they keeping the details under wraps. this is an active investigation. they found all three children safe. they were found at 11:30 in richmond. they are okay. the amber alert for the 12-year-old, the six-year-old, and three-year-old have been canceled. their mother, 35-year-old alicia ortez was also found last night. she is considered a suspect in the disappearance or was categorized as of yesterday. i asked police if she is in custody. they say they can't or don't want to say. the amber alert was issued monday morning when the children's father was found shot to death at their home in san pablo in the back yesterday. the kids were gone and so was the mother. neighbors described the dad, oscar, as a nice father who was

always playing with his kids. police say they might be releasing more information this morning by 7:00. they could possibly hold a press conference. the situation is fluid right now. >> oakland police are investigating a situation where a woman and a child were shot before 10:00 last night at 83rd. the victims are in "stable" condition. no arrests have been made. >> that was five hours after another child was shot in oakland, a three-year-old boy was grazed by a stray bullet while riding a transit bus. emergency workers worked the scene near international boulevard at 66th at 5:30 yesterday evening. a man was wounded by gunfire. the man and child are expected

to be okay. >> five service member, all americans, have been killed to an attack in southern afghanistan. it happened in the southern province that is shown here. it does not show the troops involved in the attack. an official tells abc that it is investigated as possible "friendly fire," after forces on the ground came under enemy fire and called phone an airstrike. the airstrike struck too close to the troop location killing them. >> in the bay area, crews in san jose have put out a fire on mount hamilton. this is video from a tower camera that broke out after 10:00 last night near mount hamilton and buns two -- burned two acres. no structures burned. there is no word on what started the fire. >> bart says service will be back to normal this morning after a mechanical problem caused a train to fill with smoke. a rider tweeted these pictures showing smoke inside a train at

the west oakland bart station. bart emphasized it was just smoke and no fire on the dublin/pleasanton-bound train. no one was hurt. there was only a short delay while the train was taken out of service. >> pedestrian suffered head and knee injuries after being hit by a streetcar near san francisco state last night. according to police two men walked along the light rail vehicle and one was hit by the side of the train. the victim was taken to san francisco general with non-life threatening injuries. the accident disrupted rail service on the ocean view line but no expected impact on the commute this morning. >> there was a freak accident that left a two-year old dead. kayson shelton was killed after a 6' tall statue outside a store at the wharf fell on him as he climbed on it. the youngster's family was visiting from it it and they are thankful for san francisco's first responders who tried to

preserved. however, it would create more obstacles for the developer who wants to tear it down. >> the san jose city council will again consider an ordinance recenting medical marijuana dispenselies. last week the city council deadlocked on requiring dispensaries be 1,000 feet away from schools and day care centers and libraries and 150' away from homes. another part of the fordance require -- the ordinance requires growing the product in san jose. >> this will be stricter rules, or will be considered, to characterize e-cigarettes as traditional tobacco cigarettes. that makes them subject to antismoking laws in place now the county. the new rules would require retailers selling e-cigarettes to have a tobacco retailer permit which runs $425 a year. >> hillary clinton's memoir hits store shelves today and last night the former secretary of

at the bay bridge you will find you have to make a detour westbound 580 to each 80 the connection is shut down for road work. that will be the case until further notice. as we take the drive away from sfo into san francisco no delays and nice and quiet and nine minutes gets you from the airport to 3rd street. the toll plaza shows things moving along and traffic is empty with light conditions away from emeryville to san francisco heading away from the maze to the city it will only take you seven minutes. a san francisco bicyclist run over by city street sweeper a year and a half ago will receive a massive settlement from the city. he fractured his pelvis, broke several ribs and suffered other injuries in december of 2012 when the sweeper dragged him. he sued the city claiming negligence. the city attorney has proposed a settlement of $3.75 million.

the city would also pay his hospital bills, totaling $325,000 and the board of supervisors will vote on the settlement today. >> heads up for drivers in the east bay with the caldecott tunnel reverting back to three or four bores the next couple of weeks. they will do work to force them to close bores one and two, the eastbound tunnels, and possibly at the same time but only at night. the work began at 10:00 last night. the work involves realigning the approach to bore two and replacing a median barrier. the fourth bore opened with great fanfare in the fall and the additional bore has saved an average of 10 or 15 minutes of travel for drivers headed in the off-peak direction. >> it is 4:50. coming you, hidden cash is coming out of hiding. the man behind the money speaks out about the plan to expand. >> air b and b wants you to it
