but the question this morning, was it all a stunt for his new film? you know, he's known to think and act outside the box sometimes. lot of people are debating that topic now. >> conspiracy theories abounding. and remember the cronut craze? we actually tried them on the set one time. this is where the pastry was created. it's been shut down by the health department. the unappetizing things they found in the trendy bakery coming up. >> going to disappoint a lot of people. first new revelations about the deadly shooting spree at ft. hood. we're learning about his possible motive and the victims of his rampage. abc's alex perez has the latest from the military base in texas. alex, good morning. >> reporter: good morning, bianna. for the first time, we're seeing one of the survivors, sergeant jonathan westbrook. he came face to face with the gunman. this morning, an exclusive look at sergeant jonathan westbrook reuniting with his family overnight for the first time since he nearly lost his life at ft. hood.

westbrook's father drove ten hours from mississippi to be with his son. you think your son is overseas and worry something can happen to him if he was serving somewhere else. he was right here, at home, on base. >> that is beyond my ability to express or describe to you. my son was deployed to afghanistan last year, and he came back here to a u.s. military insulation that's secure and almost lost his life and got wounded. >> reporter: sergeant westbrook was one of the first people shot, twice in the chest and twice in the arm. >> we walked the floor, we cried, we prayed. we allowed ourselves to think of the worst. >> reporter: westbrook says lopez had been in the office shortly before the shooting, asking for a leave of absence form. when he was told to return for the form the following day, lopez apparently lost it and stormed out.

>> he came back with a gun and opened fire. >> reporter: the gunfire killing staff sergeant carlos rodriguez, sergeant timmy owens, and daniel ferguson, sergeant first class. his fiance says he was killed while holding a door shut, trying to protect a room filled with military personnel. >> since wednesday, we've been to hell and back. >> reporter: and mr. westbrook says those seven hours without his son were the longest hours of his life. there are already plans for a memorial to remember the victims here in ft. hood next week. dan, bianna? >> alex, thank you. lot of open questions in the story. we'll continue to cover it right here on abc news. meanwhile, we want to check the other overnight head lines. for that it's mr. ron claiborne. good morning, sir. >> good morning. we begin with terrifying moments on a city bus in philadelphia. a passenger springing in action after the driver is knocked out of his seat trying to dodge an oncoming car. this happened friday night. police say the driver of a white

mazda ran a red light and slammed into that city bus, jolting the driver out of his seat. the bus went careening on to the sidewalk, striking several parked cars before taking down a street lamp. a quick-thinking rider dashed to the front of bus and slammed on the brakes. 23 people, though, were injured in that incident. a major child seat buckle recall to tell you about this morning. evenflo is recalling 1.3 million buckles found in eight children's convertible and booster seat models. the company says the buckles may become stuck and children can get trapped in their seats and could not be removed quickly in an emergency. owners will be provided with replacement buckles. and take a look at this dramatic video of a brazen smash and grab break-in in broad daylight. this happened in england. footage recovered by an on looking showing a gang of masked robbers, carrying what appears to be axes, smashing into the

jewelry store. at one point, one of the robbers uses the ax to persuade a passer by to get away from getting too close. the suspects took off in a get away car with a number of stolen watches. and former nfl quarterback and sports show host, boomer esiason is apologizing for some controversial remarks he made about met's second baseman and new dad, daniel murphy. murphy missed the first two games of the season on paternity leave to be with his wife in florida following the birth of their son. earlier this week, esiason suggested his wife should have scheduled a c section so murphy wouldn't miss any baseball games. >> i apologize for putting him and his wife in the midst of a public discussion that i basically started by uttering insensitive comments that came off very insensitive. for that i apologize. >> murphy has defended his decision to be with his wife and newborn. and 8-year-old joseph lee from denver is nursing a broken leg and kind of a broken spirit a day after being on the slopes he took a dangerous turn. joseph's mother was recording

