>> good morning, everyone. it's 5:00 a.m. on saturday. i'm katie marzullo. we will start off with a quick look at the weather with meteorologist lisa argen. good morning. >> good morning. we have fog and low clouds not just in the city but also the north bay. the fog will be spreading across the bay into the santa clara valley and also the salinas valley. a pretty good push this morning as a weak weather system moves across the bay. but look at the dewpoints. they are lower so the temperatures are lower, santa rosa and 52 hay barred and oakland. the visibility in the north bay just down to a mile and a half to a quarter mile. santa rosa, novato, five miles at the coast. elsewhere you are in good shape but the deck of low clouds and fog up to 2200 feet.

although we are looking at a lot of it, it is going to mix out quickly simply because of the wind. 67 to 73 today in our inland east bay. so we are getting a little bit warmer around the bay with mid-and upper 60s. maybe a degree or two. but coastside we are still going to see those upper 50s, but getting clearing. we will bring some sunshine to some of our beaches, as well a further look at the possibility of rain. it's in the seven-day outlook. katie. >> this sounds good. thank you, lisa. developing news in san francisco. a man with a gun is dead this morning. he was shot by police in a poplar park. it happened just after 7:00 last night in the city's bern natural heights neighborhood. a man called 911 and said there was a man on the trail with a gun. man was not threatening anybody but he had his gun out when they encountered him. they shouted to the man to put the gun down and then there were several shots. >> this is a quiet area of the city. it's usual. -- it's unusual. it's not something to comes to

mind to being a problem to the district. >> authorities will hold a town hall meeting next week about the shooting. police vehicles were vandalized during a hastily-organized anti-police protest in the mission district overnight. police received word of the protests in the area of bryant street and division. there they found a small group of protesters marching toward the hall of justice. you are looking at a viewer photo of police lined up on bryant street. during the march several police cars were vandalized with graffiti. no word on injuries or arrests. the 21-year-old giants fan who fatally dodged a giants fan last year will not face charges. a man stabbed him moments after a game between the dodgers and giants. it was blocks away from the at&t park following the final regular season game. investigators interviewed witness whose backed up montgomery's story that he was hit over the head with a chair and had no choice but to defend himself. the san francisco district

attorney george gascon said his office was ethically obligated to not prosecute montgomery. developing news, a teenage boy is dead and a girl critically injured after being hit by a freight train after attending a dance. police say the boy died at the scene and the girl was airlifted to a hospital. people attending a little league game nearby said they heard a long blow from the train, but no word yet on the circumstance that is led up to the accident. the search for the missing malaysian plane is stretching into its third week. right now planes are flying over the indian ocean where objects were spotted earlier this week. the planes and 27 ships are searching an area that stretches 22,000 square miles but so far they have not found anything.

chuck sievertson has the latest from abc news. >> two weeks after slight 370 vanished, the search for any sign of the plane is treading water. by air and by sea. thousands of square miles of ocean have been scoured. every inch in vain. >> unfortunately we haven't found anything out there. >> the latest lead. the satellite pictures of items in the water was a false alert. intense searches in the area have turned up nothing yet. >> its about the most inaccessible spot you can imagine on the face of the earth. >> and the pictures are five days old, which means the tides and the winds could have moved any wreckage hundreds of miles away. relatives of the missing, these have been two weeks in a sea of anguish, their deep and uncertainty is deepened by what they say is the callous indifference of the malaysian authorities. even bad news or ming would relieve the stress of not

knowing. >> they are beginning to accept their family members are maybe not coming back. >> the family of the chief steward on flight of the plane is burning this candle to light his way home. his wife keeps calling his cell phone hoping for an answer to his prayer. >> i keep calling him, hoping that he would reply. >> search planes are in the sky again and resuming the hunt, abc news, new york. >> crews are also using unmanned probes. the autonomous underwater vehicles can go as deep as 20,000 feet and create maps to guide searchers, but they are slow. they search about 8 square miles per day and the researchers say it could take months or years and crews my not have that kind of time. signals coming from the black boxes are expected to last only 15 more days. >> it's a needle in a haystack, and obviously it becomes

substantially more difficult to find them once the fingers have gone silent. >> even worse, there may be no information on the voice recorder at all. it records on a two-hour loop and if the plane kept flying for seven hours or more we may never know what happened when it changed course. there is the possibility both recorders were shut off, either because the circuit breakers were intentionally pulled or due to a catastrophic power failure. first lady michelle obama said the u.s. is offering as many resources as possible to assist in the search for the missing plane. she made those rockers in front of a group of students at peking university in china. of the people on board, 153 were chinese nationals. >> as my husband has said, the united states is offering as many resources as possible to assist in the search. and please know that we are keeping all of the families and loved ones of those on this flight in our thoughts and in our prayers at this very difficult time.

