live from the kgo-tv broadcast center this is abc7 news. american flags are displaid outside a south bay school on the cinco demayo to draw attention to a flag controversy born on this day, at this school, four years ago. good morning, protests are taking a stand at a morgan hill high school where four years ago the school order kids to remove their u.s. flag t-shirts born on a day that celebrates mexican heritage. police are on hand at live oak high school. >> police say all went well for

the demonstration at live oak high school but they are not done. two more profits are planned in morgan hill in response to the american flag controversy. >> cinco demayo is not just another day at live oak high school in morgan hill. since four students were sent home from school for wearing american flag t-shirts in 2010 the lawsuit surrounding the she was recently dismissed by a judge, sparking new passions. this morning, several police officers kept an eye on east main avenue at the campus. the local tea party group held large american flags in silence. >> we didn't bring signs. we didn't bring anything with words but were silent and leaving right now when we are done because school -- we did it before school so we do not disrupt the school. ♪ stand beside he >> the official protest was quiet it created an opportunity for others to turn it into a spectacle for students arriving.

two teens were holding a poster saying they were from the doughnut party hand out pastries. another group showed support for the demonstrators and others came to watch. >> just to watch what happens. >> this doesn't happen every day. >> students created banners and placed them on the fence surrounding the campus. one is a picture of an oak with the roots and another said "united at the roots," and the other says "we are different branches of the same tree." a video was posted on youtube and facebook pages showing students visiting class to talk about incident four years ago and respecting different cultures. many of them have grown tired of the attention. the teachable moment is for adults to listen to the kids about wanting to respect and accept each other's criminals and understand that other people can have opinions and people can disagree with each other.

and still get along. ought roast groups agreed to hold their event at two different locations at two different times to keep them peaceful. the parents of one of the five students has touched off the controversy four years ago turned out at the rally to express their support. daniel is a student at the university of nevada and an mirv reservist and his mother says that despite the we time, they still ready to appeal the case to the 9th circuit. >> he was accused of being a troublemaker and not being part of the unity by wearing an american flag and now he is out there defending the flag. that is what it is about for the kids. their ride in their country. >> he wants to be a military lawyer directly inspired by the flag controversy. >> expect to see extra officers in san jose on the streets

downtown from now through tomorrow morning. police want to make sure that cinco demayo celebrations do not get out of hand. they were out in full force patrolling last night. the violence and vandalism have marred past celebrations in downtown san jose. d.u.i. law enforcement patrols are out in all bay area counties. >> happening now, lockdowns at two schools have been lifted after a man was shot driving his car nearby at lockwood elementary school at 65th avenue. lockwood and haven court middle school were briefly put in lockdown mode after the incident. right now we have breaking news. the ntsb is at travis airbase with a news conference on a pilot who died. any recommendations to prevent this accident from happening again. >> each of our investigations we

investigate the pilot, machines, the operational factors and the environmental factors. the focus today is the documentation of the on-site. we are looking at ground, at the wreckage. we are focusing on the site, factual information only. we will be doing recovery of the wreckage today. we will be following that up with a secondary exam and a more detailed fashion tomorrow at a secure lotion that will occur in pleasanton grove, california. the investigator in charge is mike huhn, and any further reports will come from mike huhn or our public affairs office in washington, dc. >> it was let-level inverted pass to cut a ribbon. >> how far off the ground? >> i don't have the exact height but that will be part of the factual report [ inaudible ] can you describe the type of training a pilot of this caliber needs to have in order to performance act like this? [ inaudible ] >> the f.a.a. provides guidance. they work closely with the international council of air shows to come up with pilot certification standards and that is going to be part of investigation. we don't have the exact numbers required. that will be part of our factual investigation. >> what part of the investigation will response time and emergency crews fit into the investigation? why did it take five minutes to reach the crash site? thank you is in the operational factors of the accident and that is typical part of the

investigation looking at response time so that will be part of the operational factors and will be in the report. >> highway helpful are the videos? are you still looking for folks to turn those in? how helpful? >> always helpful because you have different angles and viewpoints. we have quite a few and i believe we have the accident sequence so i don't believe we are asking anymore but they are always very helpful. >> have you been able to get anything? >> we have. we have a lot of videos. obviously we have not had time to look at all of those. we are focusing strictly on the perishable evidence, the site with the ground scars and the wreckage, before it is moved. >> are there regulations regarding the distance of the responding crews, the fire department, and the housing to where they would be responding?