her son skiing when suddenly a man, you see him there, cuts off the boy, runs right into him and, dan, imagine this he casually takes off, the adult does. under colorado law, the downhill skier always has the right of way and you're required to stop if you hit someone while skiing and help them. this guy didn't do it. joseph said he just wants the skier to apologize for running into him. and an all-star move by a yankees legend derek jeter. it happened during thursday night's game against the houston astros in houston. jeter spotted a little girl wearing a derek jeter jersey. number 2. and went other to her to give her a ball as a souvenir. fans, grownups in front kept trying to grab it for themselves. imagine that. after some pretty slick moves, jeter got the ball to the little girl. yankees beat houston, by the way, bianna. and finally, cronut lovers, everywhere, you may need a moment for this one. the bakery that makes this donut hybrid has been shut down by the

new york city health department due to a severe mouse infestation. kind of sickening, but the shutdown comes after this video surfaced of what appears to be a mouse racing through that bakery. the designer donut hot spot has a die-hard cult following with lines stretching for blocks. the bakery says they're exterminating and hope to reopen soon. i don't know if they'll still get those crowds after this. >> what's next, the ramon burger, my other favorite food. enough bad news for one morning. >> ask your doctor about that. >> great segue to our medical news. >> i still like them for the record. >> you'll be back? >> i'm forgiving. we turn now, though, to the backlash against a new painkillers. zohydro hit the market just last month. already massachusetts has banned the prescribing and the dispensing of this drug. >> vermont issued an emergency order to make it harder for doctors to prescribe this drug. let's bring in dr. jennifer ashton with more on this. good morning, dr. ashton.

>> good morning, guys. >> so we talked about this drug when it came out last month. what's so different about it and why is it to easy to abuse? >> you have to remember the premise of medicine is to do no harm. when you talk about a drug like this, i'm not sure the benefits outweigh the risks. this is an incredibly pure, powerful opioid narcotic. it does not contain acetaminophen. it stays in the body longer. than other traditional painkillers. it's igniting a fire storm of controversy within the medical community and the public alike. >> the fda did approve it. there must be some benefits, right? >> yeah, dan. the benefits -- this is another big tool in the arsenal against chronic pain which affects 1 in 3 americans. this is not for short-term usage. it's for use for more than three months. the big thing with this drug, zohydro, it doesn't contain acetaminophen. and that is important. we've heard a lot about the fact that acetaminophen overdose

accidentally when taken with opioid narcotic is the leading cause of acute liver failure in this country. that's potentially a huge benefit. >> we should mention that the maker of the drug says they'll set up a board of experts to review. what can we expect them to do? i was interesting in what you told me off camera. this is really an american problem. >> absolutely. we use more than 99% of the world's opioid narcotics here in this country. the risks with this, which are the risks of all of this class of medication, it has a very high potential for abuse, very high potential for misuse and accidental overdose and addiction. so, they are going to be looking at this very, very carefully. the big opponents to this drug have a problem with the fact that it doesn't contain any abuse deterrents. therefore it can be crushed, it can be inhaled, it can be injected. that's the last thing we need with this class of medication because misuse is already a massive problem. >> thank you for bringing this to our attention. >> proceed with caution. >> work with your doctors on this. >> absolutely. >> all right, jen, thank you. >> you bet. we turn now to the bizarre drama playing out in a courtroom in florida.

a man defending himself at his own murder trial. his angry outbursts have the prosecutor voicing some anger of her own and demanding a judge take action. abc's gio benitez has been following the case. good morning, gio. >> reporter: good morning. the man is charged with killing his 21-year-old wife within days of a rushed wedding. now a strange series of events right there in court, prosecutors feeling threatened as the judge calls it all a circus. it's a bizarre murder case playing out in a florida court right now. that's 42-year-old michael escoto. accused of murdering his new wife, wendy, just days after their marriage. the allegation, he did it to collect $1 million in insurance money. now, he's representing himself in court. here he is addressing the witness on the stand. >> say that again. >> objection, judge. >> reporter: that outburst leaving the judge to hold him in contempt of court. >> this is not a circus and it

