abc7 news begins with breaking news. much. >> this is a gas leak and the san francisco fire department says there were evacuations and streets have been slut down. it has been cut. >> a truck at a construction site and pg&e is on the scene. a photographer on the ground says that you could hear the gas missing so loudly that it was sealed off, and pg&e directed the workers to dig around the break to stop it. the evacuations have been lifted

with no reports of injuries so report. breaking news continues on twitter. >> our other top story is in san jose, the mysterious shooting death of a young father. thanks for joining us. san jose police found the man shot in his car in east san jose before 5:30 this morning and sadly, he die add short time later. his family talked with matt keller who is on the scene. >> police are still here in this east san jose neighborhood. the coroner arrived in the past half hour and several streets are block off in the area. officers are still collecting evidence and talking to witnesses, but so far they have no suspect. >> it is not that unusual to hear gunshots in this east san jose neighborhood. but the sound this morning was different. >> at 3:30 i heard five gunshots back-to-back and i woke up and her the last one and it sounded like a bang and i didn't see

nothing so we went back to bed. >> two people called police and pa trillions found nothing. at 5:20 they received another call, a woman found her husband dead in the car still running. not too far from their home. >> he was reasonable shot while driving and, then, veered off down the street at a slow rate of speed and then hit the car in front of him. >> family identified the victim as 27-year-old. he grew up in san jose. he was married for two years and he and his wife have a six-month-old baby boy. he worked until 2:00 a.m. at the job at a machinist and the family says a friend would have dropped him off and believe he then went to hoof the car because of parking issues in the neighborhood when he was shot. this is a known gang area but police and family say that he was not gang affiliated. >> a big mistake. he is not something you thought

he was. you should be ashamed of yourself. you left a son without a father now. >> that was matt keller. >> five young men face murder charges in the death a teen stabbed during a fight. the men, ages 17-20 are all affiliated with the gang. according to the police the five and the 16-year-old ivan diaz got in an argument with todd tharp and tharpe feared for his life and stabbed diaz in self-defense. diaz died. the five men can be charged with homicide because they started the fight. >> the man called the central figure in the racketeering conspiracy case involving state senator yee is back in court for a bail haring. the judge released to release keith jackson on bail on tuesday if he could post adequate property for bond.

the details are not announced. >> had hood, -- ft. hood is open after the shooting rampage. four people were killed including the shooter. today we are learning more information of him and the when he used. katie marzullo is in the newsroom with that story. katie? >> sources say the shooter, ivan lopez, bought the gun in texas at guns galore where high wind advisory -- where nidal hasan purchased the gun he used. a photo of the shooter identified as 34-year-old army specialist ivan lopez. that is him but he was always smiling. >> thank you is from a neighborhood of ivan lopez. investigators are looking into the possibility that ivan lopez may have been in an argument before the shooting at the texas post. the gun, a 45 caliber semi-automatic handgun bought in texas where there is in waiting heard. >> he lived on post. we try to do everything we can

to encourage soldiers to register their personnel weapons. >> investigators say he spent nine years in the national guard in puerto rico before help lifting in the army in 2008 and was deployed twice to iraq including now months in 2011 as a driver. >> his records show no wounds, no involvement, direct involvement in combat. >> still, he was treated at ft. hood no anxiety, depression, and possibly ptsd but he was examined last month and showed in violent or suicidal tendencies. he shot and killed three soldiers before killing himself. 16 more are wounded. >> my thoughts and prayers are with the victims, their families and the entire ft. hood community. >> a trauma surgeon says of the 16 who are injured, three are still critical with neck, spine, and abdominal injuries. ivan lopez did not appear to have connections to extremist

groups. >> in washington state, officials are saying that 30 people confirmed dead in the massive mudslide that wiped out a small community north of seattle. 13 are still missing but that is down from 18 yesterday. the medical examiner is trying to figure out the identity of a mystery man whose remains do not match the description of anyone on the missing person's list. the only clue is the gold teeth. they hope that will help determine his identity. a special task force in san jose state will hold another public hearing to look into racial tension on campus after alleged hate crimes. the 18 member panel of students and community members has met four times over the past few months. this comes after a black student came forward claiming his four white roommates tormented him for months. the students have been suspended and face hate crime charges. the task force meets one more time after tonight and will make its wreck diss for new --

recommendations for new policies this month. >> san jose state confirming that 18 of the resident assistants are on longer employed by the university. the statement released to abc says the assistants worked in several dorms on campus and this is called a "personnel" matter and will not comment on why they were let go. they have been hired for the upcoming fall semester, they are asked to fill in. four students have been charged with the hate crime and battery against their black roommate. we are driving over the best kept roads in a decade according to a new report. nick is on move in the east bay with more on why the state is telling you one thing and your car could be telling you something else. nick? yes, we asked our viewers this morning at abc7, to sound

off on what roads they thought were the best and worst. starting out at the lowest, would have been i-80 which my partner is driving, eastbound on 80. they said that the potholes are a problem. this was not the worst. number two, would have been 101 in san jose right there at the junction. three, 580 at the altamont pass. the worst, the one that kept coming up over and over and over is i-880. >> 880 is the worst. >> at one time the 22-minute delay from this stretch was so filled with potholes that it gave california the distinction of having some of the worse highways in the nation. this stretch even had a nickname: the nasty nimitz. >> we asked viewers to tell us which they ranked as the worse and the nimitz was on top repeat through. according to a report by caltran, 84 percent of california highways are in good

operating condition. but commuters that use the roads regularly are not so sure. >> there seem to be a lot of construction on 80 around the altamont pass -- no, excuse me, 880. they seem to try to fix that area. >> it is a challenge. >> a $3.9 billion infusion of cash the past several years for road paving is almost gone. money from the recovery act and proposition 1b was one time only programs. >> with people driving less, which they should, that is all good, but that is where the funding comes from so it is a double edge sword. >> one of ten miles driven in america is driven in california. 40 percent of all god brought to america are brought in on california roads. the bay area is mostly at the port of oakland. >> a fully loaded 18 threer is equal to 5,000 passes of an

this is disturbing video from texas, a school bus driver boxing a crying girl and encouraging others to do the same from san antonio, texas. a student says that there is a sign on the bus that reads "no bullying." the superintendent tells abc that the bus driver in question is no longer employed by the district. a second baseman for the new york mets is facing credit civil for taking paternity leave to be with his wife after the birth of their son. daniel murphy is entitled to throw days of life under collective bargaining agreement and only missed two games

well below average, along the coat we have upper 50's to nearly 60 degrees. at the game tone, we are back to a regular schedule with no threat of wet weather. marine wees are in time take on the a's but it will drop down to 52 at end of the game and keep dropping into the mid-40's to low 50's with cloud cover and all the blanket effect will keep our temperatures up. you can see scattered light rain developing during the overnight hours. not all of us will get it, it will be scattered. a week ago on tuesday we opened the storm door and this is the last one and the weakest of all of those so the rainfall amounts are minuscule. 11:00 tonight and light showers are along the sonoma county coast hanging around until 8:00 or 9:00 and more scattered at