>> her visit is part of a week-long trip that's being viewed as a prelude to an upcoming meeting between president obama and china's president at a nuclear security summit. >> a teenager of summit has been arrested for calling in bomb threats to public schools 1100 miles a way. authorities traced the calls from helena, monthly fees tana to dublin, and they arrested the boy at the dublin high school. after each call schools were evacuated and yesterday all classes, grades k through 12, were dismissed. the district attorney in helena is working with prosecutors in california to determine where the dublin boy will face charges. a disturbing case of abuse and neglect in salinas. it's so disturbing even investigators are having a tough time with it. 31-year-old erica, a former

prison guard, and a 34-year-old have been arrested. they found boys ages 3 and 5 and an 8-year-old girl living in filth. all were suffering from severe malnourishment and abuse. the girl's condition was the most serious. she was chained to a post to keep her from getting food. >> she was described as someone who looked like she'd been in a concentration camp. they were all malnourished. a devastating scene. >> the girl was hospitalized for several days. all the children are now in protective custody. the two women adopted the girl. and also adopted the older boy. and the youngest boy is the biological child of one of the women. a turf war brewing in santa clara. the soccer parents say the 49ers aren't following through on their promise to provide new fields. their current fields are right next to the new levi stadium and on seven sundays when he are scheduled to play the families would be prohibited from using the park. to avoid the mess the 49ers were

proposing to revitalize three additional fields. but now it's following through. >> there's no signed documentation. it's not part of a contract. but it was said in a letter that he was committed. >> the city is committed to spending $2 million to help if -- help them with the building of a site somewhere in the city of santa clara. >> the soccer league president said the niners are only offering to support new fields if the soccer park gives up its parking lot. the niners tell us they are currently in talks with the city. 6:09. bright and early on your saturday morning. if you are headed out, i say bundle up. >> you are right. low clouds and fog are with almost everyone, except around concord and mountain view this morning. from our sutro two, certainly back out there. 50 in the city and low clouds and fog in many areas this morning. but it will not last. that's going to mean a different afternoon today and tomorrow and some rain in the week ahead.

tree. a second motorcyclist then ran into the man on the bike. the police are investigating to see if charges will be filed. hundreds of people turned out to a candle light vigil last night to remember the two women killed in a horrific traffic accident last weekend. sue thought news particular element try school students in the area, many of whom came out to pay their respects. abc7 news reporter nick smith has the story from santa rosa. ♪ >> friends and family are remembering the 53-year-old woman, sue, killed last weekend killed in a car crash that also killed the life of her 74-year-old mother-in-law. the other family members were seriously injured. >> she touched everyone she encountered. no matter how busy she was she always had a positive, positive outlook and a smile on her face. >> susan, seen in this family photo, was the mother of three but touched the lives of

hundreds. ♪ >> songs performed were some of her favorite. many of the hands holding candles first held the instruments that she taught them to play. her husband jay and her sons joe and joel listened while fighting back tears. >> just look around here and all you children, please remember what sue did and taught you. >> the crash happened here at highway 12 and farmer's lane. the family was on their way to dinner when the 33-year-old man rear-ended their camry with his sierra. the women were killed instantly. >> he was stopped and said he was pumping his brakes to get the attention of the driver. >> friends were frustrated to learn that the man said he was use his cell phone at the time of the crash. he was arrested on the charges of vehicular manslaughter and driving under the influence of drugs and alcohol. he left court in tears.

he remains in jail while the d.a. awaits for toxicology reports n the meantime the community prepares to bury and say good-bye to down. their own. abc7 news. a plan hatched to help salmon go to adulthood will be put into effect next week. normally the coleman national fish hatchery releases the young chinook salmon into the river. but because of the low water level and low current, most of the fish are being eaten before they get to the ocean. next week they will be truck them down river to rio vista to give them a fighting chance. >> we aren't out of the woods. we will truck these but meanwhile others are naturally spawned that are trying to make their way to the dealt you right now as we speak. and they are pumping quite a bit of water out of the delta. we are very concerned about those fish. all of our problems are not solved by this trucking. >> the official salmon sportfishing season begins the first weekend in april. already fire officials say conditions look more like midsummer than the start of spring.

the state is in the throws of a drought with the bay area experiencing some of the most severe conditions. the areas shaded in red on the map are in extreme drought. the maroon areas are already in an exceptional drought, and that's as bad as it gets. laura anthony has more. >> the flames thursday in pittsburgh were big and hot and spread very quickly. state fire officials say they are a good indicator of when we -- what we might see for months to come, starting right about now. >> we are most likely, with the pattern we've already seen, going to see potentially more fires and larger fires. in fact, the past several years and the past decade we've already begun to see a significant size in the size of wildfires we respond to. >> thanks to the drought, the fuels in california are ripe for fire well before their normal time. despite the rains that turn the top grasses green, life beneath is tinder dry and ready to burn.

