hasn't caught up to the new reality that women now make up about half of the workforce n his weekly address the president said women face outdated policies that hold them back in the workplace that then hurts their families and the broader economy. >> today women make up about half of our workforce and more than half the college graduates. more women now are the family's main winner than ever before. but in a lost ways our economy hasn't caught up to the new reality left. on average a woman still earns just 77 cents for every dollars a man does. and too many women face outdated workplace policy that is hold them back. >> president obama said congress must act to address those problems. he is calling for congress to raise the minimum rage to $10.10 an hour.

a public memorial service will be held monday for a mendocino county sheriff's deputy who would killed in the line of duty. hundreds of people are speck to turn out for the 10:00 a.m. service for deputy ricky delsienero. he was killed last week on a violent crime spree that began in oregon. the suspect was later shot and killed by police. new details. investigators say the helicopter involved in a deadly cash was rotating when it took off. a preliminary report said surveillance video showed the helicopter beginning rotating counterclockwise tuesday morning. it crashed on a street next to the space needle and burst into flames. the wreck killed both men on board and a third was seriously burned when the helicopter crashed on his car.

an iraq activist whose injured during a protest two years ago has reached a settlement with the city of oakland. he will receive $4.5 million. he was hit in the head by a bean baling fired by a police officer. lilian kim has more. >> there is a portion of our left frontal lobe which is and will always be dead. >> for the past two and a half years, the 26-year-old man has had to relearn to talk, cope with constant headaches and deal with memory loss. he was shot in the head by a police office we're a led-filled beanbag during an occupy demonstration. with his lawyer he announce add $4.5 million settlement with the city of oakland. >> no amount of money, it's not going to get me my brain back. so, you know, i'm not happy. but, you know, i think this is enough. >> olson's lawyers provided this

video of him in the hospital not long after his accomplice encounter. he said he will never fully recover from his injuries. olson has permanent brain damage, which has kept him from holding down a job. in a written statement the oakland mayor jean quan said we regret mr. olson suffered these hardships are, and i want him to know because of the evening's event we took steps to change our procedures. but the lawyer said nothing will change until they stop using less than lethal weapons >> all of these weapons that are fired from guns can kill someone or cause permanent injuries and should not be deployed in crowds. >> as for olson, he's not sure what the future holds but he says he can now focus on becoming a productive person. >> now that this has been resolved, i'll have more of a idea of to be able to think about that and find out -- find out what i can do. >> in oakland, lilian kim, abc7 news.

there's another notable payout for oakland this week. the city council agreed to a $3 million settlement with a cyclist who was seriously injured after crashing into oakland hills in 2011. she was riding down hill on mountain boulevard between as scott drive and the highway 13 on-ramp. the 35-year-old suffered severe injuries to her face, head, jaw and teeth. she sued, arguing potholes made the ride dangerous. the city fixed the potholes later that year. experts say it could be the biggest payout of its kind. a big victory or a neighborhood that fought the opening of a 711 store. they reached a settlement with the operators to close their doors. vic lee has been following this story for more than a year and has an update you will only see on abc7 news. >> it's been an ugly and costly legal battle since 711 opened their doors just over a year ago. hundreds of residents in this quiet san mateo neighborhood

banded together, signing pegs pass and demonstrating, asking the city to close it down. >> a lot of money has been spent on both sides. and even the neighbors have put up over $40,000 in legal fees. we aren't going to be reimbursed. >> they didn't want a convenience store that would be open all night that might attract the wrong crowd in this neighborhood. >> 711 is not a bad company. they just don't be long right in the middle our neighborhood. >> the store sits on land that was originally designated as a residential zone. the old resident was grandfathered in. the property should have reversed back to residential use when it became vacant but city staff ruled otherwise and issued a permit. residents kept up the pressure, going all the way to the city council where they got what they wanted >> the council looked at it again and reviewed and determined that the staff's determination was a mistake and

that the property had to then comply with the residential zoning requirements. >> in january a judge refuse today overturn that decision. in the settlement the city will pay $150,000 to 711 and the property owners and the store will close by the end of this month. 711 issued a statement which reads in part, we are very disappointed with the california state court's ruling. in that in good despite rely on the permits this were issued by the city, we open this location. >> neighbors we spoke to are absolutely delighted by the settlement. the city promises them that that piece of property over there will never been revert to commercial use. you know, this really is a david and go hyatt story, if there ever was one. vic lee, abc7 news. >> still ahead, area students get a lesson from google on how to stay safe online. and 5:37. taking a live look outside.

45 in redwood city. good morning. los gatos is a cool 40 with half moon bay coming in at 50, as well as san francisco. another van tanning point this morning with low clouds and fog around parts of san francisco. but look at santa rosa's temperature. 37 degrees. the dewpoints are lower that morning, allowing for the chillier start. we have fog in both santa rosa and novato. 48 concord for friends in the east bay. in the upper 40s. here's a look at the visibility from a quarter file santa rosa, mile inform novato and five miles half moon bay w that dry frontal passage it allows for better mixing than we had yesterday and high pressure is going to try to build in off the coast. so it's going to bring us the low clouds this morning. warmer around the bay and inland. but still cool along the shoreline. look what happens tuesday and wednesday. a chance of rain coming our way, spring showers and maybe another chance as we head towards the first part of april. that's a ten-day outlook.

cooler and sea breeze once again today. weak high pressure builds in behind the weak trough but this still allows for the alignment of that high pressure to funnel in that air to the lower pressure and that allows for the sea breeze. the dry pattern takes us through the early part of the work week and here come the changes. state-wide percentage of normal a week ago was 25%. look at the sierra they have. in the northern sierra, just 15%. central syria faring in the low 30s and down around southern california we are looking at 26% of average for the snowpack. so, yeah, doesn't look good. but as we go through the next several days we've got the summertime low clouds and fog at the coast into tomorrow and monday. but we are going to take it out as far as it goes into tuesday and that's when things could get a little bit interesting with the possibility of some showers lining up late tuesday and sweeping through the bay into wednesday. he is we are looking as far out
