confronting a 12-year-old boy on campus and putting her happens on his throat and telling him not to bully her daughter anymore. the school district is also reacting. >> we are planning to have our school psychologist to check with both of the students and see how they are doing and respond to their needs. >> parents received a written explanation of what happened and a remainder of the visitor policy. the mom in question is out of jail on bail and under court order to stay away from campus. >> my youngest daughter gets bully weekly because she has a tooth condition and the kids make fun of her. >> watch are your kid being bullyied is awful. >> this is the wrong approach but i have been there, i have wanted to say my peace but i haven't. >> the school says they do not ignore the reports. >> we were not away of the

allegations. we will investigate them. we have a bullying policy. we will follow and investigate and get to the bottom it. >> oakland police are investigating a shoot near kaiser permanente hospital. we were on the scene that happened at west wind lodge. police are questioning a friend of the victim who shot back at the suspect. the victim is expected to recover from his wounds. santa clara prosecutor announced they will ask for the death penalty against this man, garcia torres who is believed to have kidnapped and murdered sierra lamar in 2012. he faces attempted kidnapping charges stemming from a separate attempted carjacking. a jury must fine him guilty of murder and then agree that he should be executed before he goes to death row. we know the identity of a

man who fell to his death off a popular rock in the berkeley hills, the body of 22-year-old from concord was on a trail 100' yesterday afternoon below grizzly peek. he was on a graffiti-covered rock. his honda was packed nearby and there was an open case of beer, second fatal accident from the same rock in two years. a registered sex offender is facing charges for assaulting a woman outside a south bay shopping center. they caught michael garcia a known trance yen, committing the crime. they hear the woman screaming behind the plant shopping center on saturday afternoon and found garcia attacking her. garcia was living in a facility that helped find permanent housing for the homeless. witnesses say the victim has stayed in the same facility. california firefighters are finally getting the upper hand on the fires that have destroyed
