looking. you might see just the opposite. san jose loves water and efforts are failing. water use is increasing here. remember this? he called on californians to conserve water. >> it's not a switch you can turn off and on. >> john tang says the message has been slow to reach customers so tips are being sent with each bill. >> we're hoping as summer months come and people get more information, they'll heed the call. >> water use is up 3% to 4% compared to last year. elsewhere, efforts are better san francisco is reporting 8%.

one degree hotter and i do mean hot. here is a look at highs so far 105 in livermore. triple digits up north. and 89 in napa. 96 san rafael. it's been a very warm day. giving you the forecast you can see fog will be forming, increasing along the coast. and not very much across san francisco bay. so cooling fog at the coast. and temperatures will start to come down. >> spencer, thank you. and hotter temperatures mean higher fire danger. crews are watching hot spots after this fire broke out. a helicopter made a water drop east of boulder creek. this is video posted on facebook

by a nearby resident. and burned about half an acre. >> two firefighters treated for heat exhaustion. the blaze started in a pile of rubbish next to a house under construction. firefighters arriveed and flames jumped into the attic. authorities called a second alarm because of the heat in the area. the cause of the blaze is under investigation >> police investigating tragic death of this toddler in san francisco. a dolphin statue fell on him he climbed the statue outside of fisherman's wharf. it tipped and landed on top of him. initially he didn't appear to have more than a bloody nose but the condition became worse at the hospital. he died four hours after the accident. his family returned to utah. coming up on abc7 news at 5:00

we're going to take a look at how police responded forcing changes to shops this weekend. >> details involving oakland mayor jean quan some saying he was talking on the phone and ran a red light. she turned over her phone records to police the mayor says she isn't sure whether she might have unthe light but says the other car hit hers. . >> i was hit from the rear. and it spun my car around. we're lucky i didn't hit anyone and nobody else was hurt. >> quan was convicted of running a red light in february. she claims waits not stopping on a right turn. days ago pictures surfaced of the mayor using her phone behind the wheel on two occasions. >> a hayward man is facing

charges for driving recklessly through downtown oakland, san francisco that is. crashing into cars, people and taking off. he was booked on four counts of hit and run. police say he hit two pedestrians and one is in critical condition the mustang hit a muni bus and hotel near union square. police say he was speeding and running red lights. it took police a few hours to track him down. >> sonoma county teen faces four felonies after being accused of using a stolen credit card to rent a sports car. today a judge sent the 19-year-old's bail at $1 million. investigators say he paid 13,000ses today rent this mcclairen group and another $27,000 to rent a mansion. >> police need help identifying this person who held up a 7-11 store by threatening the clerk with a hatchet.

now, he's described as a white man in mid to late 20s. police say he took off with cash. >> workers in napa state hospital demanded more safety measures today this, week, violent assaults have been on the increase. abc7 news joins us in the hospital now with the story. vic? >> state government shows the number after tacks on staff and patients in the system have been on the increase these past three years. here, napa state hospital, they instituted some security measures that appeared to be working. but a rash of attacks has workers scared and angry. >> on the night of may 24, i was violently assaulted. >> stephanie did not want her last name used. she's a psych tech, working at

napa state for a decade she was escorting a patient on the grounds of a hospital when sexual assaulted. she says the hospital can help prevent attacks by alerting staff about the more aggressive patients. >> been in seclusion, who has had a sexual assault so we know who we need to be careful for. >> stephanie joined workers to voice support for the bill. legislation that would isolate the dangerous patients >> you separate them out, have enhanced staffing that are trained to provide the treatments they need. >> the workers' demands for a safer work place is four years after a psych tech had been strangled by a patient the hospital implemented new safety measures including a personal alarm for workers to carry and more patrols by police. those at the rally say those

measures had been working. but recently there has been a spike in the number of attacks on staff. rally organizers introduced this female social worker who had been viciously attacked just a week after stephanie was assaulted. >> had to go hospital, suffering fractures and missing teeth. >> adding when it comes to safety they're on the same side of workers and it's a top pry at this time. assembly bill 1340 coming up for a hearing before a senate committee wednesday. >> san jose mayor council member in the upcoming race. surprise, he is one of the mayors in the race. >> i know years that i work with sam what his character is like. because you learn the true test during tough times.

abc7 reporter mary bruce with the story. >> reporter: investigators say the suspects came to this shopping center sunday looking for police officers to kill. >> they believe law enforcement is the oppressor and they're associated with the nazi movement. >> police say the husband and wife jared and amanda miller walked into the pizza restaurant and ambushed two police officers on their lunch break. the two were killed. by bodies killers allegedly placed a swastika and a note declaring the start of a revolution. >> telling the cops it was a revolution. >> they weren't done yet, allegedly entering a walmart, killing a man inside, exchanging gunfire with police before retreating to the back of the store, there, they carried out an apparent suicide pact. amanda miller killing her

husband before shooting herself. >> they were going to kill as many officers they can, and going to do away with themselves. and that they, they didn't believe in the government, feds or cops. they wanted to get rid of as many as they can >> both of the officers are husbands and fathers one has three children, the other leaving behind a newborn baby. >> investigators say the big rig driver that killed a man and injured a comedian tracy morgan had not slept for 24 hours. police say he slammed into a limo bus saturday. morgan is in critical condition with several broken bones. his long time friend james mcnair was killed and three others, injured they were returning to new york from a show in delaware.

the evidence room at police head quarter buzz it's similar to this one at the art gallery at fisherman's wharf. police say he was playing on the statue just outside of the store when it fell on him. first, paramedics thought injuries were minor but after taking him to san francisco general hospital, they realized he had suffered internal injuries. he died four hours later. the family now has a page n you caring asking for money to cover funeral expenses. >> family is doing well as could be expected. and gosh just pulled together and it has been amazing. >> following the accident the store was cited for having it's statues on display beyond this blue line. the port authority owns that section of the sidewalk. >> merchants supposed to keep objects off the port authority property. >> this business
