flipping the plane and flew close to the ground and the plane veered and slammed into the ground. witnesses say the plane burned on the tarmac for some time before the fire crews could get to it. >> an eternity for first responders. >> why weren't they getting out there? every five seconds it seemed to take forever. >> officials say they will hook into the positioning of fire crews during the show. >> another witness at the show posted video on youtube show the plane on fire with thick smoke coming from the wreckage as first responders arrive. our reporter will have more coming up in a report in 30 minutes. we will have the latest on the air show tragedy and we have updates at abc7news.com and

twitter@abc7newsbayarea. it is cinco demayo but rather than celebrating mexican heritage several groups are planning protesters at the center of a flag controversy. matt keller is at a high school in morgan hill. matt? >> police are going to increase patrols around live oak high school. you can see there is a large fence with no trespassing signs. this is a precause ahead of the rallies. the democrat indication is four years after several students wearing americaning ins were sent home from school during a cinco demayo celebration, some parents sued the school saying rights of free speech were violated and a judge cite add hit of racial tension at the school which is appealed. two separate demonstrations are planned from opposing groups.

patrolling the streets last night, with violence and vandalism marred past celebrations in downtown san jose. officers made at least one arrest related to the festivities. d.u.i. law enforcement patrols will be out in all bay area counties. they want people to have fun but stay safe. if you celebrating cinco demayo you can get a free ride home from aaa with free rides and towing to crackdown on drunk driving from 6:00 p.m. to 6:00 a.m. tomorrow providing a one-way ride home up to ten miles for drivers and their vehicles. membership in aaa is not required and the program is open to everyone. bay area-baseed lawyers is offering free cabs until 4:00 a.m. >> dublin police shot and killed a man who attacked them with a baseball bat. we are hearing what happened through the voices of officers on the scene. >> shots fired. shots fired.

>> dispatch, shots fired. >> officers went to the home to investigate a domestic dispute at 6:15 and they say the man attacked an officer with a bat and the officer shot the suspect and he died at the scene. a neighbor says this is not the first time police have been called to the home. >> a few times the cops have been called and it ends up being a disturbance going on and either nothing happens or the person makes the phone call ends up being the one they take away. >> no word on the man's name. police are part of the alameda county sheriff at dublin. the sheriff and the district attorney are investigating. an argument between two men led to a fatal shooting in richmond. paramedics found the victim near virginia avenue and south 12th shot in the torso and died at the seen. investigators have not released the victim's name or a description of the suspect who left the scene.

outside. santa rosa is 48, for a cool spot and san rafael and los gatos at 51. and 52 in napa. 50 in half moon bay. everyone else is around 53 to 57 degrees. the temperatures are close to where we were at this time yesterday but for half moon bay is about five degrees cooler. how does it translate going forward? next 12 hours we are mostly cloudy, with temperatures staying about where they are, all the way through 7:00. by noon the clouds will open and you will see the temperatures on the cool side of average with 58 at the coast and low-to-mid 60's around the bay and inland and that is where we will stay for the better part of afternoon with an outside chance of a sprinkle or two but there is just not a lot of moisture in the lower level of the atmosphere so anything that falls in the higher elevations would be best chance of it reaching the ground before it evaporates and through 7:00, grab a coat because it will be breezy to the low 60's. leyla gulen?

we spoke with the climber and his family. >> i feel grateful to be home. >> john is back home with his family but with a new perspective on mount everest two weeks ago when an avalanche killed 16 guides. the mountain's most deadly day after another. all afternoon, clipping one guy after the next, and hauling the bodies and we were stand there watching and one body after the other, like vietnam. >> this was his second trip to mount everest. he hoped to reach the summit this year but now he is thankful he is alive and credits his sherpa guide for pushing him out of the way when the avalanche came roaring down. >> he turned to me, get out, get out, and that is what we did, we upped behind a big block of ice and we let it blow past us. >> since the disaster the guides have essentially called a strike demanding death benefits for