is not a show. this is a murder trial. but we're not going to make it a comedy show. i'm not going to allow that. >> reporter: friday, a twist. prosecutors telling the judge that escoto is dangerous. >> this defendant is a time bomb waiting to explode. >> reporter: and even with the contempt of court ruling, prosecutors say they fear for their safety. >> that's not enough for me to feel safe. it is not enough for my partner to feel safe. >> reporter: now prosecutors are asking for the tables to be rearranged in court so they would be far enough for escoto reach. watch as escoto cross-examines his own mother-in-law last week. >> did you think that i could kill wendy? [ speaking in foreign language ] >> translator: i never thought you would be capable of something like that. you were her husband. >> reporter: and escoto has pleaded not guilty and has said, only a moron would kill someone for insurance money. the trial is expected to last at least another month, dan. >> quite a case, gio, thank you.

we have a big new twist this morning in the greek yogurt wars. and now it's getting personal. the ex-wife of the man who founded chobani is coming forward with an allegation that he illegally bought the recipe from a competitor, fage, the company that started the whole greek yogurt craze here in america. and abc's reena ninan is on the story this morning. good morning. >> reporter: good morning. oh, boy, the marriage of the founder of chobani yogurt may have soured but the greek yogurt industry certainly has not with billions of dollars at stake. the yogurt wars keep churning. >> it's hard these days to find food made with only real natural ingredients. >> reporter: it's a battle for your taste buds. >> plain will never be the same. >> reporter: in a matter of years, chobani yogurt unseeded fage becoming the number one brand of greek yogurt in the u.s. but this morning, could allegations of espionage sour business? the former wife of chobani ceo hamid ulukaya alleging her

husband simply stole the recipe from fage. in an affidavit obtained by abc news as part of her lawsuit over shares of ownership in chobani and its predecessor company, hex wife ayes giray says he bragged he got the recipe by bribing a former employee of fage with over $41,000. now she's suing her former husband. >> we're talking about big dollars here. but the only way that it's going to have a real impact on chobani is if the company, who she says he stole the recipe from, were to take legal action. >> reporter: and that special recipe, according to chobani's youtube page -- >> almost 18 months in the kitchen. we try to do it as pure as possible. >> reporter: on the competitions website, fage claims it's made with a family recipe dates back to 1926. just milk, cream and live active cultures. chobani denying any theft or espionage. telling abc news, the

school for boys, teens who got into trouble with the law. during a visit there last fall, had the idea of returning to talk about and teach what we do. so last monday, a group of us from abc and abc's affiliate wpvi, philadelphia, we put on a tv news workshop. i got to tell you, it was an amazing day for all of us. we began our marathon day meeting our 24 students in the school's library. >> from 4:30 to 7:00 a.m., you turn on channel 6, you'll see me there. >> i started off in the music video aspect. >> i am the chief photographer at wpvi. >> they told us a little bit about themselves. >> i'm the type of person that likes to take on a lot of challenges. >> i want to be an actor. >> reporter: then it was time to roll up our sleeves and get down to helping these young camera men, reporters and editors put their stories together. >> we're speaking to this baseball coach and we're talking about her being a baseball coach in news, you want to see that. >> reporter: we helped show them

how to write their stories. >> you have a female coach and this is an all-boys school. that's pretty unusual. and how to really tell them. imagine yourself before you start saying check this out. this is something you want to pay attention to. >> do you know a girl who everything is dramatic, but every story is, oh my god, do the story the way she would do the story. >> reporter: and finally put it all together, edit it into a real news story. >> throughout the piece, make it stronger if you hear the background noise. >> is there something he said quickly that you can lay in? >> grab people's attention. >> reporter: the results, well, have a look. >> those sounds and images of hard work inside the glen mills weight room are the keys to success. >> having a female in your lives to feel like that will benefit you guys in the long run. >> perhaps none, literally, are as big of a success story as jay thompson. >> reporter: it was all a lot of fun, but more important is the lesson we hope these bright young men full of promise learned that there is another way, another path in life that they can succeed.

