good afternoon, thanks for joining us. i'm cheryl jennings. >> we begin with more violence in an oregon school on the day before classes let out for summer. today a teen-aged gunman entered reynolds high school gym naysish in oregon and opened fire with a rifle, one student was killed and a teacher wounded. >> police say the gunman then killed himself the school was evacuated room by room. students walked out with their arms raised. >> she's okay, but until you hear that vital word, you always have the thought.

>> i am glad to hear from you. >> reports indicate the gunman was a student at the school. authorities aren't releasing his name. in washington, d.c. president obama said he's frustrated congress has not approved any type of gun control laws >> the country has to do soul searching about this. this is becoming the norm. we take it for granted. >> according to an analysis by a group mayors against illegal guns there have been 44 school shootings in the u.s. since the massacre at sandy hook elementary in 2012, that is average three per month. overseas, three u.s. special operation forces are dead after being ambushed. the troops were mistakenly called in by friendly fire. this is one of the worst friendly fire tragedies since

since 2001. >> a san jose father faces charges after his young son suffered serious injuries in a fire works accident. police say they found 14 pounds of fire works and the 10-year-old boy suffered a severe hand injury. >> i think he was shocked. all he was saying to me is i'm sorry. sorry. this kid had no hand. freaked me out. i am still shooken up about it. >> police say the father was arrested on charges of child endangerment and possession of illegal fire works. it's illegal to possess any form of fire works in the city of san jose. >> three east bay siblings the focus of an amber alert are now safe. >> but now, facing phone shall loss of both parents their father is dead and the mother and another man are now under arrest for murder.

>> abc7 news reporter amy hollyfield has the story. >> everyone is safe. >> police are full of relief now that they have found three children alive and well. officers say they had exhausted leads in this case and decided to make a plea through the media yesterday for help. they won't say what happened next, but they found the kids last night, along with their mother, 35-year-old alicia ortez and her acquaintance inside of the home. >> the mother is in custody for homicide. with also a male companion subject in custody for the homicide >> they're accused of killing the childrens' father, found shot to death in the yard of his home. the children were missing. >> the father had custody of the children. and it appears to be that that, i haven't seen any court documentation but that is who they were living with. police say they're doing

interviews and haven't charged the pair with kidnapping but aren't ruling it out. >> there will be additional charges but this point we're mainly focusing on the homicide itself and bringing the children to a safe place. >> i asked police if there are any other family members to take care of them police would only say the children are okay and doing all they can to make sure their needs are being met. in san pablo, abc7 news >> san jose city council is meeting now to once again consider regulating medical marijuana dispensaries. last week, the council deadlocked on basics requiring them to be a thousand feet from schools or day care centers and to grow their own marijuana to ensure none is bought from gangs or criminals the mayor said that is a strong proposal, keeping kids safe. >> we're trying to take care of the bad actors but we do have bad actors causing a lot of

trouble for neighbors we want to stop that. we have regulatory system to do that. we want to make sure people who are entitled to medicinal marijuana can get it safely. >> the pot clubs say those restriction woz put them out of business. there are 90 in san jose. >> the san jose city council discussing a plan tonight to transform downtown in a major transit hub and site for a new a's ballpark, if and when they get that built. here is what it could look like. one of the biggest changes would be at the station that includes adding bart and an elevated structure for high speed rail and 4 million square feet of space. >> a judge ruled teacher tenure in this state is un-constitutional. >> the plaintiff argues it make it too difficult to remove bad teachers. some are hailing the decision

and others, criticizing it. >> after this ruling, cheryl, the superintendent said he's concerned this might make it more difficult to remain good teachers in the classroom. others are telling us they think it's exactly what school kids here need. >> i'm happy. >> the president of the west contra costa school board says a ruling for a los angeles judge that teacher tenure is un-constitutional is a victory. especially for students in his low performing district. >> teaching is hard. it's not a profession everybody needs to be in. and it can't be a situation where they can just stay, now, we're having a conversation about how there are issues around bad teaching. >> they make it almost impossible to fire ineffective

teachers. . >> i don't think this decision will end up having affect. >> the attorney for the california teacher association is based in san francisco. >> tenure serves important state interests such as fostering academic freedoms and also provides teachers the job security they need to make a long run investment in schools. >> we lose half of all new teachers within five years this, decision is not going to do anything to address the core problems our students and teachers face. >> the children come first even fit hurts teachers >> others say the ruling could be good for students if it pushes some out of the door >> if this is not the profession for you, because teaching is hard, find something else, don't make life of a child miserable. >> the supreme court ruling is

many machado let his bat fly and paid the price, suspended for five games. benches cleared after the tossing the weekend filled with machado antics. this followed a tight pitch from the a's reliever. machado fined and suspension goes into effect tonight but he could appeal it. sad news for a's and fans. former pitcher bob welch died in southern california. he was only 55 years old he captured the american league cy young award. that makes him the last pitcher to win 25 games in a major league baseball season he served as special instructor for the a's. the cause of death is unknown but suspicion is heart attack.

it's 19 degrees cooler than it was at this time yesterday. you can see fog and low clouds there from our camera. 66 in oakland, 76 san jose. 84 morgan hill. 59 half moon bay. here is a look at fog at golden gate. 71 now in santa rosa. low to mid 70s in novato and livermore. and fog pushing over the bay. these forecast features foggy around the coast. and bay tonight. cooler pattern but will be warmer by week's end. here is the cloud pattern. you can see low clouds and fog, often this flow brings us warmer

water temperatures along the coastline. that is not the case now though. we take a look at water temperatures you can see only 56 degrees in waters around half moon bay. 57 near san francisco. 56 in bodega bay. cool air inland and in t the -- cool air and water temperatures. during overnight hours, we'll see fog filling in cracks and crevices along coastline, pushing out over the land areas of the santa cruz mountains and north bay valleys. overnight lows will be into low to mid-50s, tomorrow's highs in the south bay low to mid-70s in san jose. about 62 degrees downtown tomorrow. north bay highs into mid-70s. 66 in oakland.

the mayor of a southern california city admits he did toss a bag of feces into a neighbor's yard. the video shows the man tossing poop on to his neighbor's walkway. this is not a random yard the homeowner fought several of the mayor's proposals including

creation of a dog park. police say it's unlike they'll seek charges. >> wow. a mom says she did not think it was possible to give birth to twins 24 day as part the boys are doing well. one is three months older. doctors say mom went into labor in 24 weeks and one baby was born premature. he told the parents keep baby number two in the womb longer. the healthy renaldo important 24 days later. >> this time of the year most 10-year-olds are finishing the fourth grade but one sacramento boy is enjoying a senior moment. he received his high school diploma over the weekend the home schooled protege earned a 4.0 grade point average.
