novemberments are on twitter@abc7newsbayarea. . >> in the mission district of san francisco a beer truck driver making a delivery was hit by a motorist who may have had a flat tire. >> driver fled the scene. police are looking for a grow sedan with white stripe. you can see the beer cans on the ground. the condition of the victim is unknown but it is not appearing to be serious. a lost news happening today. another big story, wal-mart is responding after a stunning attack inside a san jose store of a four-year-old girl. she was attacked by a crowbar by a random woman. matt has the latest. >> wal-mart is responding and the district attorney is responding. i have breaking news to report in the last three minutes. i was given the information that the district attorney is now in the process of filing attempted murder charge with hate crime allegations and assault with a

deadly weapon charge with another hate crime allegation. this comes from a 20-year-old woman attack add four-year-old in the wal-mart. this case has disturbed the community. >> the parking lot at the wal-mart in east san jose is busy again. this was the name seem of the day when police say a 20-year-old maria garate attack add four-year-old sitting in a cart while shopping with her farther on tuesday. the father jumped to the rescue and during the assault he held the woman ground. the suspect is described as a transient yield at the child and said she deserved it. the family did not know maria garate. people we spoke with were obviously disturbed. >> the world is going crazy. people are nervous. people are...it is crazy. especially in this area. we need help in this area. >> if you have little kids...stay close to your parents.

watch your kids. you don't know when something will happen. >> i talked with a spokesman with wal-mart and she said our notes and prayers are with the family. we appreciate the police's quick response. security has been increased the past year. wal-mart is working with local law enforcement in the investigation. police were given surveillance video from the store and are saying the father likely saved his child's life. >> this is any parents' worst nightmare happening in front of the parent. he does what any parent would do. he is struck but he stops the attack. aought girl was taken to the hospital with non-life-threatening injuries and maria garate will face attempted murder, assault with a deadly weapon and a hate crime enhancement add an arraignment scheduled this afternoon. matt, thank you. you may recall this is the same wal-mart involved in this wild scene a year ago.

surveillance video captured a car plowing through the front of the store in march of last year. he ran into a beer display and jumped from the car swinging a bar at people. three shoppers and an employee were injured. the man was then tackled by shoppers and held until police arrived. he has been charged with attempted murder. antioch police want to know who used a u-haul truck to break into a drugstore. the driver and one other person tried to steal an a.t.m. from the cvr store and the police chased the truck. officers captured a man who jumped from the truck after the chase entered concord. he needed treatment at the hospital. the driver get going that was driving the truck. part of san francisco is shut down at market after a big rig crashed into a funeral home. haz-mat crews are on scene. that is where amy hollyfield joins us from the castro.

amy? yes, in is a delicate operation. they are dealing with the file that was on truck. westbound market treat is closed. we have major progress, the most all morning, now with the cab getting loaded to tow away the truck 11 hours after it crashed and burned. >> man who took this cell phone video her the accident first. he was shocked when he saw it. he said it did not sound like a vehicle crash. >> the soup was so loud it sounded like steel girder falling 20 stories off of a building on to the cement. >> a tractor trailer headed down market street in castro district at 12:30 crashed into sullivan's funeral home and burst into flames. there were two men in the truck. >> they were fortunate. i expected to find human remains in the vehicle. they were not seriously injured.

>> the gas tank blew and the flames shot into the air. >> this woman lives above the funeral home and saw so much orange she thought for sure the business and her home would be destroyed. >> the color of the room and the sounds, i thought half of the building was gone. i thought, it is time to get out. >> firefighters say fuel on fire was floating down market street so they evacuated the lodge next door. it took an hour and a half for get the fire out. the cab of the truck was unrecognizable but the 90 year old funeral home was saved. it was scorched on the outside but fine on the inside. >> no loss of life. >> late morning westbound market street was still closed. many wondered why the truck was still there and the motel gusts who saw the accident. >> i expected it to be gone and back to normal when we got up.

