november and they hoping that san jose has nearly 100 pot clubs and hope to mobilize those who use the pot clubs. this morning, police are searching for a paroleee who violently beat an 89-year-old woman before stealing her car. it happened on sunday afternoon in a c.v.s. parking lot in el cerrito. police identified the suspect as 28-year-old terrance hardy based on a witness description. the woman was found lying on the ground after the attack and has a broken collar bone and ribs. she is hospitalized but expected to survive. amy hollyfield has a report from the scene ahead at 5:30. in san francisco, police are investigating a fatal shooting in the tenderloin neighborhood. officers responded to a report of a shooting before midnight. so far investigators have only said officers found the man dead at the scene. this morning, former bart police

officer is expected to testify in a civil lawsuit filed by oscar grant's father. he said he accidentally shot grand on new year's morning in 2009 and he thought he was firing his taser. he served half of a two-year prison sentence for involunteer manslaughter. grant's father in prison to murder filed a lawsuit claiming that bart foam police chief failed to take any action to reveteran the shooting. the bart previously settled the civil lawsuit filed by grant's mother and daughter. >> today, raymond "shrimp boy" chow will ask a judge to release him from jail. he is one of 29 defendants in a corruption indictment that included state senator yee and has been in custody since march. his lawyer say he reformed and not the gangster he was but the fbi said he returned to his old ways and charged with conspiracy and selling stolen liquor. >> public teachers in the state

could have a nationwide impact in a decision. the judge ruled that tenure and other pres for california public school teachers are unconstitutional. the judge determined the system discriminates against minority and low income students by placing ineffective teachers in their schools. menlo park nonprofit group students matter brought the lawsuit on of behalf nine students who claim they were deprived of a good education. teachers argue it presents the administration from firing them on a whim and helps attract quality teachers. an attorney for the california teachers association believes the ruling will be overturned on appeal. a san francisco mayor and lt. governor are urging the archbishop of san francisco to skip a rally in washington, dc. the archbishop is scheduled to attend an event on thursday hosted by the national organization for marriage and the family research council. they say the groups are the most anti-gay groups in the country. this sends the wrong message if he attends.