>> and you know, they really were a great group of young men. smart and curious, engaged and pretty darn good at writing and shooting and editing video. yes, they have made mistakes early in their lives, but every one of them, every one of them showed genuine ability. these guys can do anything they want to do, they just have to believe it. and, you know, i just want to add a note here. one of the guys in the group was louis who is the chief photographer for 38 years. at wpvi. he retired yesterday and he really connected with those guys with his own stories of his experience and his upbringing. some of them talking to them, they actually had tears in their eyes when he was talking to them. >> congratulations to lou. >> it was a great thing. >> you said they have to believe it, but it works both ways and people have to believe in them, too. it was fabulous. >> that was one of my messages. >> watching you with the hat on. you're a great teacher, ron claiborne. >> i love it. it was a great day, i have to tell you. >> great teacher and great story teller.

dino guglielmelli, seen here in this interview about fda regulation is the founder of a multimillion dollar natural products company which distributed his wife's skin care line sold at hundreds of drugstores nationwide. >> i have almost 400 employees. i am a success story. >> reporter: but the business went bust, filing for bankruptcy after guglielmelli was arrested in october, accused of attempted willful, deliberate and premeditated murder and solicitation of murder. according to court documents, guglielmelli asked a friend to kill olsen. that friend recorded their conversation and went to police. >> when the jury hears the tapes, they'll understand that he was manipulated by somebody who was trying to help himself. >> reporter: guglielmelli's defense attorney says his client was set up in the midst of a bitter divorce battle. olsen declined to comment but is reportedly focussed on

rebuilding a once glamorous life, hoping to save her home and business. guglielmelli is now in jail on $10 million bail, expected to remain there at least until his trial is complete. that's expected to begin next month. his company and all its assets have already been sold at auction. dan, bianna? >> thanks to you. lot of other stories developing over night. for that let's go to ron. hey, ron. >> bianna, dan, sara haines. good morning, everyone. we begin with a dramatic rescue in the high seas. the california national guard boarded military planes to reach a 1-year-old american baby girl who needed immediate medical help. the baby developed what looked like a life-threatening rash while on a sailboat with her parents. they were 900 miles off the west coast of mexico. luckily help got there in time and she is now, the baby girl, in stable condition. and overseas, voters in afghanistan are lining up for that nation's first democratic transfer of power. those voters defying a threat of violence by the taliban. outgoing president hamid karzai cast his ballot on saturday.

ballot boxes were deliberate to polling stations. and take a look at this. a woman reels in a record tuna in new zealand. several boaters battled the nearly 900 pound pacific blue fin for nearly four hours before finally getting that fish on to the boat there. the largest tuna ever caught by line and hook. imagine this, it's worth $2 million. $2 million. and the fisher woman, she has no plans to sell it. i'm not sure why. finally, a play date with a prince. prince harry of britain let loose with some children after queen elizabeth olympic park opened in london, taking a spin on a huge swing. the park opened saturday to the public for the first time since the 2012 olympic games there in london. maybe next time try doing something more comfortable on. instead of going around in a suit playing on a swing. little unusual. >> field trip of a life time for those children.

good saturday morning, everyone. i'm katie marzullo. it's 8:00 a.m. here's a quick look at the weather with lisa argen. >> good morning. we give the radar a break today. the radar on top of mount st. helena and in the south bay, a little bit of sunshine. 50 in oakland. 51 in san jose. we have some cloud cover there. half moon bay also is at 50. here's the plan for the rest of the day. we'll see the clouds continuing to scour on out. but the winds will be breezy. certainly at the coast, keeping the numbers in the upper 50s to the low 60s there. we will be near 70 today in the livermore valley.