nope. >> there is the other half, the trailer. police think it will be another hour or two hours before all of this is gone. the driver told police the hud of the truck popped open. he lost control. he hit this median. he then careened to hit the funeral home. he and the passenger are okay. it is a miracle. they had only minor injuries and were treated. firefighters are still working to gain the upper hand on fires burning in san diego county. this is how the wildfire in san marcos looked burning out of control close to many homes. hayward fire department left to help crews put out the flames. cal fire strike teams from northern california are on the frontlines. our reporter has the latest from carlsbad. smoke and flames climb through the rafters of the

in new york a permanent museum was opened this morning to honor those who died in september 11th. president obama and michael bloomberg toured the museum at the world trade center site. katie marzullo? president obama said no act of terror can mask theç strengh and character of the united states. a somber and powerful return to a horrific day that carries so much emotion. >> family members of victims, first responders and survivors, gathered at what was the site of the world trade center joining president obama and political dignitaries to dedicate the museum. he said we can see the faces of the 3,000 innocent victims of the attacks and hear their

san francisco is not closed. no. a high-tech prankster amused commuters in san francisco and offered some commentary on the heat wave. this morning, a technician reprogrammed the sign and provided some insight on this kind of hacking. >> you need to know what you are doing, to do this. >> well, yeah, you have to have some experience. it is really not that hard. if you are not familiar it could be tough. after a few key strokes it displayed the message that was desired, van ness avenue is closed from 6:11 on sunday morning because of bay to breakers. >> hacker has a sense of humor. >> the first head has rolled in the jay-z altercation. the standard hotel to new york city has fired the hotel employee who recorded this video

the world has seen showing the sister of superstar singer beyonce attacking her husband, jay-z a week and a half ago in an elevator after a party. the employee report through sold the video to tmz for $250,000 after shopping it around for a few days. the hotel says they fired the employee and will try to get the individual prosecuted to the fullest extent. moving on, is the heat wave over yet? well, starting to see the signs. meteorologist mike nicco will check out what is going on in your neighbor. >> look to the left at the ferry building, the wind is not moving. looking to the north to the wharf i can see the fog encroaching on alcatraz and the temperature at ocean beach is 59. in downtown it is 76. the sea breeze is developing. we will see it on live doppler 7

hd. you can see the clouds. they are hanging out on the coast. you can see the last couple of hours it is moving in. this a sign that things are changing. the winds at half moon bay are at 14 miles per hour. as we head through the afternoon hours, watch the sea breeze develop and get aggressive to the evening. you will feel it in the east bay valley. it will be a different evening than the last couple of evenings and you will notice the cooler weather during that timeframe. right now the temperatures are the same. they are even warmer at sfo. look at half moon bay, that is a sign and santa rosa is five and four degrees cooler. 64 at half moon bay. 73 in san francisco. it is 91 in antioch. it is 92 in los gatos. mid-to-upper 80's inland with 80's in hayward and san rafael. the heat is not going to dissipate in all areas. the drive home or if you are headed northbound from san francisco you can see the golden

gate bridge is socked in with the marine players and to ocean beach easy to see why it is 59. coast a.m. clouds are the rule. the rest of us have high clouds and sunshine. it will be as hot as yesterday. you will speak better tonight in most areas. especially the areas without air conditioning. it will be nearly normal. in san jose, though, another hot day for you at 93. that is a degree cooler than year's record. san rafael, oakland and san francisco at seven to nine degrees cooler than year. a low-to-mid 90's in the south bay. gilroy is warmest at 98. we will hit 90 on the peninsula at redwood city and then mid-to-upper 80's and mid-70's along the coast if we are lucky to nearly 80 in downtown and south san francisco. and mid-80's through the north bay valley and mid-to-upper 80's along the east bay shore and low-to-mid 90's in the east bay valley. heading to the game, it is going to be more normal by the end of the game at 70 degrees, dropping to a breezy 61.

san francisco leaders want director george lucas to consider building a museum for his hollywood and memorabelia on the water front. the site is across the embarcadero from pier 30 and 32. the warriors abandoned plans to build a new arena on the piers because of strong opposition. lucas has been looking for a home for the museum since the