is there a regulation regarding the amount of time for response? >> those regulations are part of the operational factors we will look at. there are standards. that is part of what we will evaluate and if we determine deficiencies and we see recommendations to change those, we will do so. this is all part of the investigation. we are just focusing on the fact you'll -- factual part of the investigation. >> do you have the exact response time? >> thank you is part of what we will develop. that is stuff that can be developed later. we are focusing on the perishable evidence leaving today: wreckage, ground scars. that is what we have to focus on. the other stuff will be developed. will it be developed by the time we publish the preliminary report? i don't know that but it will be part of our factual report and

of the crash during the air show before a crowd of more than 1,000 spectators. >> i could see the plane upside down and burning and then it was engulfed. >> it was 50' above the runway in the middle of a maneuver when it crashed. >> i heard them say if you have any children with you, they were saying over the speakers, "hide their eyes." the pilot, 77-year-old eddie andreini of half moon bay had performed in a thousand air shows and was a fixture in the community. in 2004 the international council of air shows gave him the sword of excellence award the highest honor an air show pilot can receive. >> mr. eddie andreini has been flying since he is 16 and lab performing in air shows for the past 25 years. >> the ntsb and f.a.a. are leading up the investigation and are asking that anyone who may have taken video or pictures

share the information to be used by authorities in the investigation. we have developing news, police are investigating the circumstances surrounding an officer's fail shooting of a young man. he came at them with a baseball bat last night. amy hollyfield joins us from scene. >> people in the department complex are upset, they say the 8-year-old-- 18 year old man way polite. police have not responded about the situation, but he was 18 years old when he was shot and camed. a woman lived in the parent unit with her two kids, one 18-year-old male and his older sister. the officer was attacked by a man with a baseball bat and he felt his life was being threatened and the officer shot and killed him. it happened at 6:15. a neighbor we spoke with says he heard a woman yelling "don't

shoot him." and she her the shots. >> the people that live down there are such nice people and my part is going out to them. the whole thing has had all shaken up. >> police released a statement saying that they were called to the home because of a domestic disturbance and they did not elaborate. they put the officer on paid leave. he was injured but not like-threatening injuries. >> we have placed several calls and e-mails into the police department and not heard back. we are working to talk to the high school where the 18-year-old was a student. stay with abc7 news as we continue to follow the developing story. still to come, a football legend's name comes up in a corruption investigation that took down a state senator. >> and

a new report reveals that joe montana came up during the corruption investigation into to senator yee and raymond "shrimp boy" chow but nothing was found and the f.b.i. dropped the probe. according to the san francisco chronicle, an f.b.i. operative contacted montana about an unspecified proposition.

los gatos and all the bay area there is abc7 news. >> today is the start of cal f.b.i. station in northern california saying they have responded to 1,200 blazes already to year more than double the usual unusual. drought conditions are not making things easier for you crews or homeowners. >> and meteorologist mike nicco shows how the temperatures are going today. >> we have school weather on the deck and it feels okay if you are in the sun but in the shade, it will feel cooler because of the breezes and the lack of a sunshine. behind me, we have openings in the cloud. we woke up to a lot high clouds but a brownry moved through and chased the high clouds an and we are left with low clouds with just enough moisture to be kicking off a few showers and one or two will stray into the northern neighborhoods but it will probably fizzle before it gets here. when the sun goes down, the showers are going to be over, but the breezes will hang around and look how fast they are, the guffs are up to 25 to 30 and we

are sustained at 10 to 15 miles per hour in most areas coming off the water and it will be cooler-than-average today. look at our temperatures right now, we are in the 50's in san francisco, and san rafael and everyone else in the low-to-mid 60's. today, from sutro tower to the north it will be partly cloudy with the breezes keeping us feeling cooler than we should be for this time of the year. any showers will remain north with breezes rolling in, in the warming trend on thursday through the weekend. in san jose we are getting more break in the cloud cover with temperatures across the board anywhere from two to seven degrees cooler than average sunsetting at 8:04. 67 in san jose and mid-to-upper 60's on the peninsula and millbrae, a breezy 62 and upper 50's along the coast and