>> it worries us a great deal. again, this is something we would normally see in late july or early august and we are seeing in this march. if we don't get further water, more rain, then this is going to be common and we are going to see more and more fires like this. >> according to cal fire, from january 1st to march 15th of this year the state has already had more than 730 wildfires. last year there were 293 by this time. the average is 250. >> the black smoke. >> judy lives in pittsburgh across highway 4 from yesterday's brush fire and a couple blocks from this fire station on east leyland, which closed last year due to budget cuts. >> the drought with no rain and the dryness of the hills and the grasses and everything around, yes. and the fire they had over there yesterday really concerned me. >> according to contra costa fire, rigs from this station would have been among the first to arrive on thursday. instead crews had to come from much farther away.

in pittsburgh, laura anthony, abc7 news. >> scary stiff. but maybe some good news? >> yes, a little bit. we are looking at some rain coming our way for the upcoming work week, and also another chance of rain ten days out. this is far out and it's not a huge storm or any huge storms on the horizon, but we will take any rains that we can. for today it's a different story. you head out with low clouds and fog. 7:10 the sun will be up, setting at 7:24. 12 hours and 13 minutes of day light. low clouds and fog are with us through most of the bay area. we are seeing it locally inland but it will not be making a firm presence throughout the day. we will see it scatter out. emeryville this morning, and 49. and 45 in redwood city. low 40s los gatos. half moon bay at 50. we have clear sky over in concord and also around mountain view this morning.

but other than that the fog making an impact with cool temperatures and poor visibility from santa rosa, napa to novato. the inland east bay with a clear sky. 46 livermore. overall we are looking at cooler temperatures mainly in the north bay. 2 to 6 degrees of cooling. but with the clear sky here a little cooler in mountain view. hayward is a little milder as well as oakland. from the exploratorium camera, the forecast highlights. areas of low clouds not just confine to the coast. we are seeing them down to the santa clara valley and as far south as here. we will look for the cooling throughout the coast today but warmer weather for your weekend for the bay and inland communities we are talking maybe 2 to 4 degrees. the chance of showers comes our way tuesday into wednesday. that's not the only opportunity. here's a look at our radar and satellite composite.

high pressure sits to the west of us and acting like a vacuum, air flowing from higher pressure to lower pressure keeps the healthy sea breeze going. but it is going to be a dry pattern today, tomorrow, monday. not what you want to hear but eeventually things will change. we will take you through the next several days with tuesday night looking at a slight chance of showers up towards the north bay. it kind of miscellaneous else's, but we will be looking at another shot our day come our way with a cool day and showers on wednesday. could see a quarter inch in the north bay, lesser amounts east and south bay. but beyond that >> know this is a long ways out burks we are still looking into the end of the month, early april, and we can see the ten-day outlook looking at just more rain chances just north of the bay. but at least it's somewhere on the horizon and perhaps giving us a little moisture. today 69 oakland, 68 san mateo. cool at the coast with san francisco 63. 70 in san rafael.

ball being of the morning to feature the gray conditions. as we go through the afternoon, plenty ever sunshine. still cool at the coast. the summertime put earn with the cooling sea breeze, temperatures in the 60s around the bay, a couple degrees warmer as you head inland with more 70s, and that is above normal once again. but we have some spring showers in the seven-day outlook. that's coming up in a few minutes. katie. >> lisa, thank you. president obama said the u.s. economy hasn't caught up to the new reality that women now make up about half of the workforce n his weekly address the president said women face outdated policies that hold them back in the workplace. >> today women make up about half of our workforce and more than half the college graduates. more women now are the family's main bread-winner than ever before. but in a lost ways our economy hasn't caught up to the new

reality yet. on average a woman still earns just 77 cents for every dollars a man does. and too many women face outdated workplace policy that is hold them back. >> president obama said congress must act to address those problems. he is calling for congress to raise the minimum rage to $10.10 an hour. a public memorial service will be held wednesday for a mendocino county sheriff's deputy who would killed in the line of duty. are hundreds of people are expected to turn out for the service. he was killed last week on a violent crime spree that began in oregon. the suspect is a 32-year-old man who was later shot and killed by police. new details. investigators say the helicopter in seattle involved in a deadly crash was rotating when it took off. a preliminary report said surveillance video showed the helicopter beginning rotating counterclockwise tuesday morning. it crashed on a street next to the space needle and burst into flames.

the wreck killed both men on board and a third was seriously burned when the helicopter crashed on his car. an iraq war veteran and an anti-war activist who was injured during a protest two years ago has reached a settlement with the city of oakland. he will receive $4.5 million. he was hit in the head with a lead-filled bean bag fired by a police officer. lilian kim has more. >> there is a portion of our left frontal lobe which is and will always be dead. >> for the past two and a half years, the 26-year-old man has had to relearn to talk, cope with constant headaches and deal with memory loss. an oakland police officer shot the veteran and anti-war activist in the head with a lead-filled beanbag during an

occupy demonstration. with his lawyer he announced a $4.5 million settlement with the city of oakland. >> no amount of money, it's not going to get me my brain back. so, you know, i'm not happy. but, you know, i think this is enough. >> olson's lawyers provided this video of him in the hospital not long after his police encounter. he said he will never fully recover from his injuries. olson has permanent brain damage, which has kept him from holding down a job. in a written statement the oakland mayor jean quan said we regret mr. olson suffered these injuries and hardships and i want olson to know because of the evening's event we took steps to change our procedures. but the lawyer said nothing will change until they stop using these less-than-lethal weapons. >> all of these weapons that are fired from guns can kill someone or cause permanent injuries and should not be deployed in crowds. >> as for olson, he's not sure what the future holds, but he says he can now focus on becoming a productive person. >> now that this has been

resolved, i'll have more of a idea of to be able to think about that and find out -- find out what i can do. >> in oakland, lilian kim, abc7 news. there's another notable payout for oakland. this week the city council agreed to a $3 million settlement with a cyclist who was seriously injured after crashing into oakland hills in 2011. she was riding downhill on mountain boulevard between as scott drive and the highway 13 on-ramp. the 35-year-old suffered severe injuries to her face, head, jaw and teeth. she sued, arguing potholes made the ride dangerous. the city fixed the potholes later that year. the settlement has yet to be finalized. experts say it could be the biggest payout of its kind. a big victory for a san mateo neighborhood this thought the opening of a 711 store. they reached a settlement with

the operators to close their doors. vic lee has been following this story for more than a year and has an update you will only see on abc7 news. >> it's been an ugly and costly legal battle since 711 opened their doors just over a year ago. hundreds of residents in this quiet san mateo neighborhood banded together, signing pegs -- petitions, and demonstrating, asking the city to close it down. >> a lot of money has been spent on both sides. and even the neighbors have put up over $40,000 in legal fees. we aren't going to be reimbursed. >> they didn't want a convenience store that's open all fight and that would or might attract the wrong crowd in this neighborhood. >> 711 is not a bad company. they just don't be long right in the middle our neighborhood. >> the store sits on land that was originally designated as a residential zone. the old store, an italian deli, was grandfathered in as a legal, converted building. the property should have reversed back to residential use

when it became vacant, but city staff ruled otherwise and issued a permit. residents kept up the pressure, going all the way to the city council where they got what they wanted >> the council looked at it again and reviewed and determined that the staff's determination was a mistake and that the property had to then comply with the residential zoning requirements. >> in january a judge refuse to overturn that decision. in the settlement the city will pay $150,000 to 711 and the property owners and the store will close by the end of this month. 711 issued a statement which reads in part, we are very disappointed with the california state court's ruling. in that in good faith and relying on the permits that were issued by the city, we open this location. >> neighbors we spoke to are absolutely delighted by the settlement. the city promises them that that piece of property over there will never again revert to commercial use. you know, this really is a david and goliath story, if there ever was one. vic lee, abc7 news.

before noontime. so that will bring sunshine and temperatures just a couple degrees warmer around the bay and inland. the view from mt. tam. saw this a minute ago many but we are showing it again. before the low cloud deck it is awfully pretty. 49 san francisco, 52 oakland, good morning san jose. gray. down in the south bay 47. a few pockets of clearing. half moon bay 51 with five mile visibility. here's a look at the horizon. you see the low cloud deck is patchy from san francisco, sutro tower camera, and cool temperatures north of the golden gate. and visibility still up in santa rosa at about two, three miles. elsewhere, no problems from the delta, upper 40s concord and 46 livermore and another view from the exploratorium camera. area of low includeddiness this morning has been spreading around the bay. but despite that we will have temperatures come up anywhere from two to tour degrees over

the weekend. keeping it cool at the coast. we will see sunshine at the coast, as well. a chance of showers headed our way tuesday into wednesday. and then perhaps another opportunity into next weekend. that is a long ways out. but radar and satellite picture now shows it's nothing but high pressure. it's to the west of us. and it's weak. but it will continue to build in throughout the next several days. that will allow for the sea breeze to stay put along the coast and the pattern should remain dry today, tomorrow, monday and then the changes come. the much-anticipated changes and, of course, this is wide. the state wide percentage of normal for our snowpack is really shrinking from a put try 29% a week ago, now 25%. northern sear are you just 15% of normal. there is still pretty good snow up in the mound continues for skiing. take a look from the central to the south. very meagher snowpack, indeed. we will look for the next several days to keep the low fog
